The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I, attached to and made a part of this chapter.
A. 
No person shall park a vehicle between the hours specified in Schedule II of any day upon any of the streets or parts of streets described in said Schedule II, attached to and made a part of this chapter.
B. 
No truck over four tons shall be parked on any street between 9:00 p.m. and 6:00 a.m., including Sundays and holidays.
No person shall stop or stand a vehicle during the time specified in Schedule III, of any day, upon any of the streets or parts of streets described in said Schedule III, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in said Schedule IV, of any day, upon any of the streets or parts of streets described in Schedule IV, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule V, attached to and made a part of this chapter, except at the angle designated and only within the painted white stall lines.
A. 
No vehicle shall be parked on the streets or parts of streets designated in Schedule VA and Schedule VB and Schedule VC attached hereto, and made a part of this chapter, during the hours designated and days designated, unless:

(1) 
The vehicle is owned by a resident of that street and the vehicle has displayed on its left rear window, in such a manner to be accessible to visible examination by an officer, a current residential parking permit.
(2) 
The vehicle is owned by a resident located at 100, 102, 104, 106, 108, 110, 112, 114, 116, 118, 120, 122 North Bridge Street, in such a manner to be accessible to visible examination by an officer, a current residential parking permit.

B. 
The following vehicles shall be exempt from this parking permit section:
(1) 
Visitors. A vehicle displaying a current visitor parking permit may park on any of the controlled streets described on Schedule VA and Schedule VB, provided that the operator of the vehicle is a bona fide guest of the residence within the permit parking area. The visitor's permit shall be displayed on the dashboard of the vehicle in such a manner as to be clearly visible by an officer enforcing parking regulations.
(2) 
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
(3) 
Emergency vehicles. Emergency vehicles and public service, telephone and other public utility vehicles may park within the permit parking area during the time they are rendering service or repairs within that area.
(4) 
Parking of vehicles as exempted in § 166-46.2.
C. 
Administration. Application for parking permits under this section shall be made in writing on forms provided to the Borough Clerk-Administrator or his designee. Permits shall be granted by the Clerk-Administrator under the following terms and conditions:
(1) 
To persons who are residents on said street or portion thereof upon which parking is restricted by this section, a permanent permit, valid for one year, shall be issued for every vehicle owned or principally operated by such person. There shall be no limit on the number of permits which may be issued to any one household. In the event a structure on said street or portion thereof upon which parking is restricted by this section shall contain a nonresidential use, then said nonresidential use shall be limited to two permits.
(2) 
Two visitor permits shall be issued to each residential unit on any street or portion thereof upon which parking is restricted by this section for use only by visitors to that residential unit.
D. 
Violations. It shall be unlawful and a violation of the provisions of this section for any person to:
(1) 
Cause, allow, permit or suffer any vehicle registered in his name or operated by such person to be parked in any of the areas designated on the attached Schedule VA and Schedule VB as established as a decal parking zone as herein described unless said vehicle displays a proper and current decal in accordance with this section.
(2) 
Willfully defraud, misuse or improperly obtain any decal so as the decal is used for a vehicle or person not entitled to use that decal as described under the provision of this section.
E. 
Penalty.
(1) 
Any person who shall violate or fail to comply with any of the provisions of Subsection D(1) as set forth therein shall be deemed guilty of an offense and shall be punished by a fine of $40.

(2) 
Any person who shall violate or fail to comply with the provisions of Subsection D(2) as set forth therein or who aids or abets any such violation or failure to comply with that subsection shall be deemed guilty of an offense and shall be punished by a fine not to exceed $500 or by imprisonment not to exceed 30 days, either or both of those penalties to be imposed at the discretion of the court.
A. 
Parking of any vehicle on any portion of a Borough public road, street or highway is prohibited whenever snow has fallen and the accumulation is such that the road, street or highway is snow-covered; an emergency shall exist and no vehicle shall be parked on the following streets or highways or portions thereof; all municipality-owned streets or highways.
B. 
The above parking prohibition shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic, to be determined by the Office of Emergency Management.
C. 
As used in this chapter, the term "snow-covered" shall mean any precipitation depositing any accumulation on the streets, roads or highways, including snow, sleet, hail, ice or freezing rain, which requires plowing, salting or sanding.
D. 
As to Subsection A of this section, regulatory and warning signs in accordance with N.J.S.A. 39:4-198 shall be erected and maintained at all street, road or highway entrances for motor vehicles into this municipality.
E. 
During extreme weather conditions when a vehicle is not able to proceed and must be parked on any street, road or highway in the Borough, the operator of such vehicle must, by the quickest means of communication, notify the Department of Public Works of the Borough of Somerville of such vehicle.
F. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and menace to the safe and proper regulations of traffic and any police officer may provide for removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
G. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this section shall be liable to a penalty of $40.
H. 
Upon the declaration of an emergency there shall be no parking upon any public road, street or highway or portion thereof in the Borough of Somerville where either a permanent or temporary "EMERGENCY NO PARKING" sign is displayed. The Mayor of the Borough of Somerville, or his duly appointed representative, with advice from the Borough Engineer, Chief of Police and the Fire Chief, is authorized to declare such emergency and to direct the posting of temporary "EMERGENCY NO PARKING" signs when, in his judgment, weather conditions, accident, fire, public celebration or other similar emergency requires the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that "EMERGENCY NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of said signs. Placing written advice of such posting on or in such a parked vehicle shall be deemed sufficient notification hereunder.
I. 
Upon the declaration of the emergency the Chief of Police may order that vehicles that remain in prohibited areas may be towed. Such costs including any administrative costs, storage or any costs arising from the tow shall be charged against the owner of the vehicle.
