The office of Township Manager is hereby created.
The Township Manager shall be appointed for an indefinite term
by a majority of all the members of the Board of Supervisors. The
Township Manager shall serve at the pleasure of the Board of Supervisors
and may be removed at any time by a majority vote of all its members.
Such removal may be without cause (subject to the terms of any employment
contract) and may be effective immediately.
Solely on the basis of executive and administrative abilities,
with special reference to actual experience and knowledge of accepted
practices in respect to the duties of office as herein outlined, the
Manager shall be chosen. The Manager need not be a resident of the
Township or of the State of Pennsylvania at the time of appointment,
but the Board of Supervisors may require that, within 180 days after
appointment, the Manager shall become and during the tenure of the
office shall remain a resident of the Township.
Before entering upon his or her duties, the Township Manager
shall give a bond to the Township with a bonding company as surety,
to be approved by the Board of Supervisors in such sum as it may require,
as fixed by resolution of the Board of Supervisors, from time to time,
conditioned for the faithful performance of his or her duties. The
premium shall be paid by the Township.
The salary of the Township Manager shall be fixed, from time
to time, by resolution of the Board.
The Board of Supervisors may enter into an employment contract
with the Township Manager which contract accurately sets forth the
various compensation and other employment benefits being offered to
the Manager in exchange for his or her services.

The Township Manager shall be the chief administrative officer of
the Township, and he or she shall be responsible to the Board of Supervisors
as a whole for the proper and efficient administration of the affairs
of the Township. His or her powers and duties shall relate to the
general management of all Township business not expressly by statute
imposed or conferred upon other Township officers.
B.Â
Subject to recall by ordinance of the Board of Supervisors, the powers
and duties of the Township Manager shall include the following:

He or she shall supervise and be responsible for the activities of
all Township departments presently existing or which may hereafter
be established unless expressly delegated by statute, ordinance or
resolution to other Township officers.
(2)Â
He or she shall make recommendations to hire to the Board of Supervisors
and, when necessary for the good of the service, shall recommend suspension
or discharge of all employees under his or her supervision, provided
that persons covered by any civil service provisions of the Second
Class Township Code[1] shall be hired, suspended or discharged in accordance
with such provisions.

He or she shall prepare and submit to the Board of Supervisors 60
days before the close of the fiscal year, or on such alternate date
as the Board of Supervisors shall determine, a budget for the next
fiscal year and an explanatory budget message. In preparing the budget,
the Township Manager shall obtain from the head of each department,
agency, board or office estimates of revenue and expenditures and
other supporting data as he or she requests. The Township Manager
shall review such estimates and may revise them before submitting
the budget to the Board of Supervisors. He or she shall also be responsible
to administer the affairs of the Township within the budget after
its adoption by the Board of Supervisors.

He or she shall, in conjunction with the preparation of the yearly
budget, develop long-range fiscal plans for the Township, such plans
to be presented annually to the Board for its review and adoption.
He or she shall make such recommendations to the Board of Supervisors
concerning policy formulation as he or she deems desirable.

He or she shall hold such other Township offices or head one or more
of the Township departments as the Board of Supervisors may, from
time to time, direct, including, if appointed, but not limited to,
Township Secretary and Township Treasurer, Sewage Enforcement Officer,
Zoning Officer and Code Enforcement Officer.

He or she shall attend all meetings of the Board of Supervisors and
its committees with the right to take part in the discussion, and
he or she shall receive notice of all special meetings of the Board
of Supervisors or its committees.

He or she shall prepare the agenda of each meeting of the Board of
Supervisors and supply facts pertinent thereto.
(8)Â
He or she shall keep the Board of Supervisors informed as to the
conduct of Township affairs, submit monthly reports on the condition
of the Township finances and such other reports as the Board of Supervisors
requests and make such recommendations to the Board of Supervisors
as he or she deems necessary.

He or she shall submit to the Board of Supervisors, as soon as possible
after the close of the fiscal year, a complete report on the financial
and administrative activities of the Township for the preceding year.

He or she shall see that the provisions of all franchises, leases,
permits and privileges granted by the Township are observed.
(11)Â
He or she may employ, by and with approval of the Board of Supervisors,
experts and consultants to perform work and to advise in connection
with any of the functions of the Township.

He or she shall attend to the letting of contracts, with prior approval
of the majority of the Board of Supervisors, in due form of law, and
he or she shall supervise the performance and faithful execution of
the same except insofar as such duties are expressly imposed upon
some other Township officer by statute, ordinance or resolution.
(13)Â
He or she shall see that all money owed the Township is promptly
paid and that proper proceedings are taken for the security and collection
of all Township claims.
(14)Â
He or she shall be the purchasing officer of the Township, and he
or she shall purchase, subject to prior approval of a majority of
the Board of Supervisors and in accordance with the provisions of
the Township ordinances and resolutions, all supplies and equipment
for the various agencies, boards, departments and other offices of
the Township. He or she shall keep an account of all purchases or
see that it is kept and shall, from time to time or when directed
by the Board of Supervisors, make a full written report thereof. He
or she shall also issue rules and regulations, subject to the approval
of the Board of Supervisors, for the use of Township buildings and
equipment. Notwithstanding anything herein contained to the contrary,
the Township Manager shall not have the power and authority to make
purchases or to enter into contracts except with the prior approval
of the majority of the Board of Supervisors.

All complaints regarding services or personnel of the Township shall
be referred to the office of the Township Manager. He or she, or their
designated representative, shall investigate and dispose of such complaints
and the Township Manager shall report thereon to the Board of Supervisors.
If the Township Manager is required for any reason to be absent
from the Township and unable to perform his or her duties, the Board
of Supervisors shall designate one of their members or the office
manager to be Secretary/Treasurer of the Township, if the Township
Manager has also been appointed Secretary/Treasurer. The other duties
of the Township Manager shall be performed by a person so designated
by the Township Board of Supervisors.
