As used in this chapter, the following terms shall have the meanings indicated:
FIREARM
A. 
Includes the following:
(1) 
Any pistol or revolver; or
(2) 
A shotgun having one or more barrels less than 18 inches in length; or
(3) 
A rifle having one or more barrels less than 16 inches in length; or
(4) 
Any weapon made from a shotgun or rifle, whether by alteration, modification or otherwise, if such weapon as altered, modified or otherwise has an overall length of less than 26 inches; or
(5) 
An assault weapon.
B. 
For the purpose of this definition, the length of the barrel on a shotgun or rifle shall be determined by measuring the distance between the muzzle and the face of the bolt, breech, or breechlock when closed and when the shotgun or rifle is cocked; the overall length of a weapon made from a shotgun or rifle is the distance between the extreme ends of the weapon measured along a line parallel to the center line of the bore.
C. 
"Firearm" does not include an antique firearm.
The purpose of this chapter is to prohibit any person from discharging a firearm in the area comprising the former Village of Macedon in which such activity may be hazardous to the general public or nearby residents.
The discharge of firearms as defined in § 163-1 is deemed hazardous to the general public and, therefore, is prohibited within the area comprising the former Village of Macedon.
The provisions of this chapter shall not apply to a law enforcement officer in the performance of his or her official duties.
This chapter shall be enforced by the Town of Macedon Police Department, the New York State Police, the Wayne County Sheriff's Department and the Department of Environmental Conservation, each of whom is hereby authorized and empowered to issue an appearance ticket for any violation of any provision of this chapter.
Any violation of any provision of this chapter shall, upon conviction, be punishable by a minimum fine of $250 and a maximum fine not exceeding $1,000 for each offense.
