Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle I of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Borough.

The provisions of this chapter imposing a time limit or restricting parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute, any other Borough ordinance or as hereinafter provided.

a. 
Nothing contained herein shall prohibit the Chief of Police or his duly authorized designee from suspending any parking restriction under special circumstances and thus permit parking to occur in a normally restricted place. Such suspension of parking restrictions shall only occur due to special circumstances, such as to accommodate road construction or due to severe weather conditions. Such suspension must also occur for a limited time period during which the circumstances warrant the suspension of parking restrictions.
b. 
The Mayor of the Borough of North Plainfield may also, upon written notification to the Chief of Police, suspend parking restrictions under special circumstances for limited periods of time, not to exceed 72 consecutive hours.
c. 
Such decision shall be made in the sole discretion of the Chief of Police or his designee, or by the Mayor, and shall not be arbitrary, capricious or unreasonable. Such suspension shall be properly published with temporary street signage as to allow members of the public to be so informed. Such decisions must be duly recorded and documented in daily police logs at the time the suspension is made, to include the date and time when the suspension of parking restrictions begins. The reinstatement of parking restrictions must also be duly recorded and documented in daily police logs at the time the reinstatement becomes effective, to include the time and date when the suspension of parking restrictions ends.

Except when necessary to avoid conflict with other traffic signs or signals, no operator of a vehicle shall park, stop or stand the vehicle in any of the following places:
a. 
In front of a driveway;
b. 
On a sidewalk;
c. 
Within a No-parking zone as established by ordinance;
d. 
Within a bus stop as established by ordinance;
e. 
Outside the lines or markings of a designated parking space or in such a manner as to be "double parked;"
f. 
Within a designated fire zone as established by ordinance;
g. 
Within a designated loading zone as established by ordinance;
h. 
Within a designated taxi stand as established by ordinance;
i. 
Within an intersection;
j. 
On a crosswalk;
k. 
Within 25 feet of the nearest crosswalk or side line of a street or intersecting street;
l. 
Within 50 feet of a stop sign; and
m. 
Within 10 feet of a fire hydrant.

a. 
Every person convicted of a violation of Subsection 7-3.1A a through m shall be liable for a penalty of $44.
b. 
Every person convicted of or who pleads guilty to more than one violation of Subsection 7-3.1A c, f or i through m within a 12 month period between January 1 and December 31 of each year may, in the court's discretion and in addition to the penalty described in paragraph a of this subsection, be liable for a progressive penalty of $10 multiplied by the number of prior convictions of or guilty pleas to a violation of Subsection 7-3.1A c, f or I through m within that 12 month period of that year upon each subsequent conviction of or guilty plea to a violation of Subsection 7-3.1A c, f or I through m up to a maximum fine of $1,000. A person shall not be liable for a progressive penalty unless the multiple convictions of or guilty pleas to a violation of Subsection 7-3.1A c, f or I through m are multiple convictions of or guilty pleas to the same subsection within a twelve-month period between January 1 and December 31 of each year.
c. 
Parking Monitoring and Enforcement System.

1. 
Installation of Parking Monitoring and Enforcement System.
(a) 
The Borough of North Plainfield hereby declares that, due to the parking of private or commercial vehicles in designated no parking zones or locations, traffic in the Borough's commercial and residential districts is increased, pedestrian, bicyclist and e-scooter users are exposed to additional safety risks and vehicular traffic is subject to reduced sight triangle vision in and around such designated no parking zones.
(b) 
The Borough of North Plainfield therefore determines that it needs to install and utilize a parking monitoring and enforcement system ("System") at various locations within the Borough of North Plainfield to monitor and enforce parking by the North Plainfield Police Department in such locations which are designated as "no parking" zones or locations pursuant to this Chapter (§ 7-3.1) of the Borough Code.
(c) 
The Borough shall have the authority to enter into a contract, following a lawful procurement process, for the installation of the System by a private parking monitoring and enforcement System provider.
2. 
Issuance of Summons.
The Police Department of the Borough of North Plainfield shall review the recorded images produced by the System to determine whether sufficient evidence exists demonstrating that a parking monitoring and enforcement violation has occurred and shall issue a summons when appropriate in accordance with the Rules of Court governing the Courts of the State of New Jersey, in particular Article 7 of the Rules of Court, governing the Rules of the Municipal Courts.
3. 
Use Of System Recorded Images.
(a) 
Except as otherwise provided in this Section or as otherwise by law or regulation, the recorded images produced by the System shall be available for the exclusive use of law enforcement officers of the North Plainfield Police Department for the purpose of discharging their duties to monitor and enforce all parking ordinances applicable in and about the Borough of North Plainfield.
(b) 
Any recorded image or information produced in connection with the System shall not be deemed a public record under N.J.S.A. 47:1A-1 et seq., or common law. The recorded images shall not be discoverable as a public record by any person, entity or governmental agency, except upon a subpoena issued by a grand jury or a court order in a criminal matter, or offered as evidence in any civil or administrative proceeding not directly related to a parking monitoring and enforcement system violation. This Section does not deny the right of a person charged with a parking violation under this Chapter to receive the same as discovery for the preparation of their case, and which shall be provided with service of any parking summons issued through the System by a law enforcement officer.
(c) 
Any recorded image or information collection in connection with any violation issued through the System by a law enforcement officer shall not be retained after sixty (60) calendar days following the resolution of any violation by collection of any fine or penalty or following any final adjudication by a court of competent jurisdiction. After the resolution of any violation by collection of any fine or penalty or following any final adjudication by a court of competent jurisdiction, the North Plainfield Police Department may purge such records without further action or authorization.
(d) 
If a summons is not issued within sixty (60) business days following the System assisted observation of a violation, all recorded images and any information collected with respect to the parking monitoring and enforcement system violation shall be removed by the North Plainfield Police Department within ten (10) business days thereafter.
4. 
Owner's Liability.
The liability of the owner and operator of a motor vehicle for a violation or summons issued pursuant to the System shall be joint in accordance with the provisions and presumptions of the New Jersey Motor Vehicle Code.
5. 
Violations and Penalties.
Any person liable for a System assisted violation or summons pursuant to this Chapter and/or the New Jersey Motor Vehicle Code, utilizing the System, shall be subject to the following fines:
(a) 
Violation: Eighty ($80.00) dollars per violation.
a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fire or public celebrations, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and menace to the safe and proper regulations of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and accumulation is such that it covers the street or highway, an emergency shall exist and no person shall park a vehicle upon any of the streets or parts thereof described in Schedule I of Chapter 7A.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parking or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule II of Chapter 7A.

No person shall park a vehicle between the hours specified in Schedule III of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III of Chapter 7A.[1]

No person shall stop or stand a vehicle between the hours specified in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV of Chapter 7A.

No person shall park a vehicle for longer than the time limit shown in Schedule V at any time between the hours listed in Schedule V of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule V of Chapter 7A.

No owner of any vehicle that is or is required to be registered and/or licensed by the Motor Vehicle Commission or equivalent agency as a vehicle may park that vehicle on that portion of the front yard which is directly in front of any principal structure, as defined in § 22-3, of any premises located in a residential district except for an attached and front-facing garage. Such vehicles include by way of example, but not by limitation, automobiles, trucks, buses, vans, sport utility vehicles, motorcycles, boats, and trailers. This section shall not be construed to preclude the parking of vehicles on the driveway area of the property as set forth in §§ 22-117.2 and 22-117.4. The person/entity responsible for the enforcement of this section shall be the North Plainfield Police Department and/or the Code Enforcement Officer of the Borough of North Plainfield or their designee.

No person or entity shall stop, park or place a vehicle in a stationary position, whether the motor is running or not, during the hours of 9:00 p.m. to 6:00 a.m. on any day of the week upon any of the streets, or parts thereof, parking lots or parking areas, or parts thereof, or any other areas of the portion of Green Brook Park located within the geographic confines of the Borough of North Plainfield.

No parking of any boat shall occur in any zone of the Borough of North Plainfield in and along any public street, thoroughfare or right-of-way between the hours of 9:00 p.m. and 6:00 a.m. of any day of the week. "Boat," as used herein, or as to any use of the term in any part of § 7-3 of the Code, shall be defined as a ship, vessel and/or any other watercraft, which is used for, capable of being use for, or intended for use for transportation of any person, property, animal or other conveyance of any kind on the water.

Trucks over four tons gross weight are hereby excluded from the streets or parts of streets described in Schedule VI except for the pickup and delivery of materials on such streets, Schedule VI of Chapter 7A.

No person shall park any commercial vehicle with a gross registered weight over 6,500 pounds or any other vehicle with a gross registered weight over 8,000 pounds on any street within the Borough at any time, with the exception of vehicles providing a service on a short term or temporary basis for a period not to exceed 24 hours, such as but not limited to, moving vans, landscaping trucks, and delivery vehicles.

The streets or parts of streets described in Schedule VII of Chapter 7A are hereby designated as one-way streets in the direction indicated.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of or who pleads guilty to a violation of a provision of this chapter or any supplement thereto, except for a conviction under Subsection 7-3.1A c, f or l through m, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both. The penalty for violation of Subsection 7-3.1A I through m shall be as prescribed by Subsection 7-3.1B b of this chapter.
All former traffic ordinances of the Borough of North Plainfield covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The locations described in Schedule XIX of Chapter 7A are hereby designated as school bus zones.
No parking, stopping or standing shall be permitted in such school bus zone by any vehicle other than a school bus.

In accordance with the provisions of N.J.S.A. 39:4-197, the off-street municipal parking yards and Board of Education property described in Schedule XXII of Chapter 7A are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the off-street parking yards described in Schedule XXIII of Chapter 7A are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

In accordance with the provision of N.J.S.A. 39:5A-1, the off-street parking yards described in Schedule XXIV of Chapter 7A are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

The owners of the premises referred to in Subsections 7-15.3 and 7-15.4 shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signing and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

a. 
No owner, operator, lessee or occupant of any premises having a parking space reserved for handicapped drivers, nor any contractor or other person employed or engaged by any such owner, operator, lessee or occupant, may block or limit access to any handicapped parking space by the plowing or placement of snow, ice or other debris in such space.
b. 
In addition to any other penalties provided by this chapter or by statute, any person who violates any provision of this subsection shall be required to remove the snow, ice or other debris at his or her own expense, or shall be charged for the costs of such removal by the Borough.

The locations described in Schedule XXV of Chapter 7A are hereby designated as parking spaces reserved for police vehicles. No parking, stopping or standing shall be permitted in such spaces by any vehicle other than a police vehicle. For the purposes of this Section, a police vehicle shall be defined as any motor vehicle, marked or unmarked, that is registered to or utilized by any federal, state, county or municipal law enforcement agency.

A midblock crosswalk is hereby created on Walnut Street beginning at a point 469 feet west of the westerly curbline of Grove Street to a point, extending 12 feet westerly therefrom.

The locations described in Schedule XXVII of Chapter 7A are hereby designated as parking spaces reserved for municipal vehicles. No parking, stopping or standing shall be permitted in such spaces by any vehicle other than a municipal vehicle. For purposes of this section, a municipal vehicle shall be defined as any motor vehicle, marked or unmarked, that is registered to or utilized by a state, county or municipality.

The Borough of North Plainfield shall permit charitable organizations as defined in N.J.S.A. 45:17A-20 to solicit contributions in certain designated roadways situate in the Borough of North Plainfield in accordance with the provisions contained herein.

All charitable organizations as defined in N.J.S.A. 45:17A-20 who desire to solicit contributions in designated roadways situate in the Borough of North Plainfield shall file an application for a permit with the North Plainfield Borough Clerk on a form supplied by said Clerk specifying the following information:
a. 
Name of applicant organization.
b. 
Address of applicant organization.
c. 
Telephone number of applicant organization.
d. 
Contact person of applicant organization.
e. 
Specific location or locations of proposed charitable solicitation.
f. 
Dates and times of proposed charitable solicitation.
g. 
If said request pertains to a location or locations on any county highway, or intersection of a county highway, said application shall include a copy of an authorization from the Somerset County Board of Chosen Freeholders to permit said charitable solicitation.
h. 
If said request pertains to a location or locations on any state highway or intersection of a state highway, said application shall include a copy of an authorization from the Commissioner of Transportation of the State of New Jersey to permit said charitable solicitation.
i. 
Description of the manner in which the motorist solicitation will be conducted and the procedures to be used to ensure the safety of the members of the public who will be traveling the roadways situate in the Borough of North Plainfield.

Upon the filing of a complete application in accordance with the provisions of this section, the North Plainfield Borough Clerk shall present same to the North Plainfield Borough Council for its review and consideration, after which the Borough Council shall grant or deny the applicant's request. In the event the Borough Council grants the applicant's request, it shall issue a permit to the applicant which shall be subject to the representations contained in the applicant's application and any conditions imposed by the Borough Council.

In no event shall any charitable organization requesting authorization from the Borough of North Plainfield for said charitable solicitations use any individual under the age of 18 years to perform any function or task associated with the said charitable solicitation in any roadway.

Any charitable organization requesting authorization from the Borough of North Plainfield for said charitable solicitation shall comply with all of the terms and conditions of N.J.S.A. 39:4-60, as amended by P.L. 1997, Chapter 82, approved April 30, 1997.

The locations described in Schedule XXVIII of Chapter 7A are hereby designated as locations for on-street parking reserved for Fire Department vehicles.

The Borough Council shall, upon the recommendation of the North Plainfield Police Department, from time to time designate by ordinance such locations for on-street permit parking for commercial establishments. On-street permit parking may be authorized only for the following purposes:
a. 
To alleviate traffic congestion due to limited ingress and egress by patron and commercial traffic to a site;
b. 
To provide safe access to sites with limited or no off street parking for commercial deliveries;
c. 
To provide safer pedestrian access along the frontage of or into commercial locations;
d. 
To provide for reduction in traffic delay or obstruction; and
e. 
Any other reason which is determined by the North Plainfield Police Department to contribute to reduction in traffic delays, obstruction or to contribute to increased pedestrian or cycling use in commercial areas.

a. 
An owner or operator of a commercial establishment which is a permitted use in the zone wherein the commercial establishment is located shall apply to the North Plainfield Police Department for an on-street permit parking space adjacent to the commercial establishment upon payment of a fifty ($50.00) dollar application fee and submission of a drawing showing the proposed location of the permit parking space.
b. 
Only one (1) on-street permit parking space will be permitted at any single premises, regardless of how many commercial establishments may be located therein or thereon.
c. 
The North Plainfield Police Department shall investigate the on-street permit parking request and recommend whether to grant or deny the permit parking space to the Chief of Police for his final decision, subject to paragraph d below.
d. 
The Chief of Police or their designee shall notify the Mayor and Borough Administrator, who shall then provide for the approval of the on-street permit parking space to be set forth in Borough Code § 7A-29, Schedule XXIX, Permit Parking, or deny the application.
e. 
Upon approval of the application for the on-street permit parking space, the owner or operator requesting the permit parking space shall pay a fee of forty ($40.00) dollars per month or any part thereof, or thirty-five ($35.00) dollars per month or any part thereof if purchased for a period of six (6) months or more in any calendar year.
f. 
If the on-street permit parking is not renewed before January 31st of each year or at the end of any period of six (6) or more months as set forth in paragraph e, above, the on-street permit parking permit shall be automatically terminated without further action by the Borough or the North Plainfield Police Department.
g. 
The owner or operator of the premises making an application for permit parking under § 7-21.2b shall, if such application is approved, provide and install signs and pavement markings for the permit parking space which signing and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner or operator of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

There is hereby established in the Borough of North Plainfield an E-Commerce Exchange Zone at the Municipal Parking Lot located on the southeast corner of the Somerset Street/Pearl Street/Craig Place intersection, also known as Block 88.00, Lot 6, for the use of private parties to conduct private business transactions by answering newspaper advertisements or through online retailers between the hours of 9:00 a.m. through 6:00 p.m., Monday through Sunday.

The E-Commerce Exchange Zone shall be used only for the following transactions:
a. 
Delivery of items agreed to be exchanged between private parties who are conducting private business transactions by answering newspaper advertisements, or through online retailers such as E-Bay, Craigslist, OfferUp, or Facebook in order to finalize their private transactions.
b. 
Delivery of items under paragraph a, above, are limited to one half (1/2) hour per transaction.
c. 
The E-Commerce Exchange Zone shall not be used for on-location sales of any kind from any vendor vehicle, such as a food truck or vendor stall, wagon and/or other vehicle and no vendor shall erect any table, tent, awning and/or canopy for the sale of goods on-location.
d. 
Vehicles used by the transacting parties must pay the associated parking fees, unless said vehicles are actually occupied or in use for loading and unloading as part of the transaction.

The following acts are clearly prohibited:
a. 
Illegal transactions, including, but not limited to exchange of contraband, illegal drugs, illegal substances, stolen property and/or other illegal items and/or exchanges.
b. 
Transactions involving firearms, firearms parts, ammunition and/or explosives.
c. 
Delivery of large, bulky items that would disrupt the operations of any Borough activity and/or the use of the Municipal Parking Lot for parking.
d. 
The delivery of any packages and/or goods to these facilities on behalf of a purchaser as a drop-off, where any such packages, goods and/or items which are left without attendance by any person and/or entity to wait a later pick-up.
e. 
Any such packages, goods and/or items which are left in the E-Commerce Exchange Zone without attendance by any person or entity for more than one half (1/2) hour are subject to seizure and confiscation by Borough officials, without notice and disposed of as trash.

The E-Commerce Exchange Zone is for the convenience of private citizens conducting business transactions by answering newspaper advertisements, or through online retailers, to permit such private citizens to pin the location on an electronic map and/or otherwise indicate a location where the transaction can be completed. The Borough neither offers, warrants, guarantees and/or represents that the use of the Municipal Parking Lot is insured, monitored or otherwise protected in any way by Borough employees and no representation, promise, warranty, guarantee and/or insuring is intended by the creation of a municipal E-Commerce Exchange Zone.

Any person who shall violate any of the provisions of' this Section shall, upon conviction of same, be subject to a penalty as established in Chapter 1, Section 1-5 of the Borough Code.
