This chapter shall be known and may be cited as the "Solid Waste
Management Ordinance of the Town."
It is hereby declared to be the purpose of this chapter to regulate
the storage, collection, transport, processing, recovery and disposal
of solid waste, in order to protect the public safety, health and
welfare and to enhance the environment of the people of the Town.
It shall be unlawful to store, collect, transport, recover,
incinerate or dispose of any solid waste within the boundaries of
the Town contrary to the provisions of this chapter.
In the absence of an agreement to the contrary, title to the
solid waste shall vest in the owner of each management activity or
facility in which the solid waste is placed.
It shall be unlawful to transport any solid waste in any vehicle
which permits the contents to blow, sift, leak or fall therefrom.
It shall be unlawful for any person to use or operate a dump.
It shall be unlawful for any person to be engaged in the feeding
of food waste to animals for commercial use with the exception of
agricultural purposes.
A. Vegetative and nonprotein food wastes may be fed to animals for agricultural
purposes, without additional requirement, provided it does not conflict
with § 204-42.
B. Protein food wastes such as meats, seafood, and other food wastes
that may harbor pathogens must be handled with proper food handling
techniques as outlined by the Departments of Health and Agriculture
before being fed to animals for agricultural purposes.
C. Nothing in this section shall in any way supersede or supplant the
Town Zoning Ordinance.
