A Fire Department of the Township, under the control and supervision
of the Mayor and Council is hereby established.

The control and supervision of the Department by the Mayor and
Council herein vested shall be exercised by resolution of the Mayor
and Council adopted pursuant hereto.

The active members of the Fairfield Volunteer Fire Department,
Inc. and the officers thereof named or herein or hereafter elected
to and holding the offices of Chief, Assistant Chief, two Captains
and two Lieutenants respectively, shall be the members and officers
of like designation of the Fire Department of the municipality. New
members shall not be admitted except upon proof of minimum qualifications
as herein prescribed.

Every member of the Fire Department shall report annually during
the month of January to the Township Physician, if there be one, otherwise
to a designated local physician, at a place and time designated by
the physician and submit to a complete physical examination. If any
member is found to be suffering from any ailment, or be underweight
or overweight to the extent that he cannot fulfill his duties, then
the member shall be relieved of his duties as a member of the Fire
Department until he receives and presents a physician's certificate
that he is physically able to perform and resume such duty.

a. When vacancies in the membership of the Fire Department occurring
hereafter are to be filled, no person shall be eligible unless that
person is a citizen of the United States, of good moral character,
who is at least the age of 18 years, and unless the applicant shall
have passed a medical examination of fire duty.
b. An active member in good standing may be allowed to be a nonresident
of the Township and retain active membership so long as the member
is able to discharge the duties and abide by the rules of order and
bylaws of the Fire Department and regulations of the Governing Body.

The Fire Department shall be entrusted with the care and custody
of the fire apparatus and fire equipment now owned by the Township,
and with such as may be hereafter acquired, subject however, at all
times to the control of the Mayor and Council.

The Chief of the Fire Department shall prepare and file annually
with the Township Clerk a statement under oath setting forth the name,
residence, age, citizenship and character of each member of the Fire
Department, and the date of his/her admission to membership together
with the percentage of fire duty credited to each member of the Department
during the preceding year, and this statement shall constitute a record
of the Fire Department filed with the Township Clerk from which the
Mayor and Council shall determine when certificates of exemption shall
be issued to members of the Department.

The members of the Department may adopt by-laws and rules, Rules
of Order pertaining to the attendance and percentages of the Department.

In the absence of any of the officers named in Subsection
2-12.3, his/her powers and duties shall be exercised and discharged by the person holding the next lower office in the order in which the officers are listed in Subsection
2-12.3.

The members of the Department may adopt Bylaws and Rules of
Order pertaining to the election of officers, the discipline and management
of the Department and the duties of the officers and members thereof,
and the Bylaws and Rules of Order shall, insofar as they are not inconsistent
with the provisions of this section or any regulations of the Mayor
and Council adopted pursuant thereto, be effective and enforceable
as Rules of the Fire Department.
