This chapter shall be known and may be cited as the "Zoning
and Land Use Regulations of the Borough of Highlands."
The purpose of this chapter shall be to provide rules, regulations
and standards to guide land development in the Borough of Highlands
in order to promote the public health, safety and general welfare
of the municipality, taking into consideration the character of each
zone and its peculiar suitability for particular uses and to encourage
the most appropriate use of the land. It is further the purpose of
the Borough to limit and restrict buildings, structures, and uses
to specific zones and to regulate the type, extent and nature of their
use to avoid undue concentration, to conserve the value of property,
and to promote generally the purposes of the Municipal Land Use Law
(N.J.S.A. 40:55D-2).
Any and all other ordinances or parts thereof in conflict or
inconsistent with any of the terms of this chapter are hereby repealed
to such extent as they are in conflict or inconsistent.
If any article, section, subsection or paragraph of the chapter
shall be declared to be unconstitutional, invalid or inoperative,
in whole or in part, by a court of competent jurisdiction, such article,
section, subsection or paragraph shall, to the extent that it is not
unconstitutional, invalid or inoperative, remain in full force and
effect, and no such determination shall be deemed to invalidate the
remaining articles, sections, subsections or paragraphs of this chapter.
This chapter shall take effect immediately upon adoption and
publication according to law.
In the interpretation and application of this article, the provisions
herein shall be held to be the minimum requirements. Greater than
such minimum requirements may be imposed where to do so will more
reasonably effectuate the proposed development and where such greater
requirement is necessary to protect the health, safety and general
welfare of the Borough and its residents. Where other ordinances of
the Borough overlap with this chapter, the more restrictive provisions
of each ordinance shall take precedence.
