This chapter shall be known and may be cited as the "Solid Waste Management Ordinance of the Town."
It is hereby declared to be the purpose of this chapter to regulate the storage, collection, transport, processing, recovery and disposal of solid waste, in order to protect the public safety, health and welfare and to enhance the environment of the people of the Town.
It shall be unlawful to store, collect, transport, recover, incinerate or dispose of any solid waste within the boundaries of the Town contrary to the provisions of this chapter.
A. 
It shall be unlawful for any person to interfere with any employee of the Town while in the performance of his duties as authorized or required by this chapter.
B. 
Any person found violating this section will be subject to a fine of up to $300 or be imprisoned up to 30 days per judgement of the Coventry Municipal Court. The Municipal Court may impose a fine for defendants that fail to appear for arraignment.
In the absence of an agreement to the contrary, title to the solid waste shall vest in the owner of each management activity or facility in which the solid waste is placed.
A. 
Prohibited. It shall be unlawful for any person to scavenge any solid waste within the boundaries of the Town. Once municipal solid waste has been deposited in the designated place, be it at curbside or at a transfer station, the solid waste becomes the property of the Town. No person engaged in the business of separation, recovery, collection, removal, storage or disposition of solid waste shall pick up or procure any recyclable materials. This restriction shall also include any resident, taxpayer or other person who might engage in such practice for personal gain.
B. 
Penalty. Any person found violating this section shall be fined as penalty for the violation an amount up to $300 or be imprisoned for a period of time not to exceed 30 days for each violation. Fines are to be retained by the Town and the Municipal Court may impose a fine for defendants that fail to appear for arraignment.
C. 
Enforcement. The enforcement of this section shall be by the Town Police Department and violations of this section shall be prosecuted by the Police Department.
A. 
Prohibited. No person shall dump, deposit or discard any refuse, rubbish, waste, glass, broken ware, tin cans, filth or trash of any kind upon public or private property within the confines of the Town, except at such places as are properly designated for such purpose by the Town Council.
B. 
Penalty.
(1) 
Any person found violating this section shall be fined, as penalty for the first violation, the sum of $100 or be imprisoned for a period of time not to exceed 30 days.
(a) 
Upon second violation any person found violating this section shall be fined $250.
(b) 
Each consecutive violation thereafter will be subject to a fine of $500 per violation.
(c) 
Fines are to be recovered for the use of the Town.
(2) 
The Municipal Court may impose a fine for defendants that fail to appear for arraignment.
C. 
Enforcement. The enforcement of this section shall be by the Town Police Department and violations of this section shall be prosecuted by the Police Department.
It shall be unlawful to transport any solid waste in any vehicle which permits the contents to blow, sift, leak or fall therefrom.
It shall be unlawful for any person to use or operate a dump.
It shall be unlawful for any person to be engaged in the feeding of food waste to animals for commercial use with the exception of agricultural purposes.
A. 
Vegetative and nonprotein food wastes may be fed to animals for agricultural purposes, without additional requirement, provided it does not conflict with § 204-42.
B. 
Protein food wastes such as meats, seafood, and other food wastes that may harbor pathogens must be handled with proper food handling techniques as outlined by the Departments of Health and Agriculture before being fed to animals for agricultural purposes.
C. 
Nothing in this section shall in any way supersede or supplant the Town Zoning Ordinance.
A. 
Generally. The Town hereby implements a mandatory leaf and yard waste source separation program for the purpose of composting in accordance with the Town's commitment to resource recovery.
B. 
Placement for removal. During the leaf and yard waste collection season, residents shall place the leaf and yard waste material into paper bags or containers, no larger than 30 gallons in size, with handles and weighing not more than 50 pounds or automated yard waste containers not to exceed 96 gallons.
(1) 
These paper bags or containers shall be placed at the curbside in accordance with this section on the collection days specified by the Department of Public Works and advertised in the local newspapers, Town-managed social media accounts, and the Town website.
(2) 
No material other than leaf and yard waste materials shall be placed in these bags or containers.
(a) 
Branches may be placed for collection, and must be bundled and tied, and placed on the ground. The length of the bundle must not exceed four feet in length/height or 50 pounds in weight.
(3) 
No tape will be accepted as a method for closure. Staples, string and no closure are acceptable.
(4) 
Automated yard waste containers may be purchased from the Department of Public Works.
C. 
Nothing in this section shall in any way prohibit any resident from composting leaf and yard waste on their residential property for any use associated therewith that is not otherwise prohibited by the laws of this state.
A. 
When the resident fails to comply with the requirements of § 204-12, or this subsection, the Director of Public Works may refuse to collect the leaf and yard waste material of the resident until the next regular pickup, and the resident shall immediately remove from the curb such leaf and yard waste material.
B. 
Compostable leaf and yard waste material shall not be placed in plastic trash bags during leaf and yard waste collection season.
(1) 
Leaves and yard waste shall not be placed in the same refuse container as, or otherwise mixed with, other forms of solid waste for collection, removal or disposal during the leaf and yard waste collection season.
C. 
Any person allowing their leaf or yard waste material to become a hazard to public travel, health and safety, or to become a nuisance of any sort will be considered in violation of this section and subject to a fine of up to $100 or be imprisoned for up to 30 days. The Municipal Court may impose a fine for defendants that fail to appear for arraignment.
