Whenever the public officer determines that any person or property
has allowed or maintained any nuisance under this Chapter, and such
nuisance constitutes the second violation of any nuisance under this
Chapter within a twelve (12) month period, then an abatement notice
of the second nuisance violation shall not be required.

It shall be unlawful for any person to maintain or permit any
nuisance under this Chapter within twelve (12) months following a
receipt of a prior Notice of Abatement for a nuisance which is abated
or results in a conviction.

Upon conviction, a repeat nuisance violation may be punished
by a fine of not more than two thousand five hundred dollars ($2,500.00),
imprisonment for not more than one (1) year, or both such fine and
imprisonment.
