The position of Township Administrator is hereby created in the Township of Chatham pursuant to and in accordance with Chapter 200, Laws of 1971 (N.J.S. 40A:9-136 et seq.).

The Township Administrator shall be appointed by the Township Committee. If the Administrator does not reside within 20 miles of the Township municipal building at the time of appointment, he/she shall reside within such distance within three months as a condition of employment. If he/she fails to do so, the office shall be deemed vacant and shall be filled by a new appointment.

The term of office of the Township Administrator shall be at the pleasure of the Township Committee. The Administrator may be removed by resolution of the Township Committee, adopted by 2/3 vote. The Township Committee may provide that a resolution for removal shall have immediate effect, provided however that the Township Committee shall cause to be paid to the Administrator forthwith any unpaid balance of his salary and his salary for the next three calendar months following adoption of the resolution.

The Township Administrator shall be appointed on the basis of executive and administrative abilities and qualifications with special regard to education, training and experience in government affairs.

The Township Administrator shall be the Chief Administrative Officer of the Township and shall be responsible to the Township Committee for the proper and efficient administration of Township affairs. The office of Township Administrator may be combined with that of Township Clerk.

The Township Administrator shall have the following duties and responsibilities to the extent not prohibited by law:
a.
Be responsible for the receipt of the monthly and annual reports from all department heads and officers of the Township.
b.
Be responsible for the preparation of the annual Township capital and operating budgets and submit same to the Township Committee for their approval; and see that each department, office, board or other agency adheres to the budget approved by the Township Committee.
c.
Be responsible for Township purchasing procedures, administrative procedures and organizational structure, and make such recommendations for changes to the Township Committee he shall deem necessary from time to time.
d.
Maintain sound personnel practices in accordance with "A Guide to the Personnel Policies and Practices for the Township of Chatham, New Jersey" and maintain appropriate records of all employees.
e.
With the approval of the Township Committee, delegate to any department head or other Township employee such of his powers as he may deem necessary for efficient administration.
f.
Make studies and surveys of such municipal problems of the Township shall be assigned to him, from time to time, by the Township Committee and prepare and submit written reports of his findings and determinations to the Township Committee for their consideration and action.
g.
Attend all conference, public, regular and special meetings of the Township Committee.
h.
Implement and enforce the policy of the Township Committee with respect to the compiling and release of public information.
i.
Investigate complaints respecting local government operations and report thereon to the Township Committee.
j.
Maintain liaison with the Township Treasurer by continuous review of operating expenses and report periodically to the Township Committee on the status of all accounts.
k.
Perform such additional duties as may be assigned to him by the Township Committee.
l.
In conjunction with the Township's Chief Financial Officer and Purchasing Agent, the Township Administrator shall review and oversee the purchasing practices and policies of all departments for the purpose of ensuring that purchases are made in accordance with applicable law, the Township Code and sound purchasing practices.

The Township Administrator shall receive the compensation as fixed from time to time by ordinance by the Township Committee, provided however that whenever the Township Clerk is serving as Township Administrator, then there shall be no additional compensation for service as Township Administrator.

Nothing contained herein shall be construed to derogate from or authorize the Township Administrator to exercise powers exclusively vested or undertake duties exclusively imposed by law upon the various elected and appointed officers, boards, and commissions of the Township.

The position of Chief Financial Officer of the Township is hereby established.

The Chief Financial Officer shall possess the qualifications which are required by N.J.S. 40A:9-140.1 and following and shall carry out the responsibilities set forth in N.J.S. 52:27BB-26 and following. The Chief Financial Officer shall perform such other duties as may be assigned by the Township Committee.

The Township Tax Collector shall hold office for a term of four years from the first day of January next following the appointment. Vacancies other than due to expiration of term shall be filled by appointment of the Township Committee for the unexpired term.

The Township Tax Collector shall meet those qualification requirements and hold those certifications required by law.

The Township Tax Collector shall perform all duties imposed by law, administrative code or regulation and directive of the Township and shall file such reports as the Township Committee shall require, including but not limited to the following:
a.
Collect and deposit money assessed or raised by taxes.
b.
Collect all charges, payments and impose penalties for delinquent payment of taxes.
c.
Keep such records as are required by law.
d.
Enforce all municipal liens and other liens on real property as may be authorized by law and charge fees authorized by law.
e.
Conduct tax sale proceedings and in rem foreclosures.
f.
Certify searches for taxes and other liens on real property as may be authorized by law and charge fees authorized by law.
g.
Perform all other duties required by law.

The Township Tax Collector shall receive such salary or compensation as shall be fixed and determined by the Township Committee in accordance with law.

The Township Tax Assessor shall perform all duties and obligations imposed or granted to a Tax Assessor by law, including but not limited to the following:
a.
Having, performing and discharging all the functions, powers and duties prescribed by law for a Tax Assessor.
b.
Making assessments for benefits for local improvements and, for that purpose, having and exercising the powers and duties of an assessor for local improvements as provided by law.
c.
Maintaining adequate assessment records of each separate parcel of real property assessed or exempt.
d.
Maintaining a current tax duplicate of the municipality and causing to be recorded thereon all changes in ownership or character of the real property assessed.
e.
Reporting to the Township Committee as to equalization proceedings and other matters involving the County Tax Board and making recommendations.
f.
Reporting to the Township Committee on all New Jersey Tax Court or County Tax Board litigation in which the Township is a party.

The Township Zoning Officer shall be appointed by and hold office until removed by the Township Committee.

It shall be the duty of the Zoning Officer to enforce and administer the Land Development Regulations of the Township.

There is hereby created the part-time position of Qualified Purchasing Agent who shall serve no specific term and shall be appointed by the Township Committee of the Township of Chatham.

Compensation for the position of Qualified Purchasing Agent shall be set annually within the Chatham Township Salary Ordinance.

The Qualified Purchasing Agent is required to possess a valid Qualified Purchasing Agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs, and perform all duties imposed by law, administrative code, or regulation including but not limited to the following:
a.
An individual shall be considered a Qualified Purchasing Agent pursuant to N.J.S.A. 40A:11-9b to exercise the supplemental authority as set forth in N.J.S.A. 40A:11-3 and 40A:11-4.3 upon meeting the criteria relevant to the individual as set forth in N.J.S.A. 40A:11-9.
b.
To meet the criteria of required training courses set forth in N.J.S.A. 40A:11-9b(5), an applicant shall successfully complete the following courses provided by the Center for Government Services at Rutgers, the State University, by the Division of Local Government Services, or, with the approval of the director, an alternative state university or county college:
c.
There shall be no specific hours of work for the position of Qualified Purchasing Agent; however, said position shall require the coordination and certification of all purchases by the Township within the confines of the Local Public Contracts Law; and abide by the bid thresholds as contained therein.
d.
Prepare, as needed, reports; establish and maintain files.
e.
Maintain renewal of state issued certification.
f.
The Qualified Purchasing Agent shall have, on behalf of the Township Committee of the Township of Chatham, the authority, responsibility, and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.): to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services, and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms, and procedures promulgated by state regulatory agencies, and conduct any activities as may be necessary or appropriate to the purchasing function of the Township of Chatham.
g.
The Qualified Purchasing Agent may award a contract without bid if the aggregate amount does not exceed in a contract year the total sum of the bid threshold amount adjusted and set by the Governor pursuant to N.J.S.A. 40A:11-3(c) as referenced by Local Finance Notices.
h.
Perform all other duties as may be required by the Township Committee of the Township of Chatham or Chatham Township Administrator.

Pursuant to the provisions of the Local Historians Enabling Act, N.J.S. 40:10A-1 and following, the position of local historian of the Township of Chatham is hereby established.

The position of Local Historian shall be filled by appointment by the Township Committee. The Local Historian shall serve at the pleasure of the Township Committee.

The Local Historian shall serve without compensation and shall have the powers and responsibilities provided in Section 7 of the Local Historians Enabling Act, N.J.S. 40:10A-7.
