There shall be established in this Township a Board of Health, in accordance with N.J.S.A. 26:3-10.

The Board of Health shall be composed of six (6) members to be appointed by the Township Committee. All appointments shall be appointed for a term of three (3) years.

The Board of Health shall adopt rules and regulations for its government, and shall elect a President from its members.

The Board of Health may appoint a Secretary and such other officers and assistants as the Board of Health may deem necessary.

The appointees of the Board of Health shall be governed by the rules of said Board, and may be removed for cause by the Board.

The Board of Health shall not contract for any debts of any kind beyond the amount of the appropriation made for its use by the Township Committee.

There shall be a Registrar of Vital Statistics. The Registrar of Vital Statistics shall have charge of the administration duties involved in obtaining reports of and recording births, marriages and deaths in the Township, together with such related work as may be required in accordance with general law and ordinances of the Township.

There exists in the Township insanitary or unsafe dwelling accommodations and persons of low income who are forced to reside in such insanitary or unsafe accommodations. There is a shortage of safe or sanitary dwelling accommodations available at rents which persons of low income can afford and such persons are forced to occupy overcrowded and congested dwelling accommodations. These conditions cause an increase in and spread of disease and crime and constitute a menace to the health, safety, morale and welfare of the residents of the Township, and impair economic values. These conditions necessitate excessive and disproportionate expenditures of public funds for crime prevention and punishment, public health and safety, fire and accident protection, and other public services and facilities. These areas in the Township cannot be cleared, nor can the shortage of safe and sanitary dwellings for persons of low income be relieved, through the operation of private enterprise, and the construction of housing projects for persons of low income (as defined in the Local Housing Authorities Law) would therefore not be competitive with private enterprise. The clearance, replanning and reconstruction of the areas in which insanitary or unsafe housing conditions exist and the providing of safe and sanitary dwelling accommodations by any public body for persons of low income are public uses and purposes for which public money may be spent and private property acquired and are governmental functions. There is a need for housing for elderly persons of low income.

a. 
Pursuant to the provisions of the "Local Housing Authorities Law," N.J.S.A. 55:14A-1 et seq., as amended, a body corporate and politic to be known as the "Housing Authority of the Township of Neptune," is hereby created and established.
b. 
The Authority shall consist of seven (7) members known as Commissioners, who shall be appointed and hold office for the terms as hereinafter provided.
c. 
The Township Committee shall appoint five (5) Commissioners of the Authority and the Mayor shall appoint one (1) Commissioner.
d. 
The Commissioners so appointed shall hold office for a term of five (5) years and until their respective successors are appointed and have qualified except that all vacancies shall be filled for the unexpired term.
e. 
The Director of the Public Housing and Development Authority in the State Department of Conservation and Economic Development shall appoint one (1) member who shall serve at his pleasure.
f. 
Not more than one (1) Commissioner of any Authority may be an officer or employee of the Township of Neptune.
g. 
A certificate of appointment or reappointment of any Commissioner shall be filed with the Township Clerk and such certificates shall be conclusive evidence of the due and proper appointment of such Commissioner.
h. 
The prohibition of employment practices (Chapter 9, subsection 9-1.22 of this Code) shall be added to subsection (d) of the Housing Authority Code, so that the foregoing shall apply to the appointment of members to the Neptune Township Housing Authority as made by the Neptune Township Committee and/or Mayor of Neptune Township, and to all hiring or appointments of any and all employees within the Authority made by the members of the Authority.

The Township Clerk is hereby authorized and directed to file a certified copy of this section with the executive officer of the Public Housing and Development Authority in the State Department of Conservation and Economic Development.

a. 
As authorized by N.J.S.A. 55:14A-56, the Township of Neptune through its Township Committee is hereby authorized to carry out redevelopment projects as defined in N.J.S.A. 55:14A-31 et seq; to act therein as the "Local Public Agency" and to exercise and carry out all the rights, powers, privileges and immunities conferred by said law.
b. 
The Township Clerk is hereby authorized and directed to file a certified copy of this section with the State Commission of Conservation and Economic Development.

There is hereby created and established a Sewerage Authority for the Township under the corporate name entitled "Township of Neptune Sewerage Authority."

The Township of Neptune Sewerage Authority shall be permitted in its powers to install, maintain and operate regional trunk mains, regional force mains, regional pumping stations, regional treatment plant, regional out-fall line, and appurtenant facilities for the purposes of collecting and treating the sewage from sewer lines and mains installed, maintained, and operated and controlled by the municipalities consisting of Neptune Township, Neptune City, Bradley Beach, Avon-by-the-Sea, and the Ocean Grove Camp Meeting Association of the United Methodist Church, the Township of Wall, and the Borough of New Shrewsbury all located within the Neptune region.

The members of the Township of Neptune Sewerage Authority shall be hereafter appointed by resolution of the Township Committee in the manner provided in Chapter 138 of the Laws of New Jersey of 1946, as amended, and each member shall receive such compensation not in excess of $5,000 and the Chairperson not in excess of $5,500 in any one year as shall hereafter be determined by the Township of Neptune Sewerage Authority.
The prohibition of employment practices (Chapter 9, subsection 9-1.22 of this Code) shall be added to the Code governing the Neptune Township Sewerage Authority, so that the foregoing shall apply to the appointment of members to the Neptune Township Sewerage Authority as made by the Neptune Township Committee and/or Mayor of Neptune Township, and to all hiring or appointments of any and all employees within the Authority made by the members of the Authority.
Members of the Township of Neptune Sewerage Authority shall be ineligible for enrollment in any New Jersey State Health Benefits Program, any other health benefits program, any drug prescription program or any dental program.

The Township of Neptune Sewerage Authority shall have and exercise all of the powers and perform all of the duties provided for by Chapter 138 of the Laws of New Jersey of 1946 as amended, together with any other powers and duties which may hereafter be conferred by law upon Sewerage Authorities, as limited by the provisions of subsection 2-37.2.

A copy of this section duly certified by the Township Clerk shall forthwith be filed by the Township Clerk in the Office of the Secretary of State of the State of New Jersey.

Pursuant to N.J.S.A. 40:56A et seq., there is hereby established in and for the Township, an Environmental/Shade Tree Commission. The Commission is established for the protection, development, or use of natural resources, including water resources, open land areas, areas of scenic, historic, aesthetic, or educational and scientific value within the territorial limits of the Township.

The Commission shall consist of nine (9) members appointed by the Mayor, with the advice and consent of the other members of the Township Committee, one (1) of whom shall also be a member of the Planning Board and all of whom shall be residents of the Township. The members shall serve without compensation. The Commission shall designate one (1) of the members to serve as chairperson and presiding officer of the Commission.
The terms of office of the first commissioners shall be three (3) members for a one (1) year term, three (3) members for a two (2) year term, and three (3) members for a three (3) year term. Their successors shall be appointed to terms of three (3) years and until the appointment and qualification of their successors.
The Commission shall also consist of two (2) alternate members appointed by the Mayor with the advice and consent of the other members of the Township Committee. Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2." The terms of the alternate members shall be for two (2) years, except that the terms of the alternate members first appointed shall be two (2) years for Alternate No. 1 and one (1) year for Alternate No. 2.
The Township Committee may remove any member of the Commission for cause on written charges served upon the member and after a hearing thereon at this the member shall be entitled to be heard in person or by counsel. A vacancy on the Commission occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as an original appointment.
Any member shall not be permitted to act on any matter in which he or she has either directly or indirectly any personal or financial interest.
An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.

The Commission shall prepare and maintain a Natural Resource Inventory and shall keep an index of all open areas, publicly or privately owned, including open marshlands, swamps and other wetlands, in order to obtain information on the proper use of such areas and may recommend plans and programs to the Planning Board and Township Committee for inclusion into the Township Master Development Plan and for the development and use of such areas.
The Commission shall have the power to study and to make recommendations concerning open space preservation, waste resources management, air pollution control, solid waste management, noise control, soil and landscape protection, environmental appearance, marine resources and protection of flora and fauna. The Commission may coordinate and support the activities of unofficial bodies organized for similar purposes, and may advertise, prepare, print and distribute books, maps, charts, plans and pamphlets which in its judgment it deems necessary for its purposes. The Commission shall have such other powers and duties of environmental commissions as are now or shall hereafter be provided for by State Statute.
The Commission shall regulate the planting, care and control of shade and ornamental trees and shrubbery upon or in the highways, parks, or parkways of the Township.

The Commission shall keep agenda and minutes of its meetings and records of its activities and make an annual report to the Township Committee.

The Commission may incur expenses as are appropriate and necessary to its purposes providing the same shall be within the limits of funds appropriated to it by the Township Committee.

The Township of Neptune has been meeting with the City of Asbury Park for the purpose of creating a joint work plan for the improvement of Wesley Lake. The State has made appropriations in the amount of $270,000.00 for improvements to Wesley Lake. Wesley Lake borders both the City of Asbury Park and the Township of Neptune. A proposed Agreement of Charter of the Wesley Lake Commission establishes the purposes and responsibilities of the intermunicipal body; and the agreement has been amended to add the change of Item 5A, 3 to state that the appointment of the representatives will be by the governing body of each municipality. The Agreement of Charter embodies the mutual understandings between the City of Asbury Park and the Township of Neptune. The "Agreement of Charter of the Wesley Lake Commission" is made pursuant to N.J.S.A. 40:48B-1 et seq. and which was forwarded to the Township of Neptune for its approval, a copy of which is on file in the Office of the Township Clerk and is hereby incorporated herein by reference. The Township Committee has reviewed this Agreement and deems it in the best interest of the citizens of the Township of Neptune to be a party to the Commission.

The Township of Neptune has agreed to create and participate in the Wesley Lake Commission. The Mayor and Township Clerk are hereby authorized to execute an agreement known as the "Agreement of Charter of the Wesley Lake Commission."

The Agreement of Charter of the Wesley Lake Commission dated July 14, 2015, shall be the official and adopted Agreement of Charter and that appointments to the Commission will be by the Governing Body of each municipality unless expressly stated otherwise in said Agreement of Charter.

The Township of Neptune has agreed to create and participate in The Fletcher Lake Commission.
b. 
The Mayor and Township Clerk be and they are hereby authorized to execute an agreement known as the "Agreement of Charter of The Fletcher Lake Commission."

There is hereby established a Neptune Urban Development Assistance Grant (The U.D.A.G.) Reciprocal Loan Review Committee which will act as a subcommittee of the Neptune Township Economic Development Corporation (the EDC). This Committee shall be made up of seven (7) members appointed by the EDC and shall consist of the following:
a. 
One (1) member of the Township Committee for a like term, consistent with his/her elected position.
b. 
The Township Business Administrator for same term as his/her position.
c. 
The EDC President or his/her designee for a one (1) year term.
d. 
Three (3) EDC members or citizens of the Township of Neptune for a term of one (1) year.
e. 
The Township Chief Financial Officer for same term as his/her position.

The Neptune EDC will establish program guidelines; setting forth application procedures, eligibility and terms and conditions, to be referred as recommendations to the Neptune Township Committee for adoption by resolution or ordinance.

a. 
Findings. Under Section 119 of the Federal Housing and Community Development Act of 1974 as amended, and also known as the Urban Development Action Grant Program, the Township of Neptune has and will receive grant monies for various commercial and industrial projects; and, the Township has loaned grant monies to approved developers in accordance with Urban Development Action Grant guidelines. These funds are to be repaid with varying rates of interest to the Township; and, Section 119 of the Federal Housing and Community Development Act of 1974 (Public Law 93-383) as amended, requires that these funds be used for future development projects within the Township of Neptune, pursuant to that Section.
b. 
Account Established. All monies and interest repaid to the Township of Neptune in accordance with the U.D.A.G. guidelines will be deposited by the Treasurer in an interest-bearing account entitled "Neptune U.D.A.G. Reciprocal Loan Program," which will be self-perpetuating, and not to be a part of the Township's Surplus, General Fund, or other various accounts.
c. 
Program Established. A Reciprocal Loan Program will be established to assist prospective developers by offering reduced interest loans, pursuant to Section 119 of the Federal Housing and Community Development Act of 1974 (P.L. 93-383) as amended.

There is hereby authorized a Facade Review Committee which shall be appointed by the members of the Neptune Township Economic Development Corporation to administer the Facade Improvement Loan/Grant Program.

The Facade Review Committee will establish application guidelines and procedures and terms and conditions of loans and grants so authorized. Grants and loans awarded under this program are for exterior improvements only. Any combination of the following are eligible:
Chemical/steam cleaning.
Graffiti removal and shielding glaze.
New awnings.
Code violation eradication.
Wall repair including repair and installation of decorative details.
Painting.
Window repair and replacement.
Door repair and replacement.
Exterior lighting.
Miscellaneous facade improvement.
Signs.

The following criteria must be met to be eligible for a Facade Improvement Loan/Grant Program:
a. 
The owner of eligible property must not have any delinquent property taxes on the eligible property and any other property owned in the Township of Neptune. Businesses leasing property with delinquent taxes will be considered for the program. Program approval for properties which the owner owes property taxes or other fees to the Township will be granted by resolution of the Township Committee.
b. 
The eligible property and all other properties owned by the eligible property owner must be in compliance with all property maintenance codes or a corrective action plan.
c. 
Applicant and contractor agree to use the Township's Facade Construction Agreement.
d. 
Applicant and owner agree to maintain the facade for five (5) years after completion of the improvements.
e. 
Applicant completes the required application and receives approval from the Facade Review Committee.
f. 
Any other criteria as established by the Economic Development Corporation.
g. 
Compliance with all applicable requirements for project approvals as are required by Township ordinances and State statutes.

The Facade Improvement Loan/Grant Program will provide the following assistance opportunities:
a. 
One-to-One Grant/Private Investment Financing. Funding must have a leverage ratio of not less than one ($1.00) dollar of private sector funding for every one ($1.00) dollar of grant funding. Maximum grant funding shall be five thousand ($5,000.00) dollars per store-front. Once per annum, the Facade Review Committee will accept competitive applications and award up to ten (10) grants per annum up to a maximum of ten thousand ($10,000.00) dollars.
b. 
Three-to-One Loan/Private Investment Financing. Funding must have a leverage ratio of not less than one ($1.00) dollar of private sector funding for every three ($3.00) dollars of loan funding. Loan will be payable in quarterly, semi-annual or annual installments at a rate of fifty (50%) percent of the prime lending rate at the time of the application approval. Maximum loan amount shall be five thousand ($5,000.00) dollars per store front.
c. 
Combination Grant/Loan Financing. Maximum amount of seven thousand five hundred ($7,500.00) dollars per storefront, of which two thousand five hundred ($2,500.00) dollars can be granted in accordance with the terms of paragraph a in this subsection and the balance in accordance with terms of paragraph b in this subsection.

The application procedures and application review process shall be set by the Facade Review Committee. A Facade Improvement Loan/Grant Program application shall be prepared and made available by the Committee.

The Project ANCHOR Committee will administer a program to provide counseling and mentoring along with diverse and interest laden activities for referred Neptune elementary students in grades kindergarten through fifth grade in order to improve social skills, behavior, self-esteem and academics.

There is hereby authorized a Project ANCHOR Committee. The Committee shall be made up of thirteen (13) members and shall consist of the following:
a. 
One (1) member of the Township Committee.
b. 
Two (2) representatives of Jersey Shore Medical Center.
c. 
Three (3) representatives of the Neptune Township Board of Education.
d. 
One (1) member of the Neptune Township Police Department.
e. 
One (1) representative of the Neptune Housing Authority.
f. 
One (1) representative of the Neptune Township Finance Department.
g. 
One (1) representative of the Neptune Township Municipal Alliance Against Alcoholism and Drug Abuse.
h. 
One (1) representative of the clergy of Neptune Township.
i. 
One (1) citizen member at-large.
j. 
One (1) member of the Neptune Township business community at-large.

The members shall be appointed by resolution of the Township Committee. The members shall serve without compensation. Initial appointment of members shall be for a term of office of three (3) years; thereafter appointments shall be made for a term of one (1) year.

The members of the Project ANCHOR Committee shall conduct an annual reorganization at which time from among the membership a Chairperson, Vice-Chairperson, Secretary and Treasurer shall be selected.

The Shade Tree Commission is hereby authorized to administer the Tree Planting Matching Grant Program pursuant to rules, regulations and guidelines established by the Business Administrator and Chief Financial Officer.

The Business Administrator and Chief Financial Officer will establish application guidelines and procedures and terms and conditions of matching grants so authorized. The Township Committee shall approve all matching grants by resolution.

The following criteria must be met to be eligible for a Tree Planting Matching Grant:
a. 
Any homeowner with property located within the Township who satisfies all of the eligibility criteria and who does not have any delinquent property taxes on the eligible property or any other property owned in the Township of Neptune.
b. 
Applicant must agree to utilize the Township's Tree Planting Agreement, select a species of tree as recommended by the Shade Tree Commission and ensure that all work and materials are in compliance with the specifications of the Agreement.
c. 
Applicant must agree to maintain the tree(s) planted under this program.
d. 
Applicant is responsible for picking up the tree(s) from Township vendor and planting trees within fourteen (14) days of approval.
e. 
Funds shall be utilized for a specific species of trees selected from a list maintained by the Shade Tree Commission. Trees will be purchased from an approved Township vendor. The Township has acquired special pricing from local vendors who are required to maintain an adequate stock of trees for this program.
f. 
The Township of Neptune, with guidance from the Shade Tree Commission, will pay the Township's share to the vendor in accordance with the terms of the contract with the vendor. The applicant must pay the applicant's share of the cost of tree acquisition at the time of pickup from the vendor. The applicant also has the option to pay the entire cost of tree acquisition at the time of pick-up from the vendor in which case the Township will reimburse the applicant for the Township's share.
g. 
Tree(s) must be planted in the front yard of the residence, or in the Township right-of-way as approved by the Department of Public Works, in accordance with the plan approved by the Shade Tree Commission.
h. 
The homeowner is responsible for obtaining all required permits and approvals and must allow a Township Inspector to inspect the property, unannounced, during the course of work.
i. 
Applicant must receive both Shade Tree Commission and Township Committee approval.
j. 
Should the homeowner fail to comply with Township requirements, the homeowner will be notified in writing that the full amount of the Township share of the costs under this program must be reimbursed to the Township within thirty (30) days of said notification or the amount due will become a municipal lien against the property.
k. 
The Township accepts no responsibility for damages in connection with this program.

The Tree Planting Matching Grant Program will provide a one-to-one grant for the acquisition of trees to be planted in the front yard of a residence (as defined by Township Zoning regulations) or in the Township right-of-way when approved by the Department of Public Works. Each project considered for funding must have a leverage ratio of not less than one ($1.00) dollar of private sector funding for every one ($1.00) dollar of grant funding. Grant funding shall be available at a minimum of fifty ($50.00) dollars and a maximum of one thousand ($1,000.00) dollars per home. Sales tax will not be counted when calculating the local or grant share.

The application procedures and application review process shall be set by the Business Administrator and Chief Financial Officer, with the consent of the Township Committee. Tree Planting Matching Grant Program applications shall be made available by the Commission.

The Human Relations Committee will promote, through education, awareness and outreach programs, the diversity of the human relations spirit among the citizens of the Township of Neptune so as to foster good will, cooperation and respect among all diverse groups. The Committee will endeavor to encourage board community involvement to educate its citizens and protect its citizens while advocating the equality of life for all Neptune citizens who share the diversity of race, creed, color, national origin, nationality, ancestry, age, sex, affectional or sexual orientation, marital status, civil union status, liability for service in the armed forces, mental or physical handicap or disability. The Committee will be charged with maintaining and preserving the principles of fairness in which every citizen is entitled and shall do so through education and promotion of good will, cooperation and equal opportunity in social, employment, recreational and community activities. The Committee will foster participation, cooperation and conciliation among all and commit itself to the elimination of ignorance, bias and discrimination.

Membership to the Committee is open to all residents of the Township. The number of members shall be unlimited. There will be efforts made to include, but not be limited to, participation from the following groups:
a. 
Neptune Township Committee.
b. 
Neptune Township Police Department.
c. 
Neptune Township Municipal Clerk.

Members of the Committee shall be appointed by resolution of the Township Committee. The members shall serve without compensation and serve for a term of one (1) year.

The members of the Human Relations Committee shall conduct an annual reorganization at which time from among the membership a Chairperson, Vice-Chairperson, and Secretary shall be selected.

There is hereby created an advisory committee, which shall be known as the Advisory Committee on Sustainable Practices, hereinafter also called the "Green Team."

The members of the Green Team, including nonvoting members, shall receive no compensation for their services as members thereof, but may be reimbursed for reasonable and necessary appropriations made available therefor, but only upon request to and approval by the Township Committee. The governing body may also, in its discretion, allow the employment of clerical assistance for the Green Team and annually appropriate funds for compensation and/or reimbursement of expenses for said clerical assistance (if so assigned by the governing body) and legal counsel on an as-needed basis, and approved by the Township Committee.

The powers and duties of the Green Team shall be to:
a. 
Collaborate with Township employees, service providers and other governmental agencies to share resource information and ideas consistent with the purpose of the Green Team.
b. 
Encourage participation of all employees to solicit ideas on green initiatives.
c. 
Research and analyze green initiatives which make practical and environmental and financial sense.
d. 
Make all information of the Green Team available to the public.
e. 
Advise the Township Committee on matters affecting "green" initiatives.
f. 
Develop strategies for sustainable "green" initiatives in municipal operations.
g. 
Seek to coordinate, assist, and unify the efforts of private groups, institutions, and individuals within the Township of Neptune in accordance with the purposes of this chapter.
h. 
Maintain a liaison and communication with the public, private agencies and organizations of local, state, and national scope, whose programs and activities have an impact on "green" initiatives.
i. 
Carry out other such duties as may be assigned from time to time by the Township Committee.
j. 
Address and make recommendations to the Township Committee on green initiatives for the community at large, such as but not limited to future of electric vehicles and the need for recharging stations within the Township.
k. 
Serve as an advisory committee to the Township Committee concerning recommendations concerning "green" initiatives and review upon request by the Township Committee plans and recommendations that are suggested by the Township Committee towards "green" initiatives.

a. 
The Green Team shall consist of five regular voting members; two alternative members at large who shall only vote where a voting member is not present at a time of a vote but shall be the first to replace a voting member as a result of a vacancy by order of their appointment; and three nonvoting members consisting of the Committee liaison appointed with the consent of Township Committee by the Mayor, Director of the Department of Public Works and the Township Administrator. Of the five regular voting members, one may be a member of the Shade Tree Environmental Commission, if a member is willing and available, and if not, said seat may be filled by a citizen member, and the remaining members shall be citizens of Neptune Township interested in "green" initiative activities. All voting members must live in the Township of Neptune and continue to live in the Township of Neptune while a member. The exception shall be that one voting member may be a nonresident if said member has a business interest within the Township of Neptune or expertise in environmental studies. On the initial appointments to the Green Team, two voting members shall have a term of four years each and other three voting members from the among the group shall have a term of three years each; the two alternate members at large shall have terms as follows: Alternate 1, two years; and Alternate 2, one year. The nonvoting Committee liaison, Director of Public Works and Business Administrator shall serve for a one-year term.
b. 
The Green Team shall be encouraged to seek participation of other residents of the Township in all activities.
c. 
The Green Team may create and disband subcommittees as they deem appropriate or as requested by the Township Committee.

The Green Team, at its annual meeting or reorganization meeting, shall designate a Chairperson from among its voting members, who shall serve for the term of Chairperson for one year. The Green Team may re-elect the same individual as Chairperson on an annual basis at their discretion. At any annual meeting of the Green Team, its members shall elect, from among the voting members, all officers of the Green Team and establish rules and procedures for its members to follow. The Green Team shall keep accurate minutes of its meetings and activities, and shall file an annual report with the Township Committee. The annual report shall cover the activities and work of the Green Team and include recommendation as may be necessary to fulfill the purposes of this section. Approved minutes of meetings shall be filed with the Township Clerk.

This section shall be deemed an exercise of the powers of the Township Committee to establish a committee with the responsibility to research potential sustainable practices, including but not limited to, renewable energy, energy conservation, greenhouse gas emissions reductions, future electric car charging stations, and other environmentally beneficial practices. The Green Team will also promote sustainable practices to the community at large.
