[Ord. 7-15-59 § 1]
Before work is commenced on the construction of a swimming pool or family pool or on any alteration, addition, remodeling or other improvement to a swimming pool or family pool, an application for a permit to construct and the plans and specifications and pertinent explanatory data shall be submitted to the Board for its approval, and no part of the work shall be commenced until the Board has granted such approval by a written permit to construct and has further evidenced its approval by a suitable endorsement upon such plans and specifications. No Department of the Borough charged with the duty of issuing permits for building, plumbing or electrical work, for sewer connections or for other work in connection with the construction of a swimming pool or the construction of any alteration, addition, remodeling or other improvement to a swimming pool or family pool shall issue a permit for a swimming pool until the plans and specifications therefor have been approved by the Board. The Board shall review such plans and specifications to determine whether they comply with the provisions and requirements.
The application to the Board for a permit to construct a swimming pool or family pool or to construct any alteration, addition, remodeling or other improvement to a swimming pool or family pool shall be submitted in such forms and be supported with such information and data, as well as plans, specification and pertinent explanatory data, as the Board may require pursuant to its rules and regulations promulgated hereunder.

Plans, specifications and pertinent explanatory data required to be submitted in connection with an application for a permit to construct a swimming pool or any alteration, addition, remodeling or other improvement to a swimming pool shall comply with the following requirements and include the following plans and information as well as such other data as may be reasonably requested by the Board:
a. 
Plans shall be drawn to scale indicating all dimensions, including the length, depth and width of the pool deck;
b. 
A profile plan showing the same information shall also be required;
c. 
A cross section of scum gutters and or skimmers;
d. 
Pipe diagrams showing size of all pipes, inlets, outlets, make-up waterlines, vacuum lines, waste and discharge lines, circulation and other piping;
e. 
The pool equipment room layout, showing filters, their location, pumps, chlorinators, chemical feeders, flow meter gauges, sight glass, strainers, hair and lint interceptors, dimensions of filter room, its location, floor drain, sumps and other pertinent information.
f. 
The liquid capacity of the pool;
g. 
The liquid capacity of any wading pool;
h. 
The kind, number, and size of filters, including the square footage of the filter area in each unit;
i. 
Top capacity in gallons per minute;
j. 
A description of chemical feeders for soda ash and alum;
k. 
The type, kind and description of chlorinator;
l. 
A description of the gauges and water flow meter;
m. 
A description of the skimmers and or scum gutters;
n. 
The type and range of testing equipment, including chlorine.

In addition to such other requirements as may be reasonably imposed by the Board through rules and regulations promulgated hereunder, the Board shall not issue a permit to construct or approve the construction of any swimming pool or any alteration, addition, remodeling or other improvement to a swimming pool hereunder unless the flowing design and construction requirements are observed in such construction and swimming pools shall be constructed and maintained in conformity with the following requirements.
a. 
Material. The material used for lining artificial swimming pools shall be one which is light in color, is impervious, and will provide a tight tank with smooth and easily cleaned surfaces. Sand or dirt bottoms therefor are prohibited.
b. 
Walls, Markings and Slope. The walls of the pool shall be vertical. Conspicuous markings shall be provided showing the location and depth of the shallow and deep portions, and the location and depth of the points where the slope of the bottom of the pool changes. Special markings shall be necessary for large and odd shaped pools as prescribed by the Board.
c. 
Overflow Gutters. Overflow gutters shall be provided extending completely around the pool, having adequate drainage of overflow water away from the pool.
d. 
Inlets and Outlets. All pools shall be provided with at least two outlets at the deepest point of sufficient size to permit the pool to be completely drained or emptied, as prescribed by the Board. The outlet openings in the floor of the pool shall be designed and located to reduce suction currents and shall be covered with a proper grating. Inlets for fresh or repurified water shall be submerged and located so as to produce as nearly as possible a uniform circulation of water through the entire pool.
e. 
Separate Space for Bathers and Spectators. The design of the locker room, shower rooms and pool shall be such as to provide proper routing of bathers and complete separation of bathers and spectators. Enclosures sufficiently high and strong to keep spectators outside the runways of the pool shall be provided. The pool shall be completely surrounded by a walkway at least four feet in width.
f. 
Heating. All indoor pools which are to be used when the outside temperature is below 60° F. shall be provided with facilities for uniform and adequate heating of the pool room, dressing rooms, and water in the pool.
g. 
Water in Pool. The water in the swimming pool shall meet the requirements of the Board for a safe drinking water supply.
h. 
Recirculation. For new pools provision shall be made for complete circulation of water through all parts of the pool. The system shall be designed and constructed so that a "turnover" of at least one time in each six-hour period shall be provided. The installation in new pools of the "fill and draw" type of circulation shall not be permitted. For pools already in existence the Board shall furnish the owners with a program of improvements and additions which shall be carried out over a period not to exceed five years in order to comply with the requirements of the Board for new pools. If, however, the "bathing load" of the pools already in existence is not excessive according to standards prescribed by the Board in rules and regulations promulgated hereunder, the Board may designate for such swimming pool the maximum number of bathers allowed at one time, or during any one day, and such maximum shall not be exceeded. The "bathing load" allowable for any existing pool shall be computed according to accepted public health standards, and the action of the Board in this regard shall be final.
A satisfactory recalculating system for the swimming pool shall be installed consisting of circulating pumps, chemical dozing equipment (alum and alkali) or surge tank, float valve control on water supply, hair and lint catcher, chlorinator, indicator, recording and totalizing instrument, flow meters, pressure gauges, and piping connections to inlets and outlets; and all other necessary fixtures and connections.
i. 
Shower Baths. Adequate shower facilities with hot and cold water and adequate in number for both males and females shall be provided. All persons entering the pool shall be required to take a cleansing shower bath and soap therefor shall be provided.
j. 
Cross Connections. All cross connections between the Borough water supply or the sewer system shall be constructed in a manner approved by the Board.
k. 
Indicating, Recording, Totalizing Instruments, Etc. When necessary, in the opinion of the Board, indicating, recording, totalizing instruments, flow meters or indicators and pressure gauges shall be installed at such points as may be designated by the Board.
l. 
Hair and Lint Interceptors. Hair and lint interceptors shall be installed so that all water drawn from the pool for recirculation shall pass through the hair and lint interceptors before reaching the filter.
m. 
Drinking Water. Lavatory and drinking water supplies shall be adequate in quality and quantity.
n. 
Walks. Walks providing ingress and egress to the swimming pool must be of ample size and satisfactorily drained.
o. 
Lighting. Satisfactory lighting must be provided for all accessory and appurtenant facilities.
p. 
Hose. Hose connections and hose must be of ample size and pressure to clean all of the pool area.
q. 
Steps. Steps and ladders must be of an impervious material, easily cleaned and must be so designed as not to collect water when the water is lowered in the swimming pool.
r. 
Pollution. Swimming pools must not be exposed to excessive pollution by dust, smoke, soot or other undesirable substances.
s. 
Disinfecting Equipment. Disinfecting equipment adequate for the purpose must be provided as an integral part of the swimming pool.
t. 
Accessibility of Equipment. All equipment must be readily accessible and every pool shall be provided with necessary equipment for the measurement of acidity or alkalinity and for residual determinations. The equipment room shall be satisfactorily located and adequately drained.
u. 
Dressing Rooms. Dressing rooms shall be adequately designed, located, drained, equipped, lighted and ventilated.
v. 
Toilets. Toilet facilities shall be provided and shall be adequately designed and located with separate facilities for men and women.

Every outdoor swimming pool or family pool shall be completely surrounded by a fence or wall not less than four feet in height, which shall be so constructed as not to have openings, holes or gaps larger than four inches in any dimension except for doors and gates; and if a picket fence is erected or maintained, the horizontal dimension shall not exceed four inches. A dwelling house or accessory building may be used as part of such enclosure.
All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use, except that the door of any dwelling which forms a part of the enclosure need not be so equipped.
This requirement shall be applicable to all new swimming pools or family pools hereafter constructed, other than indoor pools, and shall apply to all existing pools which have a minimum depth of 18 inches of water. No person in possession of land within the Borough, either as owner, purchaser, lessee, tenant or a licensee, upon which is situated a swimming pool or family pool having a minimum depth of 18 inches shall fail to provide and maintain such fence or wall as herein provided.
The Board may make modifications in individual cases, upon a showing of good cause with respect to the height, nature or location of the fence, wall, gates or latches, or the necessity therefor, provided the protection as sought hereunder is not reduced thereby. The Board may permit other protective devices or structures to be used so long as the degree of protection afforded by the substitute devices or structures is not less than the protection afforded by the wall, fence, gate and latch described herein. The Board shall allow a reasonable period within which to comply with the requirements of this subsection.

All reasonable precautions shall be taken to protect the users of and bathers in swimming pools and family pools from injury or accident. Convenient means of ingress and egress shall be provided and the depth of water and any irregularities of the bottom shall be clearly indicated. Safety appliances such as lifebuoys, life hooks, bamboo poles, or ropes and equipment including first aid kits shall be provided and be readily accessible. A sufficient number of attendants shall be on duty when the swimming pool is in use who shall be capable swimmers, competent in lifesaving methods and artificial resuscitation.

No person shall operate or maintain a swimming pool or family pool until a license therefor shall have been issued by the Board which license shall not be valid for longer than one year from the date of issuance. A new license must be secured on or before May 1 of each year, which will permit operation or maintenance until the following April 30. All licenses shall be in writing and shall state the conditions thereof and the terms for which the license is granted. It shall be unlawful for any person to conduct, operate, maintain or manage any swimming pool without complying with the requirements of this Code, and the Board is charged with the enforcement of the provisions hereof. The Board is hereby authorized to promulgate rules and regulations for the construction, operation and maintenance of swimming pools and family pools for the protection and promotion of the public health, safety, morals and public welfare.

Any license granted by the Board hereunder may be revoked by it for failure to comply with its rules and regulations promulgated hereunder or with this Code, or whenever, in the determination of the Board, further operation under such license creates a menace to the health, safety or morals of the users of the swimming pool or family pool; provided, that the holder of any license which has been revoked may appeal to the Borough Council the Board's revocation of the license and may have the Borough Council determine the legality or reasonableness of the revocation of the license. No appeal under this subsection, however, shall entitle the license holder to continue operation of the swimming pool or family pool pending action by Borough Council.

No person having any skin eruptions or abrasions, sore or infected eyes, a cold, nasal or ear discharge, or any communicable disease shall be permitted to use a swimming pool or family pool. Spitting, spouting water, or blowing the nose in the swimming pool shall be strictly prohibited. The operator of a swimming pool shall post suitable placards embodying such personal regulations and instructions.

The buildings, grounds, dressing rooms, and all other swimming pool or family pool facilities shall be kept clean and in a sanitary condition and maintained free from garbage, trash and other refuse.

Visible dirt on the bottom of swimming pools and family pools and visible scum or floating matter on the surface of pools shall be removed at least once daily with an approved type vacuum cleaner or as often as necessary to maintain good sanitary conditions. All swimming pools shall be thoroughly cleansed at least once each week in a manner and by the use of such disinfecting agents or cleansing materials as may be required by the Board, and all such pools shall be emptied and the water therein completely changed at least twice each week.

The Board shall inspect or cause to be inspected all swimming pools and family pools within the Borough at such times as it may deem necessary to carry out the intent of this Code. The Board is hereby authorized to enter upon any premises, private or public, to take such samples of water from such pools at such times as it may deem necessary and to require the owner, proprietor or operator to comply with this Code. In the event of the failure of compliance after due notice with the requirements of this Code, the Board shall have the power to abate or cause a suspension of the use of such swimming pool or family pool until such time as the same is, in the opinion of the Board, no longer a menace or a hazard to health, safety or morals.

Chlorination plants shall be operated in such manner that the amount of excess or residual chlorine in all parts of the pool at all times when the pool is in use shall not be less _____ parts per million, or more than _____ parts per million. The chlorinator and tanks shall be installed in a special closet, with vent to the exterior of the building and with a fan, unless considered unnecessary by the Board. A sufficient number of daily tests for available chlorine shall be made by the pool operator and a record of these tests to insure proper operation.

The water at swimming pools and family pools shall show an alkaline reaction at all times when the swimming pool is in use. Whenever alum or sulphate of alumina is used frequent tests shall be made to insure that the water has an alkaline reaction. At all times when the pool is in use the water shall be sufficiently clear to permit the entire bottom of the pool to be clearly visible from the walkways.

Such records of operation shall be kept as may be required by the Board and reports shall be submitted as required or requested.

No swimming pool or family pool shall be so located, designed, operated or maintained as to interfere unduly with the enjoyment of their property rights by owners of property adjoining the swimming pool or family pool or located in the neighborhood.

Lights used to illuminate any swimming pool or family pool shall be so arranged and shaded as to reflect light away from adjoining premises.
[Ord. 7-15-59 § 17]
It shall be unlawful for any person to make, continue or cause to be made or continued at any swimming pool or family pool any loud, unnecessary or unusual noise or any noise which annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others. In the operation of a swimming pool or a family pool the use or permitting the use or operation of any radio, receiving set, musical instrument, phonograph or other machine or device for the producing or reproducing of sound in such manner as to disturb the peace and quiet and comfort of the neighboring inhabitants or at any time with louder volume than is necessary for convenient hearing of the person or persons who are in the swimming pool or family pool premises shall be unlawful.

The carrying on of any commercial undertakings at a swimming pool or family pool entailing sales of food, drinks, novelties or other merchandise in a manner unreasonably disturbing neighboring property owners and inhabitants in the enjoyment of their property shall be prohibited. Swimming pool signs and placards shall be of such type so affixed as not to prejudice or unreasonably disturb the enjoyment of neighboring property owners of their property.

In the construction, operation and maintenance of any swimming pool or family pool, State laws and the rules, regulations and requirements of the State Department of Health shall be observed. In the event of any conflict between the provisions of this Code and any provision of State law or requirement, rule or regulation of the State Department of Public Health, the provision imposing the higher standard or the more stringent requirement shall be controlling.

Every person using an outdoor swimming pool or family pool, or an indoor swimming pool where the sexes are mixed, must wear a bathing suit or other suitable garment to protect his person from indecent exposure.
[Ord. 12-26-75 § 21]
The fee for a permit to construct a swimming pool shall be the sum of $50. The fee to construct any additions, improvements, alterations, or for the remodeling of an existing swimming pool shall be $25. The fee for a license to conduct, operate and maintain a swimming pools shall be $200 each payable annually. No fees shall be charged for a family pool.

[Ord. 7-15-59 § 22]
No body of water whether it be a natural or an artificial body of water in the Borough which contains sewage, waste or other contaminating or polluting ingredients rendering the water hazardous to health shall be used for swimming or bathing purposes by any person or persons.
