The office of Business Administrator is hereby created in and for the Township pursuant to the provisions of N.J.S.A. 40A:9-136, et seq. The duties of the Business Administrator shall be those set forth in § 2-5.7, in addition to those other duties as shall be assigned by the Township Committee from time to time.

There is hereby created the position of Assistant Business Administrator. The duties of the Assistant Business Administrator shall be those set forth in § 2-5.7, in addition to those other duties as shall be assigned by the Business Administrator or Township Committee from time to time. The Business Administrator shall ensure that the Assistant Business Administrator has sufficient involvement and familiarity with the day-to-day operations of the Township such that he or she is ready and able to assume the duties of the Business Administrator in the absence of the Business Administrator.

a. 
The Business Administrator and the Assistant Business Administrator shall be appointed by a majority of the Township Committee and shall serve at the pleasure of the Township Committee.
b. 
Any vacancy in these offices shall be filled by appointment of the Township Committee.
c. 
Absence or Disability: During the absence or disability of the Business Administrator, the Assistant Business Administrator shall perform the duties of this office during such absence or disability. Such absence or disability shall be limited to three months, after which time such absence or disability may be deemed a vacancy.
d. 
The Business Administrator and the Assistant Business Administrator shall not be removed from office except in accordance with N.J.S.A. 40A:9-138, and N.J.S.A. 40A:63-7.1, which statutes are incorporated herein by reference.

The Business Administrator and the Assistant Business Administrator shall be appointed on the basis of their executive and administrative abilities and qualifications, with special regard to education, training and experience in governmental affairs, including the interworking of governmental agencies and boards.

The Business Administrator and Assistant Business Administrator shall be appointed to serve and each shall devote their full time to the duties of this office, except that nothing herein shall prevent the Business Administrator or Assistant Business Administrator from also holding another municipal office of the Township and fulfilling the duties thereof.

The Business Administrator and the Assistant Business Administrator shall receive such salaries as may be established by the Township Committee in the annual salary ordinance.

The Business Administrator shall be the Chief Administrative Officer of the Township. The Assistant Business Administrator shall be the Deputy Chief Administrative Officer of the Township. The Business Administrator and Assistant Business Administrator shall, at all times, be under the supervision of and responsible to the Township Committee for all actions relevant to the duties and responsibilities of these offices to the extent not prohibited by law.

The Business Administrator, and the Assistant Business Administrator under the supervision and direction of the Business Administrator, for the purpose of carrying out their responsibilities, shall develop, promulgate and implement, with the approval of the Township Committee, sound administrative, personnel and purchasing practices and procedures for all departments, offices and agencies of the Township, and shall to that end:
a. 
Study, recommend, implement and enforce personnel organization and policy of the Township and its departments, in accordance with Chapter 9 of the Township Code.
b. 
Study, recommend, implement and enforce administrative procedures and policies of the Township and its departments after consultation with department heads.
c. 
Study, recommend, implement and enforce purchasing procedures and policies of the Township and its departments after consultation with department heads.
d. 
Study, recommend, implement and enforce procedures and policies of the Township and departments for receipt, dissemination and collation of, and responses to, communications and information after consultation with department heads.
e. 
Assign responsibility for departmental action and coordinate intradepartmental operations as authorized by the Township Committee.
f. 
Study, recommend, implement and enforce the procedures and policies of the Township and its departments for the coordination, compiling, editing and prompt dissemination and release of public information, upon the recommendation and authorization of the Township Committee.
g. 
See that all terms and conditions imposed in favor of the Township or its inhabitants in any statute or contract are faithfully kept and performed and, upon knowledge of any violation, call the same to the attention of the Township Committee.
h. 
Study, recommend, implement and enforce the financial procedures and policies of the Township and its departments after consultation with department heads.
i. 
Conduct a continuous study of all activities and operations of the Township government and recommend changes for the purpose of increasing efficiency and effectiveness; prescribe such rules and regulations as they shall deem necessary with the approval of the Township Committee for the conduct of administrative procedures, and revoke, suspend or amend any such rules or regulations, subject to approval of the Township Committee in all background matters to assist it with the establishment of policy.
j. 
To require the various departments to effect an adequate inventory of all equipment, materials and supplies in stock, and to recommend sale of any surplus, obsolete or unused equipment when authorized by the Township Committee.
k. 
The Business Administrator and Assistant Business Administrator shall make studies and surveys of such municipal problems of the Township as shall be assigned to them by the Township Committee, and prepare and submit written reports of their findings and determinations to the Township Committee for consideration and action. The Business Administrator and Assistant Business Administrator shall be responsible to see that any complaints concerning the functions and obligations of the Township made by any of its residents, citizens or taxpayers are promptly attended to, a written record kept of such complaints when made, and when and what action was taken in response thereto.
l. 
The Business Administrator and Assistant Business Administrator shall perform such other duties as may be specifically assigned to them by the Township Committee.
m. 
The Business Administrator and Assistant Business Administrator shall attend all public meetings of the Township Committee and any other meetings when so requested by the Township Committee.
n. 
The Business Administrator and Assistant Business Administrator shall assist the Township Committee in the preparation of the annual Township operating and capital budgets to be considered and adopted by the Township Committee.
o. 
The Business Administrator and Assistant Business Administrator shall keep the Township Committee informed as to federal aid projects, state aid projects and any other aid programs for which the Township may qualify

Nothing in this section shall derogate from or authorize the Municipal Business Administrator to exercise the powers and duties of the elected and appointed officials or employees.

The office of the Township Clerk shall be an appointed position and, unless otherwise provided by law, the term of offices shall be three (3) years and shall commence on the date of appointment. The salary of the Township Clerk shall be as established in the Salary Ordinance.

The Township Clerk shall:
a. 
Perform all of the functions required of municipal clerks by the General Election Law (Title 19 of the Revised Statutes) and any other State Law or Township ordinance, and receive the fees prescribed therefor for the use of the Township.
b. 
Until such time as a separate Alcoholic Beverage Control Board may be established pursuant to law, issue such licenses as may be authorized by the Township Committee pursuant to the State Alcoholic Beverage Control Law (N.J.R.S. 33:1-1 et seq.) and ordinances of the Township.
c. 
Keep all records, resolutions, ordinances and minutes of the meetings of the Township Committee.
d. 
Issue all licenses required by law or ordinance, faithfully make all reports required by law or ordinance to the Township Committee and account monthly for all fees received by the Office of the Township Clerk.
e. 
See to it that all ordinances and notices of the Township of Neptune are properly advertised.
f. 
Take care of all correspondence of the Township and of the Township Committee.
g. 
Administer oaths.
h. 
Have such other, different and additional functions, powers and duties as may be prescribed by law, ordinance or regulation.

A Deputy Township Clerk shall be appointed. The Deputy Clerk shall have all the authority and powers of the Township Clerk in his or her absence and shall hold office at the pleasure of the Township Committee.

a. 
Appointment; Duties. There shall be appointed by the Township Committee a Chief Financial Officer who shall meet all qualifications as required by N.J.S.A. 40A:9-140.10, and shall hold office for a term of four (4) years. In addition the duties prescribed by Statute, the Chief Financial Officer shall perform such other duties as may be prescribed by ordinance or resolution of the Township Committee.
b. 
Salary. The annual salary of the Chief Financial Officer shall be established in the Salary Ordinance.

a. 
Established. This section shall be cited as the Purchasing Ordinance of the Township of Neptune.
b. 
Purpose and Scope. The purpose of the section is to prescribe the manner in which the Purchasing Agent shall implement procedures and supervise the purchase of all materials, supplies, equipment, work and contractual services of the Township of Neptune.
c. 
Department/Division/Office of Purchasing. There is hereby established by the Township Committee under the general supervision of the Township Committee and under the specific direction of the Chief Financial Officer, a Purchasing Division within the Finance Department, and the position of Purchasing Agent/ Deputy Treasurer as head of such division. There shall be an Assistant Purchasing Agent and such support staff as may be necessary.
d. 
Powers and Duties. The Purchasing Agent/Deputy Treasurer shall have general supervision of the Purchasing Division. The Purchasing Agent/Deputy Treasurer shall have the powers and duties prescribed by this subsection subject to the review and supervision of the Township Committee generally, and the Chief Financial Officer specifically.
The Purchasing Agent/Deputy Treasurer shall have the power, and it shall be his/her duty:
To develop municipal purchasing goals, objectives, policies, programs, procedures, rules and regulations for the acquisition of materials, supplies, equipment and services.
To develop and prepare a purchasing procedures manual to be promulgated by the governing body and distributed to all municipal departments, nonautonomous using agencies and boards containing procedures and instructions for initiating the purchasing style.
To stimulate both bid and quotation competition in order to obtain the highest quality goods and services at the least expense to the municipality.
To discourage uniform bidding and endeavor to obtain as full and open competition as possible on all purchases.
To explore the possibilities of buying "in bulk" so as to take advantage of discounts.
To prescribe and maintain such forms as necessary for the successful operation of the purchasing function.
To consolidate requisitions of like or common items to obtain the maximum economic benefit.
To monitor and evaluate vendor performance.
To maintain a centralized organization of qualified procurement personnel.
To acquaint and, when necessary, train appropriate municipal personnel in purchasing procedures.
To establish and supervise storerooms and warehouses and maintain current inventory records of all materials, supplies and equipment placed in storerooms and warehouses.
To arrange, after governing body approval, for the disposal of surplus materials and equipment either by transfer to other municipal agencies or by public sale.

a. 
Appointment; Duties. Pursuant to N.J.S.A. 40A:9-141 et seq., the Mayor and Township Committee shall appoint the Municipal Tax Collector who shall be charged with the duty of collecting taxes upon real property in the Township.
b. 
Term of Office; Vacancies. The Municipal Tax Collector shall hold office for a term of four (4) years from January 1 next following his appointment. Vacancies other than those due to expiration of term shall be filled by appointment for the unexpired term.
c. 
Certificate Required. No person shall be appointed or reappointed as Municipal Tax Collector unless he or she shall hold a Tax Collector certificate issued by the Director of the Division of Local Government Services.
d. 
Certification Requirements. A Tax Collector certificate shall be obtained upon qualification and successful completion of the examination given by the Director of the Division of Local Government Services. Qualifications for certification shall be in accordance with N.J.S.A. 40A:9-140.4 and N.J.S.A. 40A:9-145.4. Revocation or suspension of any certificates shall be in accordance with N.J.S.A. 40A:9-140.8, N.J.S.A. 40A:9-140.9 and N.J.S.A. 40A:9-145.5.

a. 
There is hereby established a Trust Fund to be known as "The Self-Insurance Fund for Group Health Benefits" (hereafter the Fund) pursuant to N.J.S.A. 40A:10-1 et seq. and regulations established by the New Jersey Department of Community Affairs.
b. 
The Township Chief Financial Officer shall remain and bear responsibility for the Fund in the same manner and to the same extent as other public funds under his/her care. All interest earned on the Fund shall accrue to the Fund's principal.
c. 
The Township Administrator shall annually estimate the probable maximum exposure of the Fund during the coming year. He/she shall make this estimate on such factors as contributory and non-contributory self-funded or partially self-funded health benefits to Township employees, their dependents, retirees or both in accordance with rules and regulations of the Director of the Division of Local Government Services in the Department of Community Affairs.
d. 
The Township Administrator shall include as part of the recommended annual operating budget for the coming year, an amount, in his/her opinion, over and above the current balance in the Fund needed to adequately and responsibly account for the costs associated with the above estimate as to Fund exposure for the coming year.
e. 
The Township Administrator shall fix reasonable rates of premium for all insurance carried by the Insurance Fund to be applied to the various covered persons and dependent categories, and shall effect all insurance in the Insurance Fund or with any insurance company or companies authorized to do business in the State of New Jersey.
f. 
The Township Committee of the Township of Neptune shall appropriate such funds as are necessary to accomplish the purposes for which the Neptune Township Self-Insurance Fund for Group Health Benefits is established.
g. 
The Township Chief Financial Officer shall collect and incorporate in the Fund employee and retiree contributions for health benefits which are made pursuant to applicable Township ordinances and contracts or in accordance with Chapter 78, P.L. 2011.

a. 
Office Established. There is hereby established the office of Tax Assessor of the Township. The Tax Assessor shall be nominated by the Mayor subject to the confirmation of the Township Committee pursuant to N.J.S.A. 40A:9-146.
b. 
Qualifications. The Tax Assessor shall be qualified as set forth in N.J.S.A. 54:1-35.25 as same may be amended.
c. 
Term of Office. The Tax Assessor shall hold office for a term of four (4) years from July 1 next following his appointment to the office.
d. 
Compensation. The compensation of the Tax Assessor shall be determined in the salary ordinance.
e. 
Duties. The Tax Assessor shall perform the duties required of the holder of such office pursuant to Title 54 of the New Jersey Statutes and such regulations as may be promulgated by the New Jersey Division of Taxation and the Monmouth County Board of Taxation.
The Construction Department shall be established in accordance with the requirements of the State Uniform Construction Code.

There is hereby created in and for the Township of Neptune Police Department, which shall consist of such employees and officers as shall be deemed necessary by the Township Committee and may include a Police Chief in accordance with N.J.S.A. 40A:14-118. The Township Committee shall, from time to time, determine the number of employees and officers of the Police Department together with their compensation. The structure of the Police Department will include at a maximum one Police Chief; one Deputy Police Chief; two Captains, (except that, in the event that the Deputy Chief position is vacant there shall be three Captains), eight Lieutenants, 13 Sergeants and up to 58 police officers. The Township Committee shall also appoint a Police Committee composed of up to six members, but at a minimum, two Township Committeepersons and the Township Administrator shall be members. The remaining three possible members shall be nonemployee residents of the Township of Neptune, appointed at the discretion of the Township Committee, subject to the language below. One of the Township Committeepersons shall be designated as the Chairperson of the Police Committee by the Police Committee members. The Township Administrator shall be a nonvoting, but participating, member. In the event of a tie amongst the Police Committee as to any action of members of the Police Committee, the matter shall be referred to the entire Township Committee for their review and consideration. The Township Committee will endeavor, within six months of the adoption of this section, to fill one or more of the remaining Police Committee membership, other than the two Committeepersons and the Township Administrator.

In accordance with the provisions of N.J.S.A. 40A:14-118 and all rules, regulations and Court decisions as to same, the Police Committee is hereby designated as the appropriate authority, subject to the ultimate and final approval of its actions/recommendations by the Township Committee.

a. 
Police Department. The Police Department shall preserve the public peace; protect life and property; detect, arrest and prosecute offenders of the laws of New Jersey and the ordinances of the Township of Neptune; direct and control traffic; provide attendance and protection during emergencies; provide appearances in court; cooperate with all other law enforcement agencies; provide training for the efficiency of its members and officers.
b. 
Police Committee:
1. 
To ensure increased public trust in the Neptune Township Police Department, the Police Committee shall seek greater transparency and oversight so as to meet the needs of both the Police Department and the citizens of the Township of Neptune, subject to limitations placed upon the Police Committee by statute and law. The Police Committee shall report to the Township Committee and shall be responsible to review the performance of the Police Department and report such to the Township Committee. It shall serve as the administrative and oversight body of the Police Department. It shall review and recommend to the Township Committee for its approval all proposed and promulgated rules and regulations for the government of the Police Department and for the discipline of its employees. The Police Committee's duties include, but are not limited to:
(a) 
Establishing the procedures to be followed by the Chief of Police and other subordinate officers for the purchase of equipment and supplies. Such procedures may include the requirement that the Police Committee review all expenditures with regard to the equipment and supplies and recommend actions as to same by the Township Committee.
(b) 
The Police Department and Chief Financial Officer shall keep a record of all business transacted by the Police Department and recommend approval of all bills for the expenses of the Police Department to the Township Committee after review and approval of the Police Committee.
(c) 
The Police Department shall keep and maintain accurate records and submit an annual report to the Township Committee, on or before January 31, which shall assess the operations of the Police Department, and its personnel, equipment and property.
(d) 
The Police Department shall keep and maintain all records, reports, documents and other data required to be kept and maintained by the federal and/or state government, with the Police Committee's right of review to the extent allowed by law, after a decision of the majority of the Police Committee at a meeting of same to conduct such review.
(e) 
The Police Department shall keep and maintain a record of all appointments, dismissals, removals, resignations and deaths of officers and other department employees as they take place, with such other information as may be necessary, with the Police Committee's right of review to the extent allowed by law, after a decision of the majority of the Police Committee at a meeting of same to conduct such review.
(f) 
The Police Department and Chief Financial officer shall develop the annual budget for the Police Department, in conjunction with the Police Committee. The budget approval shall be done by the Township Committee. Review of all expenditures prior to same occurring shall be reviewed by the Police Committee and Chief Financial Officer with final approval by the Township Committee.
(g) 
The Police Chief shall analyze crime trends and statistics to ensure that the Police Department makes the best use of available funds, personnel, equipment and supplies, with the Police Committee's right of review to the extent allowed by law after a decision of the majority of the Police Committee at a meeting of same to conduct such review.
(h) 
The Police Committee and the Police Chief shall jointly evaluate the effectiveness of work program and procedures of all organizational components within the Police Department and developing effective work methods for subordinates.
(i) 
The Police Committee, in conjunction with the Police Chief or designee, shall undertake special studies pertaining to police functions and promoting close coordination of planning efforts.
(j) 
The Police Committee, in conjunction with the Police Chief or designee, shall establish and maintain helpful and cooperative relations with civic and business organizations, schools, and court offices, and with other groups and public authorities and other jurisdictions, and with others interested in the maintenance of law and order.
(k) 
The Police Committee shall prepare written minutes of their meetings to the same extent as the Township Committee does at its meetings and said minutes shall be distributed to the Township Committee within 10 days of each Police Committee Meeting.
2. 
The Chief of Police or highest ranking sworn law enforcement officer in the absence of the Chief shall report directly to the Police Committee and the Police Committee shall receive weekly or other periodic reports, as designated by the Police Committee, from the Chief of Police or highest ranking sworn law enforcement officer in the absence of the Chief.
3. 
The Police Committee shall also be responsible for ensuring that all Police Officers and employees are compensated in accordance with state and federal wage and hour requirements.
4. 
(a) 
The Police Committee shall be appointed by the Township Committee. The members of the Police Committee shall serve on the Police Committee from the date of their appointment through and including December 31 of appointed calendar year, except as set forth herein. At all times one of the two Township Committeepersons appointed shall be the Mayor or the Mayor's designee. The Township Administrator shall serve for the time he/she serves as Township Administrator and only the Township Administrator can replace the Township Administrator on the Police Committee.
(b) 
Any member of the Police Committee, other than the Township Administrator, the Mayor or the Mayor's Designee, can be removed by the Township Committee, if the member fails to attend three consecutive meetings of the Police Committee without being excused by a majority of the members of the Police Committee and when the absence is not due to a legitimate documented illness.
(c) 
Any member of the Police Committee, other than the Township Administrator, the Mayor or the Mayor's designee, may be removed by the Township Committee for cause, after a public hearing if the member being removed requests such, or after a private hearing if no such public hearing is requested. A vote of three Township Committee members to remove is required. The Township Administrator or Mayor may only be replaced by a new Administrator or newly-appointed Mayor pursuant to ordinance and/or state statute.
(d) 
The Mayor's designee serves at the pleasure of the Mayor and may be removed or replaced by the Mayor at any time.
5. 
In addition to the two members of the Township Committee appointed to the Police Committee, the Township Administrator and the other members of the Police Committee, the Township Committee may also authorize on its own, or after the Police Committee requests same, any professional needed to accomplish its duties, including the Township Labor Counsel, the Township Attorney, the Township Chief Financial Officer or any other consultant or professional necessary to assist the Police Committee in its functions.
c. 
Chief of Police:
1. 
If a Police Chief is appointed, he/she shall exercise any and all of the rights, authorities, powers and responsibilities reserved solely to the Chief of Police pursuant to N.J.S.A. 40A:14-118.
2. 
If a Police Chief is not appointed, any and all of the rights, authorities, powers and responsibilities reserved solely to the Chief of Police, pursuant to N.J.S.A. 40A:14-118 shall be delegated to a Chief Law Enforcement Officer, which shall be the highest ranking sworn law enforcement officer in the Police Department.

a. 
No person shall be appointed as a member of the Neptune Township Police Department unless he/she:
1. 
Is a citizen of the United States;
2. 
Is not less than 21 years of age or older than 35 years of age, except under certain circumstances provided by law;
3. 
Shall have graduated from high school or possess a General Equivalency Degree (GED);
4. 
Shall possess an associate's degree or 60 college/university credits from an accredited college/university or be honorably discharged from active duty services in any branch of the U.S. military;
5. 
Is sound in body and of good health sufficient to satisfy the Board of Trustees of the Police and Firemen's Retirement System (PFRS) as to his/her eligibility for membership in the retirement system;
6. 
Is able to at least read, write and speak the English language well and intelligently;
7. 
Is of good moral character and has not been convicted of any criminal offense involving moral turpitude;
8. 
Shall have successfully passed the police officer's entry level written, and if part of same, physical examination administered by the New Jersey State Association of Chiefs of Police and currently on a valid active list. This requirement may be issued by the Township if the candidate successfully completed a New Jersey Police Training Commission (PTC) approved basic training course for police officers or has successfully completed a PTC approved training course for Special Law Enforcement Officer Class II (SLEO II) at the Monmouth County Police Academy and is eligible for a waiver of training under PTC guidelines.
9. 
Successfully passes a physical examination and a psychological examination as part of a conditional offer of employment.
b. 
No police officer shall be entitled to a permanent employment as a police officer in the Neptune Township Police Department unless said police officer has successfully completed a period of one year after successful completion of either:
1. 
Employment with the Neptune Township Police Department, if already having successfully completed a police training course (not a special law enforcement course); or
2. 
A police training course at a school approved and authorized by the Police Training Commission (PTC) and Department of Law and Public Safety of the State of New Jersey. As to paragraph b(2) herein, if the police training course is not taken by the police officer at the start of his/her retention by the Department, the probationary period shall be extended so that one year of probation shall follow the successful completion of the training course.
Once the one-year probationary period is completed, the Township Committee shall determine whether or not to make the probationary officer permanent. Up to and through the expiration of said probationary period, the Township Committee may terminate the police officer's employment with the Township Police Department at any time without cause by a resolution of the Township Committee.

a. 
Whenever an emergency exists, as provided by Statute or as declared by the Mayor, the Chief of Police is hereby authorized to summon and keep on duty any member of the Police Department for such a period of time in excess of ordinary duty hours which, in the sole discretion of the Chief of Police, is necessary to adequately perform the duties of the Police Department and to preserve public safety and welfare in the Township.
b. 
Members of the Police Department shall be compensated for time on duty in excess of their regular hours of duty at the same rate per hour as they are paid for regular duty. This additional compensation shall be in lieu of any compensatory time off and in addition to the regular salary paid to members of the Police Department.

a. 
The position of Special Police Officer in the Neptune Township Police Department is hereby established.
b. 
The Mayor, subject to the approval by resolution of the Township Committee, shall appoint Special Police Officers for a term not exceeding one year and shall not revoke such appointments without cause or hearing, unless the appointment is for four months or less. Such Special Police Officers shall carry out their duties and responsibilities under the direct supervision of the Chief of Police and their powers, rights and duties shall be specifically defined by the Chief of Police, pursuant to the statutory duties of a Special Law Enforcement Officer and within the scope of their training as determined by the Police Training Commission. These powers, rights and duties, however, shall immediately cease at the expiration of the term for which they were appointed, or upon revocation of their appointment. The resolution approving appointment of Special Police Officers shall designate the rate of pay if any.
c. 
No person shall be appointed as a Special Police Officer unless he or she is a citizen of the United States and of the State of New Jersey; is able to read, write, and speak the English language well and intelligently and has a high school diploma or equivalent; is physically qualified and of good moral character, shall not have been convicted of any crime/offense; and, has successfully undergone the same psychological testing that is required of all full-time police officers in the Township. Every such Special Police Officer shall be fingerprinted and his fingerprints shall be filed with the Division of the State Police and Federal Bureau of Investigation. Reports shall be made by the Chief of Police to the Township Committee in writing concerning the eligibility and qualifications of any person proposed to be appointed a Special Police Officer.
d. 
Class One Officers (Class I). Class I Officers shall be authorized to perform routine traffic detail, spectator control and similar duties. Class I Officers shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the Revised Statutes. The use of a firearm by an Officer of this class shall be strictly prohibited and no Class I Officer shall be assigned any duties which may require the carrying or use of a firearm.
e. 
Class Two Officers (Class II). Class II Officers shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time police officer. The use of a firearm by an officer of this class may be authorized only after the officer has been fully certified as successfully completing training as prescribed by the commission. Class II Officers are not authorized to carry an off duty weapon.
f. 
Class Three Officers (Class III).
1. 
Class III Officers shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time police officer while providing security at a public or non-public school or a county college on the school or college premises during hours when the public or non-public school or county college is normally in session or when it is occupied by public or non-public school or county college students or their teachers or professors. While on duty in the jurisdiction of employment, an officer may respond to offenses or emergencies off school or college grounds if they occur in the officer's presence while traveling to a school facility or county college, but an officer shall not otherwise be dispatched or dedicated to any assignment off school or college property.
2. 
In order to be appointed as a Class III Officer, the person must be: a retired law enforcement officer in good standing who is less than 65 years of age whose retirement does not include a retirement resulting from injury or incapacity or the officer's return to work does not violate Federal or State law or regulation as to a return to work; has served as a duly qualified, fully trained, full time officer in any law enforcement position eligible for participation in PFRS or in any Federal or bi-state law enforcement agency or as a member of the State Police and was separated from that prior service in good standing; is physically capable of performing the functions of the position, determined in accordance with PTC guidelines; possess a NJ PTC Basic Police Officer certification or a NJ State Police Academy Certification or other proof of basic police training approved by the PTC; has completed the training course for safe school resource officers developed pursuant to N.J.S.A. 52:17B-71.8a; and, is hired in a part-time capacity.
3. 
The use of a firearm by a Class III Officer shall be authorized pursuant to the provisions of N.J.S.A. 40A:14-146.14b. A Class III Officer shall not be authorized to carry a firearm while off duty unless the officer complies with the requirements of subsection I of N.J.S.A. 2C:39-6 authorizing a retired law enforcement officer to carry a handgun.

a. 
Pursuant to N.J.S.A. 40A:9-154.1, the Township Committee shall have the power, by resolution, to employ Police Officers or any other authorized personnel to act as School Crossing Guards.
b. 
Such Adult School Crossing Guards shall receive compensation as established by resolution of the Township Committee.

The Police Committee, as the "Appropriate Authority" shall, from time to time as may be necessary, adopt and amend the rules and regulations for the government and discipline of the Police Department and employees thereof subject to approval of the Township Committee. Said rules and regulations may fix and provide for the enforcement of such rules and regulations and the enforcement of penalties for the violation of such rules and regulations. All employees of the Police Department shall be subject to such rules and regulations and penalties.

Discipline of employees and police officers will be imposed consistent with New Jersey State statutes and the Rules and Regulations of the Neptune Township Police Department. Employees may be subject to discipline for violating laws, statutes, ordinances, rules and regulations and written directives. Disciplinary hearings shall be conducted by the Township Administrator or designee.

The Township intends to provide all eligible candidates for promotion with fair notice and equal access to the promotional process. Additionally, it strives to identify the most qualified members of the Police Department for promotion to leadership positions within the department and sets forth the components of the promotional process that will be utilized by the Police Department, The Neptune Township Police Committee and Neptune Township Committee in carrying out the process. In situations where the Chief of Police position is vacant, the Deputy Chief shall assume all roles herein that are assigned to the Chief of Police. All promotions require the final authorization, approval, and concurrence of the Police Committee as the appropriate authority and the Governing Body of the Township of Neptune by way of resolution with is approved at a public meeting.
a. 
Procedure.
1. 
Eligibility and Process. General considerations: Existence of an associate degree and honorable discharge from the United States Military Service, or a bachelor's degree, will be considerations for points credits in evaluating eligibility, but not be a minimal requirement or dispositive of eligibility of the candidate with other credits, including experience and prior service in the Neptune Township Police Department and/or other law enforcement agencies.
(a) 
Deputy Chief.
(1) 
It is recognized that the position of Deputy Chief is an appointment made based on the review and recommendation of the Police Committee and the Chief of Police, and approval by resolution of the Governing Body of the Township of Neptune, after consultation by the Police Committee with the Chief of Police.
(2) 
At a minimum, applicants for the position of Deputy Chief, shall i) have at least 14 years of experience in law enforcement; or ii) possess an associate degree from an accredited college/university and be honorably discharged from the active military service in a branch of the United States Military; or iii) be in possession of a bachelor's degree.
(3) 
The process for promotion to the position of Deputy Chief will consist of an oral interview conducted by the Chief of Police and the Neptune Township Police Committee. The Chief and the Police Committee members conducting the interview will have access to the candidate's resume; the candidate's experience report; personnel file as permitted under the New Jersey Attorney Guidelines, consisting of past evaluations, career experience, accommodations, disciplinary notices and sustained abuse of sick time (if any). While a candidate's disciplinary history is considered under the record review section of this policy, Internal Affairs files are not considered part of the personnel file and shall not be subject to review as part of the promotion process. The candidate's experience, seniority, accomplishments, time and service with regard to the Neptune Township Police department or other law enforcement agencies, education and honorable military service will also be taken into consideration. Applicants will submit a letter of intent, resume and complete a candidate experience report prior to the deadline established by the Police Committee.
(i) 
Each candidate shall prepare and provide a typed personal profile of himself/herself. This profile shall include, at a minimum, the candidate's career objective, educational achievements (including but not limited to academic, law enforcement-related, management, instructor certification and military experience), past and current responsibilities with the Police Department, commendations/letters, any and all disciplinary actions taken against the candidate (including the results of each action), any volunteer work performed and record of sick days used in the past five years. The candidate may include any additional information at his or her choosing. Each candidate is responsible for obtaining and ensuring the accuracy of all required information included in this profile. A candidate may be rejected for a deficiency in their personal profile. This report is to be completed by the candidate and is to be submitted to the Police Committee, after it has been reviewed and its accuracy is confirmed by the Police Chief, with their resume and letter of intent. This report is an opportunity for the candidate to identify those specific career experiences that the candidate believes qualifies him/her to serve as Deputy Chief. Copies of all submissions will be provided to the Chief of Police and placed in the department's promotion file.
(4) 
Applicants for the position of Deputy Chief must have held the rank of Captain for a minimum of two years, or have experience comparable to the same, and shall have a minimum of five years of experience in a police supervisory capacity, supplemented by the completion of approved course work in police administration, police science, or related fields.
(5) 
In accordance with N.J.S.A. 40A:14-129, due consideration shall be given to the length, merit of service, and seniority in service to any candidate for promotion to Deputy Chief. Due consideration shall also be given to the recommendation of the Police Committee and consideration of the recommendation of the Chief of Police, which shall be based on the aforementioned factors and a review of the performance of the candidates.
(6) 
The Chief of Police shall provide the Police Committee with his or her analysis of the strengths and weakness of each candidate and shall rank them in accordance with his or her recommendation for promotion and the Police Committee shall forward the Chief of Police's recommendations to the Township Committee.
(7) 
This process shall take place in a private closed-door session.
(b) 
Captain.
(1) 
Applicants for the position of Captain must have held the rank of Lieutenant for at least two years prior to the notice of posting for the position of Captain, supplemented by the completion of approved course work in police administration, police science, or related fields. For employees hired after March 15, 2021, applicants for the position of Captain shall possess at a minimum a bachelor's degree from an accredited college or university or possess an associate degree and be honorably discharged from active duty military service in any branch of the U.S. Military. Applicants will submit a letter of intent, resume and complete a candidate experience report prior to the deadline established by the Township and affected majority representative(s).
(i) 
Candidate Experience Report - Self Assessment.
[a] 
Each candidate shall prepare and provide a typed personal profile of himself/herself. This profile shall include, at a minimum, the candidate's career objective, educational achievements (including but not limited to academic, law enforcement-related, management, instructor certification and military experience), past and current responsibilities with the Police Department, commendations/letters, any and all disciplinary actions taken against the candidate (including the results of each action), any volunteer work performed and record of sick days used in the past five years. The candidate may include any additional information at his or her choosing. Each candidate is responsible for obtaining and ensuring the accuracy of all required information included in this profile. A candidate may be rejected for a deficiency in their personal profile. This report is to be completed by the candidate and is to be submitted with their resume and letter of intent. This report is an opportunity for the candidate to identify those specific career experiences that the candidate believes qualifies him/her to serve as Captain.
(2) 
The examination for the position of Captain will consist of an oral interview conducted by a review board consisting of the Chief of Police, Deputy Chief of Police and Captain(s). The review board will have access to the candidate's resume, candidate experience report and personnel file, consisting of past evaluations, career experience, and commendations and disciplinary notices and sustained abuse of sick time. While a candidate's disciplinary history is considered under the record review section of this policy, Internal Affairs files are not considered part of the personnel file and shall not be subject to review as part of the promotion process. All candidates will be evaluated on their answers to questions formulated by the review board taking the candidate's experience, seniority, accomplishments, education and honorable military service into account.
(3) 
In accordance with N.J.S.A. 40A:14-129, due consideration shall be given to the length and merit of service and to seniority in service to any candidate for promotion to Captain. Due consideration shall also be given to the recommendation of the Chief of Police, which shall be based on the aforementioned factors and a review of the performance of the candidates.
(4) 
This process shall take place in a private closed-door session.
(5) 
All candidates and supervisory personnel participating in the oral interviews will be required to sign a nondisclosure agreement. (Appendix #1 and Appendix #2[2]).

A copy of this report will be distributed to each commander participating in the Commander Recommendation phase. By providing the commanders with each candidate's experience report, this will assist in making sure that each participating commander has a well-rounded understanding of the experiences and qualifications that each candidate offers.
[c] 
Commanders shall be the rank of Captain and above.
(2) 
The examination process for the position of Lieutenant will consist of three phases, which will be scored with the following percentages:

These superior officers will be selected by the Chief of Police. They will utilize a uniform set of questions and grade the candidates on a standardized form. The criteria candidates will be tested on include, but are not limited to, the following:

Constitutional, state, and municipal law;
[2] 
Department policy, procedure and SOPs;
[3] 
Attorney General guidelines;
[4] 
Monmouth County policies;
[5] 
Rank-specific questions;
[6] 
Community-based questions.
(ii) 
Phase 2: Commander Recommendation/Record Review.
[a] 
Commander Recommendation. Existing agency command staff members of the rank of Captain and above. These members of the command staff will make their appropriate recommendations for Lieutenant promotions as follows:

The Chief of Police and Deputy Chief of Police will facilitate this step.
[c] 
Each participating command staff member will be provided with the candidates resume, candidate experience report and personnel file, consisting of past evaluations, career experience, commendations, disciplinary notices and sustained abuse of sick time included for command staff review for this phase of examination. While a candidate's disciplinary history is considered under the record review section of this policy, Internal Affairs files are not considered part of the personnel file and shall not be subject to review as part of the promotion process.
[d] 
This process shall take place in a private closed-door session.
[e] 
This step is designed to allow existing command staff members to submit their individual recommendation into the promotional process.
[f] 
The Chief of Police and Deputy Chief of Police will begin a roundtable discussion about each candidate to include a review of the subject's personal profile. After a roundtable discussion has taken place for each candidate, the Deputy Chief of Police and other participating members of the command staff will complete an evaluation with a numerical grade for each candidate taking the candidate's experience, seniority, accomplishments, education and honorable military service into account.
[g] 
Each commander shall provide a grade for each candidate utilizing a standardized form.
[h] 
Upon completing each evaluation/grading, the commander shall immediately seal their written evaluation which will be submitted to the Chief of Police for scoring.
[i] 
Confidentiality and Scoring. All commanders participating in the commander recommendation phase are to complete their evaluations and grading independently. Although roundtable discussions are appropriate at the start, commanders are forbidden from discussing their scores with other commanders during this session and/or until the completion of the entire promotional process.
[j] 
Upon completing each evaluation/grading, the Chief of Police shall immediately tally all of the scores submitted from the staff.
[a] 
Scoring Formula.
[1]
Candidates will be graded on a scale of 60 to 100 by increments of five. The scores are as follows: 60, 65, 70, 75, 80, 85, 90, 95 and 100.
(iii) 
Phase 3: Chief of Police Recommendation. The Chief of Police shall evaluate the candidate's qualifications including a review of any and all files pertaining to the candidate.
(3) 
In accordance with N.J.S.A. 40A:14-129, due consideration shall be given to the length and merit of service and to seniority in service to any candidate for promotion to Lieutenant. Due consideration shall also be given to the recommendation of the Chief of Police, which shall be based on the aforementioned factors and a review of the performance of the candidates.
(4) 
All candidates and supervisory personnel participating in the oral interviews will be required to sign a nondisclosure agreement. (Appendix #1 and Appendix #2[3]).

Sergeant.

Applicants for the position of Sergeant who have an associate degree, honorable discharge from the United States Military Service and/or a bachelor's degree or above shall be awarded point credits in evaluating eligibility for promotion. Applicants will submit a letter of intent, resume and complete a candidate experience report prior to the deadline established by the Township and affected majority representative(s).
(i)

By providing the commanders with each candidate's experience report, this will assist in making sure that each participating supervisor has a well-rounded understanding of the experiences and qualifications that each candidate offers.
(2) 
The examination process for the position of Sergeant will consist of three phases, which will be scored with the following percentages:

(3) 
Phase 1: Written Examination.
(i) 
The written examination will consist of a series of multiple-choice type questions. The questions will be based on basic police practice and may include police and investigative procedure, supervisory and administrative principles, report writing and general legal aspects of police work.
(ii) 
The Township shall utilize a valid and reliable testing company to supply, administer and score the written exam.
(iii) 
Any and all costs associated with the written examination except for the written examination itself shall be the responsibility of the candidate.
(iv) 
The Chief of Police shall receive authorization to conduct a written test. Candidates will be provided with a syllabus of possible testing resources in order to prepare for the written examination.
(v) 
Eligible candidates will be allowed a minimum of 60 days for preparation period, prior to the first phase of the process.
(vi) 
Eligible candidates will be notified by the Chief of Police or Deputy Chief of Police as to the date and location of the written test.
(vii) 
Eligible candidates who are scheduled to work during the written examination will be granted time off at their own expense to take the examination.
(viii) 
Any candidate who does not achieve a minimum score of 70% is excluded from consideration for promotion.
(ix) 
In the event there are fewer than five candidates with a minimum written examination score of 70%, then the five highest-scoring candidates shall proceed to the next phase and continue with the process regardless of their scores. If more than one candidate achieves an identical fifth highest score, then each shall be permitted to continue in the process.

If two Sergeants or Lieutenants have the same time in rank the Sergeant or Lieutenant with the most service in Neptune Township shall be deemed most senior), which will be selected by the Chief of Police and Deputy Chief of Police. They will utilize a uniform set of questions which will be reviewed and approved by the Chief of Police. They will then grade the candidates on a standardized form. The criteria candidates will be tested on include, but are not limited to, the following:

The Chief of Police and Deputy Chief of Police will facilitate this step and will be active participants in the grading of candidates.
[b] 
Each participating command staff member will be provided with the candidate's resume, candidate experience report and personnel file, consisting of past evaluations, career experience, commendations, disciplinary notices and sustained abuse of sick time included for command staff review for this phase of examination. While a candidate's disciplinary history is considered under the record review section of this policy, Internal Affairs files are not considered part of the personnel file and shall not be subject to review as part of the promotion process.
[c] 
This process shall take place in a private closed-door session.
[d] 
This step is designed to allow existing staff members to submit their individual recommendation into the promotional process.
[e] 
The Chief of Police, Deputy Chief of Police will begin a roundtable discussion about each candidate to include a review of the subject's personal profile. After a roundtable discussion has taken place for each candidate, the Chief of Police and Deputy Chief of Police and other participating members of the staff will complete an evaluation with numerical grade for each candidate taking the candidate's experience, seniority, accomplishments, education and honorable military service into account.
[f] 
Each commander shall provide a grade for each candidate utilizing a standardized form.
[g] 
Upon completing each grading, the staff member shall immediately seal their written evaluation which will be submitted to the Chief of Police for scoring.
[h] 
Confidentiality and Scoring: All staff members participating in the supervisory and command recommendation phase are to complete their evaluations and grades independently. Although roundtable discussions are appropriate at the start, staff members are forbidden from discussing their scores with other staff members during this session and/or until the completion of the entire promotional process.
[i] 
Upon completing each evaluation/grading, the Chief of Police will tally all of the scores submitted from the staff.
[a] 
Scoring Formula.

Candidates will be graded on a scale of 60 to 100 by increments of five. The scores are as follows: 60, 65, 70, 75, 80, 85, 90, 95 and 100.
b. 
Record Review.
1. 
For every rank set forth in this policy, a record review will be conducted by the Police Chief and Deputy Chief of Police. A maximum of 25 points will be awarded based on the following criteria:
(a) 
Commendations: candidates shall receive one point for each commendation up to maximum of five points. Commendations shall include, but not be limited to, all of the following: official commendations issued by the Chief of Police for actions taken in the performance of their duties, formal letters of commendation from any law enforcement agency or governmental entity; awards received for actions taken as a law enforcement officer; academic awards; letters from the public acknowledging the appreciation of actions taken as a law enforcement officer; any and all documentation, whether written or some other form of communication, acknowledging good work as a law enforcement officer. This definition is not meant to be limiting in any way and should be construed to include positive references to an officer's career in whatever form they may be. The Chief of Police and Deputy Chief of Police will validate all commendations to determine if they qualify for points.
(b) 
Disciplinary Actions: The cumulative sustained disciplinary occurrences for any discipline issued will be used for this section. Candidate only receives the point(s) associated with the most severe penalty and not the point(s) for each separate penalty. Discipline outside of the applicable time period as set forth below will not be considered and will not count against the officer.
(1) 
Candidates for promotion: Oral reprimands shall only count as disciplinary occurrences for one year following the oral reprimand. Written reprimands shall only count as disciplinary occurrences for three years following the written reprimand. A suspension of two days or less shall only count as a disciplinary occurrence for three years following the suspension. A suspension of three to 10 days shall only count as a disciplinary occurrence for five years following the suspension. Any suspension of 10 days or more will be counted regardless of when the suspension was incurred.
(2)

d. 
Preference to Residents.
1. 
If a situation arises where a resident of Neptune and a nonresident achieve the same final average after all scoring is complete, a resident shall be appointed over the nonresident. The preference granted by this section shall in no way diminish, reduce, or affect the preferences granted to veterans pursuant to any other provision of law.
e. 
Security of Promotional Materials.
1. 
The Chief of Police shall be responsible for the security of promotional materials. All promotional materials will remain in a secured promotional file.
f. 
Posting of Results.
1. 
At the end of the scoring process, all candidates shall be provided with their score for each phase of the testing process and their total score.
2. 
The PBA President shall be provided with the scores of all written examinations taken for the rank of Sergeant. The scores provided to the PBA President shall not contain names, badge numbers or any other identifier.
3. 
The FOP President shall be provided with the scores of all candidates for promotion. The scores provided to the FOP President shall not contain names, badge numbers or any other identifier.
4. 
Promotions shall not take effect until 10 days after the posting of results and, if an appeal is filed as set forth below, may be delayed until the appeal has been resolved.
g. 
Appeals of Process.
1. 
Within 10 days of the posting of the promotions for any rank, a candidate may file a written letter of appeal. Said letter must contain the reason(s) or justification(s) for an appeal and must be submitted to the Police Committee and the Chief of Police through the appropriate chain of command. The Police Committee will assess the request and, with advice from and due deference to the Chief of Police, make a determination of how the request will be addressed on a case-by-case basis. Such requests may address the following areas of the promotional process:
(a) 
Review and re-tabulation of the scored elements of the selection process.
(b) 
Review any evaluation or internal document that was used in the selection process related to the appellant. Any restrictions on access to internal documents pursuant to the Attorney General Guidelines shall be respected and review of those documents shall be conducted by authorized personnel only who shall report to and advise the Police Committee in making their evaluation.
(c) 
If the appeal impacts upon the results of the promotion(s) as determined by the Police Committee, the candidate may be permitted to be re-evaluated.
2. 
Any candidate for promotion, who believes they may have a conflict with a supervisor conducting a review of the candidate in the promotional process, may make a request, in writing, to the Chief of Police and the Police Committee, detailing their perceived conflict. The Police Committee, with advice from and due deference to the Chief of Police shall evaluate the request and render a decision if the evaluator is to be replaced or not.
3. 
Within seven days of receipt of an appeal, the Chief of Police will advise the candidate of the steps that are being taken to address the appeal and when the appeal is expected to be concluded.
h. 
Eligibility Lists.
1. 
An eligibility list for promotion to Sergeant will remain in effect for a period of 24 months, and for all other promotions for a period of 12 months from the date of the posting of final scores by the Chief of Police, which may be extended by the Township.
2. 
All promotions shall be contingent upon successful completion of a thorough psychological examination, which consists of a battery of written tests along with a comprehensive psychological interview. The psychological tests measure cognitive ability, personality, psychopathology, supervisory capacity, and competent performance. Candidates also complete a writing sample dealing with issues pertinent to the rank being sought. Candidates also complete a biographical summary, which collects an array of background and social history data.
3. 
After the expiration of the eligibility list, candidates will be required to reapply for any subsequent promotional process. Candidates that have taken the written examination within the last three years may choose to use the prior score or may retake the exam. If the candidate retakes the exam, the higher of the scores will be used in evaluating the candidate for promotion. Examinations taken prior to the date this policy becomes effective may be used for current and future promotions provided that they were taken within three years of the promotional process.
4. 
The Chief of Police shall rank all eligible candidates for promotion in descending order based upon his/her evaluation/score.

a. 
Participation by the Township of Neptune in a County-wide compact which shall be known as "The Monmouth County Mutual Aid Agreement" is hereby authorized.
b. 
This subsection is created pursuant to N.J.S.A. 40:48-1(6) and N.J.S.A. 40A:14-156.1 and is adopted as a reciprocal agreement with all municipalities participating in the County-wide mutual aid compact. Pursuant to this agreement, the Township of Neptune shall render assistance to any participating municipality by providing members of the Neptune Township Police Department, upon request, to help preserve the public peace and order.
c. 
The municipality requesting assistance shall compensate the officers at an agreed-upon rate by forwarding payment to the municipality, which will then compensate those officers who rendered assistance.
d. 
In the event that an officer is injured while rendering assistance, the municipality providing assistance shall be primarily responsible for any costs as a result of the injury. Nothing in the Agreement shall serve as a bar to the municipality providing assistance from seeking indemnification from the municipality receiving assistance.
e. 
This subsection is separate and distinct from any mutual aid agreements previously entered into between the Township of Neptune and any other municipalities and shall remain in full force and effect until specifically repealed by an affirmative act of the governing body.

The Department of Public Works is hereby established.

a. 
Authority of Director.
1. 
The Director of Public Works shall have the authority to manage and allocate the supervisor and other personnel of the Public Works department.
2. 
The exercise of such authority shall, at all times, be subject to the review of the Administrator in his or her capacity as Chief Personnel Officer of the Township, and may be subject further to his or her modification.
3. 
The Director is instructed, empowered and authorized to implement, alter, modify or rescind operating procedures, record-keeping procedures and equipment maintenance schedules; stream, drainage, storm and sanitary sewer, road, drive-way and sidewalk maintenance schedules; and such other procedures designed to achieve efficiency, reduce costs or preserve the useful life of Township rolling stock or property, subject to review by the Administrator, in his/her capacity as Chief Administrative Officer, and subject further to the Administrator's notifying the Committee with respect to any of the foregoing and receiving its consent with respect thereto.
4. 
The Director of Public Works shall have the authority to control the use, operation and allocation of all equipment of the Department and the divisions thereof.
5. 
The Director of Public Works shall have such additional authority necessary to fulfill the responsibilities delegated to him under this section, which responsibilities are not specifically delegated to any other official by State Statute or local ordinance.
b. 
Responsibilities of the Director.
1. 
The Director of Public Works shall report to the Township Administrator concerning matters of operation, personnel, planning, citizen inquiries, complaints or requests for assistance and such other matters pertaining to the Department which will enable the Administrator to exercise his/her responsibilities to the Committee.
2. 
The Director of Public Works shall submit, at least monthly, to the Administrator and the Committee, a written report concerning operations and other matters pertinent to the Department. The monthly written reports shall include, but shall not be limited to, the status of work projects, studies, reports and other actions authorized, contracted or directed by the Committee; items concerning personnel; needs of the Department; recommendations with respect to operating or other procedures or modifications thereto; and the number and status of citizen inquiries, complaints or requests for assistance. At least annually, the Director shall submit to the Administrator and the Committee a report summarizing the activities of the Department; recommendations with respect to all operations of the Department; and other matters of interest to the Township and the Committee.
3. 
The Director shall serve as liaison to such subcommittees of the Committee or agencies or instrumentalities of other governmental units as the Committee may direct and the Director shall report to the Administrator and the Committee matters of interest or concern to the Township and the Committee.
4. 
The Director shall receive all injuries, complaints or requests for assistance pertaining to the Department from all sources and shall direct the investigation of same, ordering, where appropriate, division action to satisfy said inquiries, complaints or requests.
5. 
The Director shall cause the preparation of all operating budget requests of the Department and its divisions in the form and within the time specified by the Committee. The Director shall review the operating budget requests of the supervisors of the divisions and shall have the power to alter or modify such requests after consultation with the supervisors.
6. 
The Director shall, after conferring with the supervisors of the divisions of the Department, applicable subcommittees of the Committee and the Committee liaison to the Department, submit to the Township Committee, not later than the first business day in September of each year, a capital budget request for the following year's budget.
7. 
The Director shall develop a six-year capital plan for the Department of Public Works, which shall be submitted to the Committee and Administrator consisting of:
(a) 
Items of construction.
(b) 
Acquisition of real or personal property.
(c) 
Original and replacement items.
(d) 
Items funded by bonding or current tax levy.
(e) 
Items which must be contracted out.
This plan shall be submitted to the Administrator for approval, rejection, and/or amendment before finalization.
8. 
The Director shall submit the six-year capital plan of the Department to the Committee not later than the first day in September of each year, and by June 30 each year thereafter.
9. 
The Director shall supervise the development of all bid and contract specifications for the purchase of services, products or property or the sale of services, products or property required by the Department or its divisions, or as may be directed by the Committee.
10. 
The Director shall review all bids received by the Township pertaining to the Department or as directed by the Committee, and shall, with the advice of appropriate supervisors, represent to the Committee compliance of the bidder with Township and other requirements imposed by law and the responsibility of the lowest bidder.
11. 
The Director shall review all proposed verbal or written contracts, purchase orders and vouchers prepared or initiated by the supervisors or employees of the Divisions of the Department before submission to the Treasurer, Purchasing Agent, Committee, Township Clerk or other Township officials and before any obligation shall have been incurred by the Township in order to assure budgetary compliance; to satisfy himself or herself of the need for such purchase; and for such other purposes appropriate to the discharge of his/her responsibilities.
c. 
Tenure. A person holding office, position or employment as full-time Director of Public Works in the Township of Neptune who has held that office, position or employment continuously for five (5) years or more shall continue to hold the office, position or employment, notwithstanding he is serving a fixed term, during good behavior and efficiency and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing.

a. 
Office Created; Appointment of Superintendent. There is hereby created within the Department of Public Works, the Office of Superintendent of Parks and Recreation for the Township of Neptune. The Superintendent of Parks and Recreation shall be appointed by the Mayor with the advice and consent of the Township Committee.
b. 
Powers and Duties. The Superintendent shall have charge of the care and upkeep of all Township-owned parks and recreational facilities and shall see that they are kept in a clean and sanitary condition and shall report to the Business Administrator when any of the parks or recreational facilities need repair. The Superintendent shall see to it that all play areas and facilities are kept in good and safe condition and that all restrooms and facilities are kept in a clean and sanitary condition.
c. 
Rules and Regulations Posted. The Superintendent shall, with the approval of the Mayor and Township Committee, post such rules and regulations as he/she deems necessary for conduct of persons in the parks and for the use of the recreational facilities.

a. 
Creation of Office; Appointment. There is hereby created within the Department of Public Works the position of Supervisor of Sewer Maintenance. The Supervisor of Sewer Maintenance shall be appointed by the Mayor with the advice and consent of the Township Committee.
b. 
Duties. The Supervisor shall have charge of the care and maintenance of those sections of the sewer collection under the care, custody and control of the Township.
The words "care and maintenance" shall include, but are not restricted to, the inspection, cleaning and repair of the sewer lines, force mains, laterals and pumping stations of the Township of Neptune sewer system, to assure the maximum operational efficiency and cleanliness.
The Supervisor shall report to the Business Administrator when any of the sewer collection facilities need repair.
c. 
Supervision of Employees. The Supervisor shall be in charge of and shall have direct supervision over the employees assigned to work in the Sewer Maintenance Department.

The enforcement of the ordinances and regulations of the Township dealing with minimum housing standards and the licensing of various trades, professions and activities within the Township requires the creation of a Code Enforcement Department separate and apart from the Construction Department established to enforce the New Jersey State Uniform Construction Code Regulations.
The establishment of the position of Code Enforcement Supervisor is necessary for the proper administration of the Code Enforcement Department.

As used in this section except as the context may otherwise require:
The singular number includes the plural and the plural, the singular.
"Shall" is mandatory and "may" is permissive.
"Writing" or "written" shall include printing, typewriting and any other mode of communication using proper or similar material which is in general use as well as legible handwriting.
The time within which an act is to be done shall be computed by excluding the last day and if the last day be a Sunday, a legal holiday, or a day on which the Township Offices are closed, that day shall be excluded.

There is hereby established a code enforcing agency to be known as the Neptune Code Enforcement Department consisting of a Code Enforcement Supervisor and such other personnel as shall be determined by the Township Committee. The Code Enforcement Supervisor shall be the Chief Inspector of the Department.

There is hereby created the position of Code Enforcement Supervisor who shall perform the following duties:
a. 
To administer and enforce the Revised General Ordinances of the Township of Neptune and all ordinances of the Township which pertain to minimum housing standards in Schedule A following Section 2-22 and such other ordinances hereinafter adopted by the Township Committee and designated by the Township Committee for administration and enforcement by the Neptune Code Enforcement Department.
b. 
To investigate, process, approve or disapprove all applications for licenses required by the several ordinances set forth in Schedule A; and keep permanent records thereof.
c. 
To make such inspections, evaluations, studies and surveys concerning code enforcement as shall be assigned to him by the Business Administrator and/or the individual assigned by the Business Administrator the responsibility for departmental action in accordance with paragraph e of subsection 2-5.6, and to prepare and submit in writing, reports there-on to said Administrator of Code Enforcement and Construction.
d. 
To keep a written record of all complaints made to the Department concerning code enforcement in the Township together with the nature of the investigation thereof and the action taken in response thereto.
e. 
To perform such other duties as may be assigned to him verbally and/or in writing by the Business Administrator and/or the individual assigned by the Business Administrator the responsibility for departmental action in accordance with paragraph e of subsection 2-5.6.

The appointment and term of the Code Enforcement Supervisor and the reasons for a vacancy or for discharge from the position shall be as follows:
a. 
The head of the Code Enforcement Department shall be the Code Enforcement Supervisor who shall be appointed by the Township Committee for an unspecified term. He/she shall be a person qualified by education, training and experience to perform the duties of this office.
b. 
Any vacancy in this position shall be filled by appointment by the Township Committee only for the unexpired portion of the term.
c. 
During the absence from duty or disability of the Code Enforcement Supervisor, the Township Committee may appoint by resolution, an officer or employee of the Township to perform the duties of the Code Enforcement Supervisor during this absence or disability. Such absence or disability shall be limited to three (3) consecutive months at which time the position shall be declared vacated by resolution of the Township Committee.
d. 
The Code Enforcement Supervisor shall not be removed from his/her position except for cause and upon written notice of the charges against him/her. In the event that the Code Enforcement Supervisor makes a request in writing to the Business Administrator for a hearing before the Township Committee of the charges against him/her, the Township Committee, within thirty (30) days of the request and upon written notice of the time and place thereof directed to the Code Enforcement Supervisor and/or his/her attorney, shall conduct a hearing into the facts, take testimony and such other proofs as may be presented. At such hearing, the Code Enforcement Supervisor shall be entitled to confront witnesses and proofs against him/her and present evidence and testimony on his/her own behalf. The Township Committee thereupon shall vote either to dismiss the charges against him/her, suspend him/her from office without pay for a period of time not to exceed thirty (30) days, discharge him/her both from the position and as an employee in accordance with the Personnel Ordinance of the Township.
a. 
The Code Enforcement Supervisor shall be appointed on the basis of his/her administrative ability, educational qualifications and his training and experience in code inspection and enforcement.
b. 
The Code Enforcement Supervisor shall be a resident of the State of New Jersey and of the Township of Neptune and shall remain a resident of the Township during his/her term of office. Should he/she change his/her residence during his/her term of office, the position shall be deemed vacated by resolution of the Township Committee.
c. 
No Code Enforcement Supervisor shall be appointed to the position unless he/she is able to devote his/her full time to the duties of that position except that nothing herein shall prevent him/her from holding another municipal position or office of the Township and fulfilling the duties thereof.
d. 
The Code Enforcement Supervisor shall receive as salary, such sums as may be fixed in the current Salary Ordinance adopted by the Township Committee.
e. 
The Code Enforcement Supervisor shall be the Code Enforcement Officer and at all times shall be under the supervision of and responsible to the Business Administrator and/or the individual assigned by the Business Administrator the responsibility for departmental action in accordance with paragraph e of subsection 2-5.6, and the Township Committee for all actions arising out of and in the course of his/her duties and responsibilities as Code Enforcement Supervisor.

There shall be a Department of Recreation which shall provide recreation programs for the residents of the Township and supervise parks and playgrounds.
The head of the Department of Recreation shall be the Director of Recreation who shall be appointed by the Township Committee. He/she shall be a person qualified by education, training and experience to perform the duties of this office.

The Director of Recreation shall:
a. 
Propose, develop, organize and supervise recreational programs for the residents of the Township and formulate plans for utilization of the recreational facilities of the Township.
b. 
Cooperate with the Board of Education and other public and private agencies and organizations in planning and conducting recreational programs.
c. 
Coordinate the activities of the Department of Recreation with those of other Township departments.
d. 
Supervise personnel of the department.
e. 
Be responsible for maintaining accurate records of the department.
f. 
Submit to the Township Committee, or such members thereof as may be designated by resolution, monthly reports on the operations of the department and the programs and activities sponsored by it and such other reports, recommendations and information as may be requested.

There shall be a Local Assistance Board of the Township composed of five (5) members appointed by the Township Committee. The term of one (1) member of the Local Assistance Board shall be for one (1) year and such member only may be appointed from among the members of the Township Committee, and the terms of the other members thereof shall be for four (4) years each, one (1) term expiring in each year. The term of each member of the Board shall begin on January 1, and each member shall continue in office until his successor is appointed and qualifies. Vacancies shall be filled for the unexpired terms only. The Board shall have such powers and perform such duties as are prescribed by general law and ordinance, and it shall appoint a Director of Welfare pursuant to State Law.

The Local Assistance Board shall organize and select a chairman and a secretary, and shall appoint a Director of Welfare who shall be the first executive and administrative officer of the Board. He shall hold office for a term of five (5) years from the date of his appointment, and shall be paid such salary as may be fixed by the Board subject to approval of the Township Committee. In case of vacancy in the Office of Director of Welfare, one temporary or acting director may be appointed to serve for not more than ninety (90) days.

Other employees, including assistants, clerks, investigators, case workers and nurses, in such number as may be necessary to properly administer public assistance, shall be appointed in the same manner as other employees of the Township. No employee of the Local Assistance Board whose compensation is paid from funds received or appropriated for public assistance or the administration thereof in any manner shall hold office in any political party.

The Director of Welfare shall:
a. 
Supervise by periodic investigation every person receiving public assistance, such investigation to be made by visitation at least once a month.
b. 
Reconsider from month to month the amount and nature of public assistance given, and alter, amend or suspend the same when circumstances so require.
c. 
Devise ways and means for bringing persons unable to maintain themselves to self-support or to the support of any other person or agency able and willing to do so.
d. 
Keep full and complete records of such investigations, supervision, assistance and rehabilitation, and of all certifications of persons for employment or benefits and cancellations thereof.
e. 
Institute appropriate action for commitment to any State or County institution when the best interest of the needy person would be so served.

The Manager of Emergency Medical Services shall report to the Township Administrator concerning matters of operation, personnel, planning, citizen inquiries, complaints or requests for assistance and such other matters pertaining to the Department which will enable the Administrator to exercise his/her responsibilities to the Township Committee.

The Manager of Emergency Medical Services shall submit, at least monthly, to the Administrator and the Committee, a written report concerning operations and other matters pertinent to the Department. The monthly written reports shall include, but shall not be limited to, the status of work projects, studies, reports and other actions authorized, contracted or directed by the Committee; items concerning personnel; needs of the Department; recommendations with respect to operating or other procedures or modifications thereto; and the number and status of citizen inquiries, complaints or requests for assistance. At least annually, the Manager shall submit to the Administrator and the Committee a report summarizing the activities of the Department; recommendations with respect to all operations of the Department; and other matters of interest to the Township and the Committee.

The Manager shall serve as liaison to such subcommittees of the Committee or agencies or instrumentalities of other governmental units as the Committee may direct and the Manager shall report to the Administrator and the Committee matters of interest or concern to the Township and the Committee.
4. 
The Manager shall receive all injuries, complaints or requests for assistance pertaining to the Department from all sources and shall direct the investigation of same, ordering, where appropriate, action to satisfy said inquiries, complaints or requests in accordance with policies of the Township.
5. 
The Manager shall cause the preparation of all operating budget requests of the Department and its divisions in the form and within the time specified by the Chief Financial Officer.
6. 
The Manager shall submit to the Chief Financial Officer and Governing Body liaison, all capital budget requests for the following year's budget, when requested to do so by the Chief Financial Officer and/or Administrator.
7. 
The Manager shall develop a six-year capital plan for the Department of Emergency Medical Services, which shall be submitted to the Chief Financial Officer, Committee liaison and Administrator consisting of:
(a) 
Acquisition of real or personal property.
(b) 
Original and replacement items.
(c) 
Items funded by bonding or current tax levy.
This plan shall be submitted to the Administrator and Chief Financial Officer for approval, rejection, and/or amendment before finalization.
8. 
The Manager shall supervise the development of all bid and contract specifications for the purchase of services, products or property or the sale of services, products or property required by the Department or as may be directed by the Committee, in accordance with the Township Purchasing Policy.
9. 
The Manager shall review all bids received by the Township pertaining to the Department or as directed by the Committee.
10. 
The Manager shall review all proposed verbal or written contracts, purchase orders and vouchers prepared or initiated by the supervisors of the Department before submission to the Chief Financial Officer, Purchasing Agent, Committee, or other Township officials and before any obligation shall have been incurred by the Township in order to assure budgetary compliance; to satisfy himself or herself of the need for such purchase; and for such other purposes appropriate to the discharge of his/her responsibilities.

The rules and regulations regulating the Department of Emergency Medical Services of the Township of Neptune attached to this section by reference are hereby approved. The Business Administrator is authorized to attach one (1) copy of the rules and regulations to this section.[1]

The New Jersey Department of Health has issued licensure for the Neptune Township Emergency Medical Services Program to be administered by the Department of Emergency Medical Services of the Township of Neptune.
b. 
The Department of Emergency Medical Services has applied for a "provider number" from the Federal and State Medicare/Medicaid Program, enabling the Township to institute a third-party payment plan.
c. 
Most residents have an insurance plan or Medicare/Medicaid which provides payments to relieve or to partially relieve their payment obligations.

The Township of Neptune hereby establishes the third-party payment plan and a subscription membership plan in accordance with Healthcare Finance Administration Guidelines ("HCFA") so that taxpayers will not be responsible for co-payments.
a. 
The Manager of the EMS Department ("EMS Manager") and the Chief Financial Officer of the Township of Neptune ("CFO"), in consultation with the Township Insurance Consultant, shall be responsible for the plan's billing.
b. 
The fee for services is initially set as seven hundred ($700.00) dollars plus costs as detailed in an annual fee schedule approved by the Governing Body.
c. 
The EMS Manager and the CFO shall annually review the plan's cost accounting records. The EMS Manager and CFO shall obtain the statewide industry average.
d. 
The CFO shall annually, no later than March 1 on the year following adoption of this section, adjust the fee for services as set forth herein pursuant to the recommendation of the EMS Manager and the Insurance Consultant.
e. 
The subscription plan shall be reviewed annually by the CFO and the subscription plan allocation shall be adjusted in the following year's budget in accordance with HCFA guidelines. The Insurance Consultant with the assistance of the CFO, shall prepare a report to be filed with the Office of the Township Clerk.
f. 
All fees associated with the EMS Program shall be adopted annually by resolution of the Township Committee and may be amended from time to time during the calendar year upon recommendation of the EMS Manager, Administrator and CFO.
