The owner or occupant of all premises where there is now located
a privy vault shall, on or before February 1 of each year, apply to
the Board of Health for a license before making use of the privy.
The application shall set forth the name, address and phone number
of the owner of the premises, the name, address and phone number of
the tenant, the number of persons that will be occupying the premises,
including adults over the age of 18 years and children under the age
of 18 years, and such other information as the Board of Health may
see fit, within its discretion, to include in the application. The
application shall also set forth a plan showing the number and location
of the privies upon the premises and whether there has ever been a
previous violation with the use of privy vaults on the premises.

Every privy vault shall be cleaned or emptied when necessary
or when the owner or occupant is notified to clean the same by the
Board of Health. All privy vaults shall be cleaned only by a licensed
entity equipped to perform the work and the work shall be completed
within five days from commencement thereof. The notice provided herein
shall be mailed to the owner or occupant, addressed to the premises
where the privy vault is located, and all work to clean or empty a
vault shall commence within five days of the receipt of the notification
from the Board of Health.

The fee for the license shall be the sum of $5. The license
shall expire on February 1 following the date of issuance.

In the event that the owner or occupant of the premises maintains
the privy in violation of the law or of the State's Sanitary Code
or any ordinance or rule of the Board of Health, the license, so issued,
shall be revoked if the condition causing such violation is not so
cured within five days from receipt of notification.

Nothing herein shall be construed as granting the right to any
person, firm or association to construct any privy vaults, the purpose
of this chapter being to regulate all existing privy vaults.

In the event that the use of the premises is terminated by the
owner or tenant for a period of one year or if the owner shall fail
to use the property for a period of 12 consecutive months and not
have the privy license renewed on February 1 of the following year,
this shall be presumptive evidence that the premises has been abandoned,
and the Board of Health shall have the right not to renew the privy
license.

On December 31 of each year, the Secretary of the Board of Health
shall send to each individual who has obtained a privy license on
February 1 of that year an application for a new privy license, by
certified mail, return receipt requested, along with an appropriate
notice stating that if the privy license is not renewed by February
1 of the following year, in accordance with this Chapter, then the
premises shall be no longer eligible for licensing under this Chapter.
