Attachment 1 - Snow Mobile Routes and Rules

All provisions of the snowmobile regulation and safety act, 625 Illinois Compiled Statutes 40/1-1 et seq., as amended, are hereby adopted and incorporated into this chapter by reference and shall be applicable in the City the same as if each provision of the snowmobile registration and safety act were specifically set forth at length herein. Three copies of said act are on file in the office of the City Clerk for public use and inspection. Any person who violates any provision of the snowmobile registration and safety act within the City shall be subject to the penalties provided in Title 1, Chapter 1-4, of this Code.

All provisions of this Section 6-5-2 are hereby declared supplemental to, but not inconsistent with, the provisions of the Illinois state statutes set forth herein.

A. 
Registration And Number Required: Except as hereinafter provided, no person shall, after the effective date of this Section 6-5-2, operate any snowmobile within the municipal limits of the City unless such snowmobile has been registered and numbered in accordance with the provisions of this Section 6-5-2 and the identifying number is displayed in a location on the snowmobile as shall be directed by the Police Chief.
B. 
Application For Registration And Number; Fee; Issuance:
1. 
The owner of each snowmobile requiring registration and numbering by this Section 6-5-2 shall file an application for number with the City Clerk on forms provided by the Clerk.
2. 
The applications shall be signed by the owner of the snowmobile and shall be accompanied by a fee of $10, which shall be for a period of two years or any part thereof.
3. 
Before a registration number shall be issued and registration accepted, the owner must supply satisfactory proof of identification including a valid vehicle driver's license and proof of registration with the state, including the Illinois registration number.
4. 
Upon receipt of the application in approved form, the City Clerk shall enter the same upon the records of his office and issue to the applicant an identification number to be attached to the snowmobile in accordance with this Section 6-5-2.
C. 
Display Of Number: The owner shall attach the identification number to the snowmobile in a place and manner approved by the Police Chief.
D. 
Separate Numbers Required; Sale Or Transfer: An owner shall have a separate identification number for each snowmobile he owns. An identification number may be transferred from one snowmobile owned by one owner to a new snowmobile purchased by the same owner, but an identification number is not transferable between two snowmobiles at the same time by one owner. Upon sale or transfer of the snowmobile to a new owner, a new identification number must be applied for.
E. 
Lost Identification Number: Should an identification number become lost, destroyed or mutilated beyond legibility, the owner of the snowmobile shall make application to the City Clerk for replacement of the identification number, giving his name, address, and the number of the snowmobile and shall at the time pay the City Clerk a fee of $5.
F. 
Effect Of Numbers: Every identification number given under this Section 6-5-2 shall continue in full force and effect until terminated or discontinued in accordance with this Section 6-5-2 or any amending or repealing ordinance.
G. 
Records Kept:
1. 
All records of the City Clerk made or kept under this Section 6-5-2 shall be public records.
2. 
The City Clerk shall keep a registration list of all identification numbers issued and the name and address of the owner to which the said identification number was issued.

A. 
Permitted Locations; Snowmobile Routes: It shall be unlawful to operate a snowmobile within the City limits except upon property owned by the snowmobile operator or upon which the owner has given express permission to the operator of the snowmobile to be upon, or upon the portions of the highways designated in a map of the City entitled "Snowmobile Route", attached to ordinance 107 and made a part of this Section 6-5-2 by reference,[1] which delineates certain highways as permissible for mobile traffic within the City limits, or upon any highways which afford the most direct and safest course to the snowmobile route to or from the point where the snowmobile is housed, or to and from the point of entry or exit of the snowmobile to or from the City limits.
B. 
Prohibited Locations:
1. 
Snowmobiles may not at any time be operated on public school grounds, park property, playgrounds, or other recreational areas unless specifically permitted.
2. 
Snowmobiles may not be operated within the central business district.

A. 
Obedience To Traffic Regulations: Each person operating a snowmobile shall strictly observe all traffic signs and signals and all other traffic rules and regulations applicable thereto, and shall obey the orders and directions of any City police officer authorized to direct or regulate traffic.
B. 
Speed Limit: Unless other speed restrictions are established by the posting of speed limit signs under the authority of the City Council, the maximum speed limit for operation of any snowmobile within the limits of the City shall be 15 miles per hour.
C. 
Stay To The Right: Snowmobiles shall be operated on all designated roadways as close as possible to the right hand side of the roadway.
D. 
Following Too Closely: The operator shall not follow another vehicle more closely than is prudent with regard to the speed of the operators and the preceding vehicle and the traffic upon and condition of the roadway.
E. 
Signal To Turn Required: Signals of intention to turn right or left are required to be given during the last 100 feet of travel when the snowmobile is traveling on any highway within the City preparatory to turning.
F. 
Racing Prohibited: No person shall engage in any race on any street or alley within the corporate limits of the City where a snowmobile may be otherwise operated. "Race" means the act of two or more individuals competing either by acceleration or from passing or overtaking another individual in competing for time or position.
G. 
Unattended Snowmobiles: It is unlawful for the operator of any snowmobile operated within the limits of the City to leave or allow a snowmobile to be or remain unattended on public property while the motor is running or with the keys for starting the snowmobile left in the ignition.
H. 
Accidents: Any operator involved in any accident with another snowmobile or any motor vehicle or pedestrian shall make accident reports in accordance with the provisions of the Illinois state snowmobile registration act, 625 Illinois Compiled Statutes 40/1-1 et seq. (as amended).

A. 
Compliance With State Law: All snowmobiles operated within the municipal limits of the City shall be equipped as designated under the state statutes regarding operation and equipping of snowmobiles.
B. 
Lighted Headlamp: The headlamp required shall be lighted whenever the snowmobile is running.
C. 
Safety Throttle: A safety or so called "dead man" throttle in operating condition is required as a part of the operating equipment of the snowmobile of any snowmobile operator within the municipal limits of the City; "a safety or 'dead man' throttle" is defined as a device which, when pressure is removed from the accelerator or throttle, said removal causes the motor to be disengaged from the driving track.

Any person, firm, or corporation violating any provision of this chapter, including any provisions of the state law that are adopted herein by reference, shall be guilty of a misdemeanor and shall be subject to penalty as provided in Title 1, Chapter 1-4, of this Code.
