Borough of Somerville, NJ Chapter 179 Food and Beverage Vending Machines

§ 179-1 Permits and Licenses Required.

It shall be unlawful for any person, whether as principal or agent, clerk or employee either for himself or any other person, or for any other corporation or otherwise to:

A. Engage in the operation of one (1) or more machines or devices offered for public use which, upon insertion of a coin, coins or token, or by other means, dispenses unit servings of food or beverages, either in bulk or package, without the necessity of replenishing the devices between each vending operation, without first having applied to and procured a permit from the Board of Health of this borough so to do, or without complying with any and all of the provisions of the most current revision of Chapter XII of N.J. State Sanitary Code as enforced by the Board.

B. Maintain or permit to be maintained on or in any location in this Borough, one (1) or more machines or devices offered for public use which, upon insertion of a coin, coins or token, or by other means, dispenses unit servings of food or beverages, either in bulk or package, without the necessity of replenishing the devices between each vending operation, without first having applied to and procured a license for each such machine or device from the Board of Health of this borough or without complying with any and all of the provisions of the most current revision of Chapter XII of N.J. State Sanitary Code as enforced by the Board.

§ 179-2 Permit and License Fees.

A. The fees for permits and licenses as required by Section 179-1 above, for the purpose of raising revenue for regulation and control to be paid annually to this Borough are hereby fixed as follows:

(1) Permit fee: $20.00 per year

(2) License fee: $100.00 per machine per year.

B. All permits and licenses issued under the authority of this chapter shall expire on the 30th day of June of each year.

C. Permits and license fees herein shall be paid to the Somerville Board of Health.

§ 179-3 Application; Issuance; Transferability.

A. Application for and issuance of such licenses and permits as referred to in this chapter shall be made on forms approved by the Board of Health and be in conformity with the provisions of Chapter XII of the N.J. State Sanitary Code as enforced by the Somerville Board of Health.

B. Such permits and licenses are not transferable.

§ 179-4 Suspension, Revocation or Reinstatement.

Permits and licenses issued under authority of this chapter may be suspended, revoked or reinstated by the Board of Health of the Borough pursuant to the provisions of all applicable State law and local ordinances.

§ 179-5 Penalties.

Any person, firm or corporation who shall violate any of the provisions of this chapter shall, upon conviction, be subject to a penalty not to exceed two hundred dollars ($200) or by imprisonment in the county jail for a period of not to exceed ninety (90) days, or by both such fine and imprisonment; and each violation of any of the provisions of this chapter, and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
