Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Borough.

a. 
The Chief of Police of the Borough, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
e. 
Pursuant to the provisions of N.J.S.A. 39:4-94.2, the Chief of Police of the Borough is hereby authorized to undertake action for the closing of the following County roadways if it is determined that any such roadway closings are necessary for the preservation of the public safety, health or welfare:

Any person who violates this section shall be subject to a fine of not more than $100.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided for by New Jersey statute, or in this chapter, every person convicted of a violation of this chapter or any supplement thereto shall be liable for a penalty of not more than $100 or imprisonment for a term not exceeding 15 days or both.
If any part or parts of this ordinance are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.
All former traffic ordinances of the Borough of Oakland are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance.

a. 
PERSON – Shall mean and include any individual, firm, partnership, corporation, public utility, joint venture or other entity.
b. 
TRAFFIC SAFETY BUREAU – Shall mean the Traffic Safety Bureau of the Police Department of the Borough of Oakland.
c. 
BOROUGH – Shall mean the Borough of Oakland.
d. 
MUTCD – Shall mean the Manual or Uniform Traffic Control Devices of the United States Department of Transportation dated 1988 Edition, and it is hereinafter amended and supplemented as it pertains to the construction, maintenance or utility work which obstructs motor vehicle traffic flow.
e. 
ROADWAY – Shall mean any public thoroughfare within the Borough of Oakland.

When the Borough council finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below the ground which requires blocking the street and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.
The Borough of Oakland, in the County of Bergen, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the MUTCD, except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic.
Any person performing any work on, above or below any roadway in the Borough shall comply with the then existing provisions of the MUTCD and any failure to comply with the then existing MUTCD shall constitute a violation of this section.

a. 
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the street to contact the Police Department of the Borough of Oakland in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of Oakland is in violation of this section.
b. 
No person shall perform any work on, above or below any roadway in the Borough without first having filed and having had approved by the Traffic Safety Bureau a written plan for traffic control at the work site. The performance of any work at the site without any approved traffic control plan shall be a violation of this section.
c. 
To obtain an approved traffic control plan, a person desiring to perform any work on, above or below any roadway in the Borough shall file same in writing with the Traffic Safety Bureau at least 14 days prior to the date on which the work is scheduled to commence. In addition, the person filing the plan shall make himself available for a pre-construction meeting with the Traffic Safety Bureau and/or Chief of Police of the Borough to review the traffic control plan. The Traffic Safety Bureau shall promptly review the traffic control plan and accept or reject it in writing. If the proposed traffic control plan is rejected, specific reasons shall be given by the Traffic Safety Bureau.

The traffic control plan shall designate a contact person and alternate contact person. It shall specify telephone numbers at which these persons may be reached during non-business hours, on weekends and on holidays.
In the event that an emergency or hazardous condition arises at the work site during non-business hours, or on weekends or holidays, the Borough shall seek to contact the designated contact person or the alternate contact person at the telephone numbers provided in the traffic control plan.
If the Borough is unable to reach the contact person and the alternate contact person at the telephone numbers provided, or they fail to appear at the work site after being contacted, the Borough is hereby empowered without any liability whatsoever, to make any disposition of any property or equipment on the work site as is necessary, and without further notice, to undertake any work, labor or service at the work site to correct or abate the hazardous or emergency condition at the sole cost and expense of the person who filed the traffic control plan.

Road closing and/or traffic detours shall not be permitted unless approved in advance of the Traffic Safety Bureau or Chief of Police.

a. 
Traffic directors shall be posted at all construction or maintenance sites when determined by the Traffic Safety Bureau or the Chief of Police that same is necessary to provide for the safety and expeditious movement of traffic.
b. 
Any person performing work on, below or above any roadway in the Borough shall, at their own cost, use a representative of the Police Department to guide traffic through and around the work area safely and expeditiously. Such representatives shall be paid in accordance with contractual agreements between the governing body and the employee's department.

No person shall use a roadway for the storage of materials, equipment or vehicles without the prior approval of the Traffic Safety Bureau or the Chief of Police or until all construction, signs, light devices and pavement markings are installed.

a. 
The Chief of Police of the Traffic Safety Bureau shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.
b. 
Upon issuance of a stop work order by the Traffic Safety Bureau or Chief of Police, each of whom is specifically hereby authorized to issue such orders, all materials, equipment and vehicles placed on a roadway of the Borough shall be forthwith removed, any excavation shall be back-filled and repaved or covered with metal plates, under/or nuisances, public or private, shall be abated.

No person shall commence working on, above, or below any roadway in the Borough before 7:00 a.m. or continue working after 5:00 p.m. prevailing time, except that the Chief of Police or the Traffic Safety Bureau may in the interest of safety, designate later starting times and earlier ending times. No person shall perform any such work, except in the case of an emergency, without the prior approval of the Traffic Safety Bureau or the Chief of Police on any Saturday, Sunday or legal holiday.

Any person who violates a provision of this section may be subject to the imposition of a fine in the Municipal Court of the Borough of up to $500 or the imposition of a term of community service as the Judge of the Municipal Court shall deem fit.
In the case of a continuing violation, a separate violation of this section shall be deemed to be committed for each calendar day that the violation occurs on or continues.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police, or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires and public celebration, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
When snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on any street or highway within the Borough of Oakland.
The parking prohibitions shall remain in effect after the snow has ceased until the streets or highways have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

No person shall park a vehicle on streets or parts of streets as described within the following sections unless an appropriate and current parking permit as issued by the Borough of Oakland is displayed on said vehicle for those streets or parts of streets as described or listed within the following sections.
a. 
General Hardships. Any owner or tenant of a residence in the Borough may apply to the Oakland Police Department Traffic Bureau for an annual street parking decal if there is insufficient or nonexistent off-street parking in the area of the residence. The Traffic Officer and the Borough Construction Official or his designee shall investigate to determine whether a hardship exists. If one is found to exist, the Chief of Police shall approve the application and issue a street parking decal for a period of one year, upon payment of a fee of $10. The applicant shall affix the decal to the vehicle's rear side window on the driver's side. The application for a street parking decal shall be renewed by the applicant annually thereafter. It shall be the responsibility of the applicant to remove the decal upon transfer of title to the vehicle.

b. 
Seasonal Hardships. If, due to seasonal conditions, an owner or tenant of a residence has insufficient or nonexistent off-street parking, an application for a temporary street parking decal may be made and the same procedure as provided for in paragraph b above shall be followed, except that the temporary decal shall be valid for a maximum period of 90 days.
c. 
Exceptional Situations. An exceptional situation shall be deemed to exist when insufficient parking exists at a residence during any twenty-four-hour period caused by a meeting, gathering, party or other occurrence at the residence, provided that the owner or tenant notifies the Police Department. Prohibited parking regulations shall not apply for 24 hours from such notification.
d. 
No Exceptions During Emergencies or Snowstorms. The issuance of either a street parking decal or a temporary authorized street parking decal as provided in paragraphs b and c and exemption from parking regulations under an exceptional situation as provided in paragraph d shall not exempt any owner or tenant from fully complying with all parking regulations during any snowstorm or other emergency requiring free access to emergency vehicles, including snowplows.

No person shall park any truck or vehicle over three tons registered gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer between the hours specified upon any Borough streets.

a. 
Commercial Vehicle Defined. A commercial vehicle is defined for purposes of this chapter as any motor driven vehicle used or designed to be used for commercial purposes or highways and roadways or in construction whether or not the vehicle is registered as a commercial vehicle or bears commercial type license plates.
b. 
Overnight Parking of Vehicles Over 10,000 Pounds.
1. 
Except as hereafter provided in paragraph b, no commercial vehicle exceeding 10,000 pounds in gross weight shall be parked overnight on any property in any residential zone except for construction equipment which is being used in connection with actual ongoing construction on the property.
2. 
A person who prior to the effective date of this section parks overnight a commercial vehicle on a lot in a residential zone which would be prohibited under paragraph a, may continue to park overnight such a commercial vehicle on the following conditions:
The person may park only one such commercial vehicle on the residential property. The commercial vehicle shall (a) not weigh more than 18,000 pounds gross weight; (b) not be longer than 24 feet; (c) not be more than 10 feet in height; and (d) have no more than six wheels. The person shall register the vehicle and the address of the residential property at which it is parked with the Police Department of the Borough of Oakland within 30 days of the effective date of this section. The person who registers such a vehicle with the Borough's Police Department shall have the right to park overnight at the same property a replacement vehicle of similar size and weight provided that each such replacement vehicle is registered with the Borough's Police Department.
c. 
Overnight Parking of Vehicles Less Than 10,000 Pounds in Single Family Residential Zones. Only one commercial vehicle with a gross weight of less than 10,000 pounds may be parked overnight outdoors on any property in a single family residential zone (RA-1, RA-2, RA-3) provided that it is parked a minimum of 10 feet from any property line, (2) parked on a paved area or a defined graveled area, (3) owned or used by the owner of the premises or a resident in the premises, and (4) all accessories to the vehicle, such as trailers, are parked on a paved area or a defined graveled area.
A person who resides at property which does not have a paved area or defined graveled area, shall install either of same at a location on the property approved by the borough's Property Maintenance Officer within 60 days of the effective date of this section.
A person who because of an unusual condition of his property, may apply to the Borough's Police Department to park his commercial vehicle within 10 feet of the property line of his property and upon approval by the Police Department, may park his commercial vehicle at such a location.
d. 
Overnight Parking of Vehicles Less Than 10,000 Parking in Multiple Family Residential Zone. In a multiple family residential zone, a cluster residential zone, a special zoning district which includes multiple family residences, and a townhouse zone, only one commercial vehicle weighing less than 10,000 pounds gross weight, including a bus with a seating capacity of 11 or less passengers, may be parked overnight outdoors by any one resident of a multiple dwelling, townhouse or other residence provided that: (1) it is parked more than 10 feet from any dwelling not owned or occupied by the resident who owns or uses the commercial vehicle, (2) the commercial vehicle is actually owned or used by the resident parking it overnight, and (3) it is parked a minimum of 10 feet from any property line and on a paved area.
e. 
Violations. Before a summons is issued for a violation of any provision of paragraphs a through d of this subsection, the Borough's Police Department shall issue a written notification of the violation and advise the person that unless such violation is corrected within 30 days, a summons shall be issued.
A person convicted for the first time of a violation of any provision of this subsection shall be fined not more than $100. A person convicted of a second or subsequent violation of any provision of this subsection shall be fined not less than $100 or more than $500.

The owners of the premises referred to subsections 7-38.3, 7-38.4 and 7-38.5 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at not cost or expense to the Township of Gloucester. The owner shall be responsible for the repair and restoration of same.

In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate or park a vehicle in violation of the regulations indicated.
a. 
Municipal Property.
1. 
Parking on Firehouse Property Prohibited. It shall be unlawful for any person to park or leave standing any vehicle upon any Borough Firehouse property in any area thereon where no parking signs, as hereinafter provided, shall have been posted. The provisions of this subsection shall not apply to bona fide members of the Borough Fire Department who are responding to an alarm or otherwise engaged in Fire Department activities.
b. 
Board of Education Property.
1. 
Parking on Board of Education Property Prohibited. No person shall park a vehicle at any time upon any Board of Education property in any area thereon where no-parking signs, as hereinafter provided, shall have been posted pursuant to authorization of the Board of Education having jurisdiction over such property.
2. 
No-Parking Signs To Be Posted. Suitable signs as required in the Manual on Uniform Traffic Control Devices bearing the words "No Parking, Chapter 7 of the Oakland Code Strictly Enforced", together with any qualifications or restrictions of such parking, if any, and conspicuously displayed, shall be posted on the lands by the owner, occupant, lessee or licensee thereon where the terms of this section are sought to be made effective. The defacing, tampering with, or damaging of such signs, when posted, shall constitute a violation of this section.
3. 
Vehicles May Be Towed Away. Where no-parking signs have been posted, pursuant to the provisions of this subsection along any driveway or passageway on Board of Education property for the ingress and egress of vehicles and there is also posted on the same station as the no-parking sign a tow-away sign as hereinafter described, any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic on such driveway or passageway, and any peace officer may provide for the removal of such vehicle. The owner of the vehicle shall pay the reasonable costs incurred by the removal and storage of the vehicle before regaining possession of the same.
4. 
One-Way Streets and Driveways on Board of Education Property. The Board of Education shall have the right to determine that any driveway, aisle, etc., on public school property shall be used for one-way traffic only and shall have the right to authorize the posting of suitable signs indicating one-way traffic and the direction of traffic. Such driveways, aisles, etc., shall then be defined as one-way streets within the intendment of Title 39 of the New Jersey Statutes.
5. 
Passenger Loading and Unloading Zones on Board of Education Property. The Board of Education shall have the right to determine the location of a passenger loading and unloading zone upon any area of the public school property and shall have the right to authorize the posting of suitable signs indicating the same as hereinafter provided. The purpose of the zone shall be for the discharge and loading of passengers into private vehicles and school buses. Any unoccupied vehicle parked or standing in this zone shall be deemed to be a parked vehicle in violation of paragraph a of this section. All signs must be installed and constructed pursuant to N.J.S.A. 39:4-198.
c. 
Indian Hills High School.
1. 
Request to Enforce Traffic Regulations. The Ramapo Hills Regional High School Board of Education has filed a written consent with the Borough of Oakland that the provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots at the Indian Hills High School located in the Borough of Oakland, County of Bergen and the following regulations shall be enforceable.
2. 
General Parking.
(a) 
All vehicles must park in designated areas between the lines provided.
(b) 
No person shall stop or stand a vehicle upon any of the streets or parts of streets described below, except in areas covered by other parking restrictions.

Unless another penalty is expressly provided for by the New Jersey Statute, every person convicted of a violation of this ordinance or any supplement thereto shall be liable for a penalty in accordance with Section 7-4 of Chapter 7 of the Revised General Ordinances of the Borough of Oakland.
f. 
Long Hill Plaza Shopping Center.
1. 
Request to Enforce Traffic Regulations. The Long Hill Plaza Shopping Center has filed a written consent with the Borough of Oakland that the provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots at the Long Hill Plaza Shopping Center located in the Borough of Oakland, County of Bergen and the following regulations shall be enforceable.

Penalty. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $200 or imprisonment for a term not exceeding 15 days or both.
In accordance with the provisions of N.J.S.A. 39:5A-4, the regulations of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable to the properties listed below.

The owners of the premises referred to in subsection 7-38.2 and 7-38.3 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Oakland. The owner shall be responsible for the repair and restoration or replacement of same.

No person, with the exception of police or other police personnel, shall stop, park or otherwise stand any vehicle in parking spaces at the rear of the police headquarters facility, in spaces which are designated "Police Personnel Only."
Any violator of this section shall be subject to the provisions of Chapter 7-3, entitled "Tow-Away," and 7-4, regarding penalties.
