No dog owner shall permit a dog to soil, defile, defecate on
or commit any nuisance on any common thoroughfare, sidewalk, passageway,
by-path, play area, park, or any place where people congregate or
walk, or upon any public property whatsoever, or upon any private
property without the permission of the owner, without having such
feces immediately removed and disposed of by the dog owner by any
sanitary method approved by the Animal Control Officer.
a.
Three copies of the Cat Licensing Code of New Jersey-1987 have been
placed on file in the office of the secretary of the Board of Health
for the use and examination by the public.
b.
Amendments and Additions. The following fee schedule, expiration
date, and penalties shall be established:
Section III(g): License Fee Schedule. A license shall be obtained
from the Borough Clerk's office after payment of a fee of $6
for each neutered cat and a fee of $9 for each unneutered cat.
Section III(h): Fees, Renewals, Expiration Date of License:
License from another municipality shall be accepted. The person applying
for the license and registration tag and/or sleeve shall pay the fee
fixed or authorized. The fee for the renewal of license and registration
tag or sleeve shall be the same as for the original, and the license,
registration tag or sleeve and renewal thereof shall expire on January
31, in the following year.
Section III(i): Loss of License: If a license tag or sleeve
has been misplaced or lost, the licensing agent may issue a duplicate
license and/or registration sleeve for that particular cat at a fee
of $0.50.
Section IV(a): Violations of Ordinance; Penalty: Except as otherwise
provided in this section, any person who violates, or who fails, or
refuses to comply with this section, shall be liable for a penalty
of not less than $5, nor more than $50 for each offense, to be recovered
by and in the name of the local Board of Health, or by and in the
name of the municipality.

a.
No person, firm or association shall have, keep, raise, harbor or
maintain any pig or pigs in the Borough of Bernardsville, without
having first obtained a license for that purpose from the Board of
Health.
b.
Such license shall allow the holder thereof to have, keep, raise,
harbor or maintain on the premises designated in the license, not
more than seven pigs.

Such license may be issued by the Board of Health upon payment
of a fee of $5 annually and shall expire on February first annually,
or prior thereto, if the premises licensed shall be converted to a
use other than that provided in this chapter, or if the license is
revoked for cause. Application for such license shall be made upon
blanks furnished by this Board.

a.
No license shall be issued by the Board of Health unless the premises
wherein the pig or pigs are to be kept, raised, harbored or maintained,
comply with all the requirements of this section and of the rules
and regulations of the State Department of Health and of this Board,
and unless in the judgment of the Board of Health of the Borough,
or Health Officer, the premises are so located and constructed that
the pig or pigs can be kept, raised, harbored or maintained in a sanitary
manner and without creating a nuisance.
b.
All buildings, yards, enclosures or premises in which any pig or
pigs shall be kept, raised, harbored or maintained shall be at all
times kept in a sanitary condition. The floors of buildings in which
any pig or pigs are kept must be of concrete, well drained, cleaned
daily and kept in good condition. The yards and enclosures shall be
drained and kept free of odors, manure, and other foul or decayed
matter. The feeding of garbage, collected from any dwellings, stores,
hotels, restaurants, or other public eating places, is prohibited
unless permission is first obtained from this Board.
c.
No building, yard, enclosure or premises in which any pig or pigs
shall be kept, raised, harbored or maintained, shall be located within
500 feet of any dwelling or other building where people sleep, eat
or live.
d.
It shall be unlawful for any person owning or having the management
or control of premises in the Borough where a pig or pigs are kept,
raised, harbored or maintained to permit a violation of any of the
provisions of this section or of the rules and regulations of the
State Department of Health or of this Board.

The Board of Health shall have the right to revoke, after five
days' written notice is given, any permit or license whenever
the holder thereof or any of his employees violate any of the provisions
of this chapter or the rules and regulations of this Board, or where
a nuisance is caused by the keeping, raising, harboring or maintaining
a pig or pigs.

When any person, firm, corporation, partnership or association
of persons shall violate any of the provisions of this chapter, each
day upon which such violation occurs shall be deemed to constitute
a distinct and separate offense.

The Board of Health or its Health Officer shall have the right
to inspect, as often as is reasonably necessary, all premises where
pigs are kept, raised, harbored or maintained and all premises wherein
the Health Officer has reason to believe that pigs are kept, raised,
harbored or maintained, and the Board of Health or Health Officer
shall have full and free access to all buildings, yards and places
of every kind and character and shall have power to enter and inspect
the premises used in connection with any such buildings, yards or
places for such purpose.

The Board of Health shall have the right to waive or to make
exceptions or modifications to the provisions of this chapter as they
may deem advisable and to adopt any rules or regulations they may
deem necessary for the protection of health.
Any person who violates any provision of this chapter shall be liable, upon conviction, for the penalty stated in Chapter BHI, Section BH1-2.
