The provisions of this Article XX shall be applicable to the Parking Deck as same is herein defined.
As used in this Article XX, the following terms shall have the meanings indicated:
ASSIGNMENT OF OPERATING MANAGEMENT RIGHTS
Defining the Borough rights to assign the operations management of the Parking Deck to a private company by entering into a contract/agreement detailing said assignment.
MULTI-SPACE PARKING METERING DEVICE
An electronic meter within the Parking Deck regulating multiple, numbered parking spaces within the public parking area which accepts coin or currency for payment of parking fees and charges for use of a parking space, and which dispenses a printed receipt indicating the numbered parking space and the time for which payment has been made.
NONPUBLIC PARKING AREA
Those parking spaces within the Parking Deck designated on the Parking Plan.
PARKING
The standing or waiting of a vehicle not actually engaged in receiving or discharging passengers or merchandise, unless in obedience to traffic regulations, signs or signals.
PARKING DECK
The parking garage structure located at 59 Veterans Memorial Drive East, Block 63, Lot 32.02 on the tax map.
PARKING SPACE
A space designated for the parking of a single vehicle by lines painted or durably marked on the floor of the Parking Deck.
PUBLIC PARKING AREA
Those parking spaces within the Parking Deck designated on the Parking Plan.
A. 
Off-street public parking in parking spaces as designated on the Parking Plan is hereby established.
B. 
A multispace parking meter shall be located as designated in the Parking Plan.
It shall be unlawful to park a vehicle: a) in any portion of the Parking Deck which is not marked as a parking space; and/or b) across any line or marking of a parking space or in such position that the vehicle shall not be entirely within the area marked as a parking space.
It shall be unlawful to park a vehicle in a parking space in the public parking area between the hours of 8:00 a.m. and 8:00 p.m. on Monday through Saturday unless: (a), a valid Parking Deck permit for public parking shall be prominently displayed so that same shall be visible through the front windshield; or (b), payment of the parking fee or charge for use of the numbered parking space for the period of time the vehicle shall occupy such parking space shall be made by deposit of the proper coin or currency in the multispace parking metering device.
It shall be unlawful to park a vehicle in a parking space in the public parking area between the hours of 12:00 midnight and 6:00 a.m. on any day unless a valid Parking Deck permit for public parking shall be prominently displayed so that same shall be visible through the front windshield.
It shall be unlawful to enter the Parking Deck with a vehicle between the hours of 12:00 midnight and 6:00 a.m. unless a valid Parking Deck permit for public parking shall be prominently displayed so that same shall be visible through the front windshield.
It shall be unlawful to park a vehicle in a parking space in the nonpublic parking area at any time unless there shall be a permit prominently displayed in or on the vehicle.
A. 
It shall be unlawful to operate a vehicle within the Parking Deck in a manner inconsistent with any directional signs or signals regulating the flow of traffic.
B. 
It shall be unlawful to operate a vehicle which exceeds eight feet four inches in height on any level of the Parking Deck.
C. 
It shall be unlawful to operate a vehicle which exceeds seven feet zero inches in height other than on the ground level of the Parking Deck.
It shall be unlawful to operate a vehicle within the Parking Deck at a speed in excess of eight miles per hour.
It shall be unlawful to deface, injure, tamper with, open, or willfully break, destroy or impair the usefulness or operability of the multispace parking metering device within the Parking Deck.
A. 
It shall be unlawful to deposit, insert or place any object or tangible thing other than valid United States coins or currency in the multispace parking metering device within the Parking Deck.
B. 
It shall be unlawful willfully to defraud, misuse or improperly obtain any parking permit provided for under this Article XX.
A. 
The hourly fee or charge for parking within the public parking area of the Parking Deck shall be defined annually by ordinance under parking fee schedules.
The Mayor and Council by resolution, and/or the Chief of Police by order, may, for special reasons or occasions, or in the event of emergency, temporarily suspend any provisions contained in this Article XX regulating the nature and time for use of the Parking Deck, spaces available for use, and parking fees and charges.
A. 
It shall be the duty of any police or parking enforcement officer, acting in accordance with instructions issued by the Chief of Police, to report:
(1) 
The number of the parking space in which a vehicle is parked in violation of this Article XX;
(2) 
A description of the area in which a vehicle is parked in violation of this Article XX, if other than in a numbered space;
(3) 
The state license number of such vehicle;
(4) 
The provision of this Article XX of which the vehicle is in violation.
B. 
The police or parking enforcement officer shall attach to any such vehicle a notice to the owner thereof that such vehicle has been parked in violation of the cited provision of this Article XX and instructing the owner to report to the Municipal Court in regard to such violation.
Any vehicle parked in violation of §§ 166-86, 166-87, 166-88, or 166-90 shall be subject to being towed, under the direction of the Police Department, to a garage or other place designated by the Chief of Police for impoundment, subject to redemption by the owner upon payment of the reasonable cost of towing and storage for each day or portion thereof during which it remains in said garage or other place.
No person shall utilize the Parking Deck or any portion thereof for recreation, sport, amusement, entertainment or other use not directly related to the parking of motor vehicles.
A. 
Any violation of §§ 166-86 through 166-92 shall be punishable by a fine of $50 per violation.

B. 
Any person convicted of a violation of §§ 166-93 or 166-94 shall be subject to a minimum fine of $100 and a maximum fine of $1,250, and such additional penalties as are provided in § 1-15 of the Code of the Borough of Somerville.
C. 
Any person convicted of a violation of § 166-99 shall be subject to a maximum fine of $1,250 and such additional penalties as are provided in § 1-15 of the Code of the Borough of Somerville.
