As used in this chapter, the following terms shall have the
meaning indicated:
The animal and vegetable waste resulting from the handling,
preparation, cooking, and consumption of food.
The process of separating approved waste materials for collection
and conversion into reusable materials to reduce waste products in
the landfill.
Combustible and noncombustible waste materials, except garbage;
the term shall include paper rags, cartons, boxes, wood, rubber, leather,
tree branches, tin cans, metals, plastic, glass, crockery, dust, and
other similar materials.
A.
Residents shall recycle to the maximum extent practicable. The Department
of Public Works shall provide a list of recycling products that the
Town's contractor will collect. Residents shall place all recycling
in a supplied container. Cardboard that exceeds the capacity of the
supplied container shall be broken down, securely tied and bundled,
and placed next to the container. Residents may procure, at their
expense, an additional recycling container subject to the approval
of the Superintendent of Public Works or designated representative.
B.
Recycling containers provided are the property of the Town of Denton.
A person who misappropriates, destroys, damages, vandalizes, or loses
a recycling container is liable for the replacement cost of the container.
A.
It shall be the responsibility of the Department of Public Works,
or its agent, to provide collection of residential recycling, except
when official legal holidays or inclement weather may occur.
B.
Collection shall be rendered at the curb, roadside, or alley abutting
the residential property. Under no circumstances shall Public Works
employees or agents enter a private property to collect recycling.
Recycling left for collection shall not inhibit passage on public
thoroughfares, including sidewalks, in any manner.
C.
Nothing in this chapter shall preclude the provision of contractual
collection services as opposed to collection by municipal employees
and equipment.
A.
The Town shall extend recycling to nonresidential properties, provided said recycling collection meets the requirements set forth in Denton Town Code § 97-6 herein.
B.
All nonresidential establishments shall have their recycling containers
properly screened in accordance with the Town of Denton Zoning Ordinance.
Private individuals or firms engaged in the business of recycling
collection in the Town of Denton or who may use the streets of Denton
for the transport of these materials shall be subject to all federal,
state, or local laws, ordinances, codes, or regulations applicable
to the operation and maintenance of motor vehicles, including air
and noise pollution. All recycling collection vehicles shall be maintained
watertight and litter-free.
All recycling must be stored and offered for collection in the
provided container unless exempted herein. The regulations are as
follows:
A.
Residents should rinse and clean any soiled materials before placing
them in the provided recycling container.
B.
Only items listed on the container labels will be collected. Cardboard
should be flattened and bundled and may be left next to the recycling
container. Cardboard should not be left out during or when rain is
expected. No household waste or packing materials will be collected.
C.
All receptacles shall be maintained in a clean and sanitary condition.
They shall not be set out for collection containing free liquids or
rainwater. They shall be kept free of offensive odors resulting from
the lack of cleanliness.
D.
Recycling receptacles and/or containers shall be placed at the curb
or roadside or alley by 6:00 a.m. on the scheduled day of collection
but shall not be so placed prior to 5:00 p.m. on the day before collection,
and empty receptacles/containers shall be removed from the curb, roadside
or alley by 11:00 p.m. of the day of collection. Receptacles/containers
shall not be kept at the curb or roadside between scheduled collections,
and they shall be stored on the premises at such locations to be unseen
from the public streets or roads or from the front yards of immediate
neighboring property.
E.
All owners and tenants of structures containing not more than 10
residential dwelling units within the Town shall be required to comply
with the fees established by the Denton Town Council for recycling.
A.
It shall be unlawful for any person to disturb any recycling containers
or to remove the covers or any contents thereof, except the occupants
of the premises on which the containers are placed on their duly authorized
agents or the duly authorized employees or agents of the Town of Denton.
B.
It shall be unlawful for a person who is neither a Town resident
or a Town business owner to place their recycling for collection in
the Town incorporated limits.
A.
Any person, firm, or corporation violating any of the provisions
of this chapter shall be guilty of a municipal infraction punishable
by a fine established by resolution of the Denton Town Council.
B.
In the event of a violation of this chapter notice of the violation
shall be posted on the recycling container.
C.
The Town will charge an additional fee to dispose of trash or unacceptable
recycling items if resident does not comply within seven days after
given a written notice to correct the violation.
D.
The Town Council will establish the recycling program fee and fines
through resolution by the Town Council.
