As used in this chapter:
Shall mean the Borough of Bernardsville in the County of
Somerset and State of New Jersey.
Shall mean and include anyone engaged in the business of
collecting garbage and rubbish in the Borough.
Shall mean and include the side of any public street or road
appearing on the Official Map of the Borough.
Shall mean and include decayed animal or vegetable matter
originating in homes, kitchens, restaurants, hotels, produce markets,
stores, and other places where food and food products are stored and
prepared for sale of human consumption.
Shall mean and include any individual, firm, corporation,
association of persons, partnership, their agents and employees.
Shall mean and include broken or discarded crockery, glass,
bottles, cooking utensils, food containers, papers, magazines, small
pasteboard boxes and small cardboard cartons.
Shall mean and include any product of the Borough sewage
system or any septic tank or seepage pit located within the Borough
of Bernardsville.
Shall mean the Board of Health of the Borough of Bernardsville
in the County of Somerset and State of New Jersey.
Shall mean any waste, residue or by-product from any residential,
municipal, industrial, commercial, religious, educational, or other
location, activity or business, including, but not limited to, garbage,
rubbish, sewage.

Garbage and rubbish shall be put in water-tight metal or plastic
receptacles tightly closed. Other types of receptacles may be used
if approved by the Board. The capacity of receptacles shall not exceed
30 gallons. These provisions shall apply only where receptacles are
placed on the curb for collection.

Receptacles that are no longer serviceable or that cannot be covered
tightly, must be replaced by the owner.

a.
The garbage receptacles shall be strong, watertight, galvanized iron
pails, to hold not more than 10 gallons, with hoop-handles and close
fitting metal covers. Receptacles shall be kept at all times tightly
covered with the metal covers.
b.
The rubbish receptacles shall be baskets, boxes, barrels, or other
like material, but must not, when filled, exceed 50 pounds in weight.

a.
All vehicles in which garbage and rubbish are carted over streets
or roads in the Borough shall be covered tightly and shall be so constructed
and loaded as to prevent the contents from falling, spilling, or leaking.
b.
Vehicles used to cart any waste material over the streets or roads
in the Borough shall be so loaded as to prevent any part of the contents
of the vehicle from spilling. Any material that falls from these vehicles
shall be cleaned up at once by the driver.
c.
Any material which drops, leaks, or spills from vehicles used in
the collection of garbage and rubbish, or from garbage receptacles
when being emptied or loaded into the vehicles shall be cleaned up
immediately by the drivers thereof. The street must be broom cleaned.

The Board of Health may adopt, promulgate and enforce such rules
and regulations as it may deem necessary or advisable relative to
this section provided the same do not conflict herewith.

Any person who shall violate or fail to comply with any of the provisions of this chapter or with any order of the Board or its representative made in pursuance thereof, shall, upon conviction, be liable for the penalty stated in Chapter BHI, Section BH1-2. Each day a violation continues shall constitute a separate offense.
