The power of the municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. N.J.S.A. 39:4-8 and N.J.S.A. 39:4-202 require that all traffic and parking ordinances be approved by the Commissioner of the Department of Transportation (except as provided in N.J.S.A. 39:4-8(b).
This Chapter 7, Traffic, received approval from the Department of Transportation October 20, 1992.

As used in this chapter, words and phrases concerning traffic shall have the meanings ascribed to them in N.J.S.A. 39:1.1.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time, as may be in current use in the Township.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, in any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY — NO PARKING signs are displayed. The Chief of Police, or in his absence the ranking police officer, is authorized to declare an emergency and to direct the posting of EMERGENCY — NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY — NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon signs being erected as required by law.

The parking of any commercially registered vehicle upon a public street within the Township shall be prohibited during the hours of 12:00 midnight to 6:00 a.m.

Pursuant to N.J.S.A. 40:67-16.1, nothing in this section shall be construed to prevent such trucks from picking up or making deliveries of merchandise or other property along streets from which such trucks would otherwise be excluded, nor shall the provisions of this section be construed to exclude emergency vehicles, Township or other governmental trucks, or trucks used by public utility companies in connection with the construction, installation, operation, or maintenance of public utility facilities. Trucks picking up or making deliveries of merchandise or other property shall proceed from a truck route to a point of delivery or pickup and return thereto by the shortest and most direct route available.

Streets forming the truck routes as established above shall be conspicuously marked by signs so placed and maintained to clearly show the truck routes by both day and night. Such signs shall comply with all applicable requirements of N.J.S.A. 39:4-198.

The following locations shall be designated and reserved as handicapped parking spaces for persons who have a motor vehicle identification placard or license plate, as issued by a state motor vehicle department, and the operator of the parked vehicle has the appropriate wallet identification card in his/her possession. All stalls shall be 12 feet wide and signed with the R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permit by the Division of Motor Vehicles. The provisions of Chapter 18 as to handicapped parking shall be applicable. No other persons shall park at these locations:

Every person convicted of a violation of a provision of this section or any supplement thereto shall be subject to the penalty provisions as set forth in the section entitled Penalty of Chapter 7, Traffic.

There shall be no parking of vehicles at any time between the hours of 12:00 midnight and 6:00 a.m. in or upon any of the parking lots or school grounds owned by the Board of Education of the Watchung Hills Regional High School District, located on Stirling Road, unless the board of education has expressly granted permission for the parking of such motor vehicles during such prohibited hours.
Except as hereinafter indicated, no person shall park a motor vehicle at any time on any of the school grounds, including roadways or parking lots thereon, except in those areas specifically reserved for the parking of vehicles and designated by parking spaces outlined in white lines and subject to the following restrictions:
a. 
Reserved Areas. All parking spaces shall be numbered and only those motor vehicles for which a permit has been duly issued by the board of education shall be permitted to park in the reserved parking area. All motor vehicles permitted to park in the reserved area shall be properly identified with an appropriate decal issued by the school district conspicuously attached to such vehicles.
b. 
Visitors Parking. Visitors are permitted to park in areas designated for such purpose on days that school is actually in session and during permitted hours.
c. 
Special Events. The parking restrictions outlined in this section shall not apply for the periods of time during which special events are conducted upon school premises to which members of the public are invited. Parking during such special events shall be in accordance with regulations established by the board of education and as implemented and directed by its duly authorized representatives.

Whenever any words and phrases are used in this section, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of this section or any supplement thereto shall be liable for a penalty of not more than $51 or imprisonment for a term not to exceed 15 days, or both.

When conditions so warrant, the mayor shall declare a state of snow emergency in the Township which shall have the effect of restricting the use of public streets and sidewalks as hereinafter set forth. The mayor shall communicate such declaration to the Township Administrator, Township Clerk, Director of Public Works and Chief of Police and shall confirm such declaration in writing. The mayor shall likewise declare an end to the snow emergency as conditions warrant.

During a period of declared snow emergency in the Township, no person shall park a motor vehicle on a public street.

At no time, whether a state of snow emergency has been declared or not, shall any person deposit snow or ice on a public street or sidewalk or cause same to be so deposited.

A police officer or employee of the Township shall first make a reasonable attempt to request the person responsible for an apparent violation of this section to rectify the condition. If the same is not promptly accomplished, a summons and complaint shall be issued. A motor vehicle obstructing snow clearing operations may be towed and the costs of towing imposed on the owner thereof.

Definitions. For purposes of this subsection, the following phrases and words shall have the following meanings:
ELECTRIC VEHICLE
A vehicle that operates either partially or exclusively on electric energy from a charging station or other electric energy source that is stored in a vehicle’s battery for propulsion purposes. "Electric vehicle" includes a battery electric vehicle, a plug-in hybrid electric vehicle, a neighborhood electric vehicle, and electric scooters or electric motorcycles.

Parking between the hours of 10:00 p.m. and 6:00 a.m.
b. 
Public parking spaces for charging of electric vehicles. The Township may designate parking spaces for use as electric charging stations within the Warren Municipal Complex. Use of said charging station spaces shall be limited and restricted as follows:
1. 
It shall be unlawful for any person to park or leave a vehicle standing in a designated stall or space unless the vehicle is an electric vehicle and is connected for electric charging purposes.
2. 
Nonelectric vehicles are prohibited from parking in the charging station spaces within the Warren Municipal Complex.
3. 
Electric vehicles are authorized to park in the spaces designated within the Warren Municipal Complex as charging spaces only during the time the vehicle is connected for electric charging purposes. When the vehicle is no longer charging, the owner or operator of said vehicle shall be required to remove the vehicle from the charging station space.
4. 
No electric vehicle shall be connected to an electric charging station within the Warren Municipal Complex for more than two hours.
5. 
No electrical vehicle parking shall be permitted overnight.

Old Stirling Road, between its intersection with the northerly sideline of Mountain Avenue and the Township of Passaic border (the Passaic River), a distance of approximately 3,280 feet, is hereby closed to all public traffic.
The existing roadway described above will no longer be maintained by the Township of Warren.
The Warren Township Superintendent of Public Works is hereby directed to install and maintain a barrier at each terminus point of the aforesaid closed portion of Old Stirling Road which will prevent the public from utilizing the same and also to install signs at those locations advising the public of the said closing.
The superintendent of public works is hereby directed to effectuate a cleanup of all debris within the right-of-way of the above-described portion of Old Stirling Road and any Warren Township-owned lands adjoining the same and that the Warren Township Police Chief take whatever actions are necessary to have any privately owned property adjoining the aforesaid portion of Old Stirling Road cleaned of debris.
The use of the roadway, in its unmaintained condition, is reserved for the benefit of public utility companies for the purpose of ingress and egress over and upon same in order to maintain, repair or replace existing or future utility facilities, if any, including water lines, gas lines and telephone, electrical and cable television wires and poles, which may be located beneath the surface of the foregoing premises or above the same.

The Township Committee is hereby authorized to designate, by resolution, an area within the Township as a park and ride commuter area restricted to vehicles bearing a valid Township-issued parking permit.

As used in this section, the following terms shall have the following meanings:
PERMIT
A parking permit issued by the Warren Township Clerk for use of the Warren Park and Ride.
WARREN PARK AND RIDE
The area designated by the Township Committee as a park and ride commuter area restricted to vehicles bearing a valid Township-issued parking permit.

a. 
The parking of licensed motor vehicles at the Warren Park and Ride shall be permitted only between the hours of 5:30 a.m. and 9:00 p.m., Monday through Friday, subject to the regulations set forth in this section.
b. 
All motor vehicles must display a valid parking permit issued by the Township of Warren, clearly visible and hung from the rearview mirror.
c. 
Parking shall only be permitted in the area designated as the Warren Park and Ride. No parking in any area not specifically designated as the Warren Park and Ride shall be permitted for park and ride purposes.
d. 
The Warren Township Police Department is authorized to prohibit parking at the Warren Park and Ride whenever necessary for the public safety when an emergency situation exists.
e. 
A parking permit shall not be transferable.
f. 
Parking permits shall be issued on a first come, first served basis.

All parking at the Warren Park and Ride shall be at the vehicle owner and/or operator's own risk, and the owner and/or operator waives any rights or claims of liability against the Township of Warren for any loss or damage resulting from parking at the Warren Park and Ride.

a. 
Any person violating the provisions of this section shall, upon conviction for a first offense, be punished by a fine not to exceed $100.
b. 
Any person violating the provisions of this section shall, upon conviction for a second offense, be punished by a fine not to exceed $200.
c. 
Any unoccupied vehicle parked in violation of this section may be removed by the Warren Township Police Department. The owner of such removed vehicle shall pay the reasonable costs of removal and storage, before regaining possession of the vehicle.

a. 
Pursuant to N.J.S.A. 39:5A-1, the owner of property located at Block 4, Lot 88.08, more commonly known as 41 Mountain Boulevard, has requested in writing that all applicable traffic and parking provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be enforced by the Warren Township Police Department upon the private and/or semipublic roads, driveways and parking lots within the boundaries of the lot identified as Block 4, Lot 88.08 on the Tax Map of the Township of Warren.
b. 
All signs, posts or other necessary materials utilized for traffic and parking control shall be installed and maintained exclusively by the owner and/or operator of the lot identified as Block 4, Lot 88.08 on the Tax Map of the Township of Warren and conform to the current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
c. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of this section or any supplement thereto shall be liable for a penalty of not more than $51 or imprisonment for a term not to exceed 15 days, or both.
