The North Plainfield Parking Authority has been duly created pursuant to N.J.S.A. 40:11A-1, et seq., for the purposes of promoting the free movement of traffic and relieving the traffic congestion on the streets of the Borough so as to promote the public safety and welfare. The Parking Authority of the Borough, in fulfilling its ordained functions pursuant to the statutes in such cases made and provided, has established off-street parking facilities in the Borough. In operating the off-street parking facilities, the Parking Authority of the Borough has rented and continues to rent the spaces for parking either on a meter basis or a monthly basis; and notwithstanding the requirement that the prescribed fee for parking to be paid to use the off-street parking facilities, motor vehicles are being parked without the operator thereof paying the prescribed fee, the actions being in derogation of the program for off-street parking facilities in the Borough. There are no means available by which the Parking Authority of the Borough may effectively enforce the regulation of parking in the off-street parking facilities without the aid of the Borough. The Parking Authority has by Resolution requested municipal aid to enforce parking regulations in those designated off-street parking facilities so as to promote the purposes for which the Parking Authority of the Borough was created. Pursuant to N.J.S.A. 39:4-197, the Borough is empowered to provide for the regulation of parking of vehicles upon premises owned or leased by the Parking Authority of the Borough and it is essential and necessary in efficiently implementing the functions of the Parking Authority of the Borough that regulations be passed regulating parking at off-street parking facilities operated by the Parking Authority of the Borough. In the course of regulating parking at these facilities it is also essential and necessary that Parking Enforcement Officers be appointed for the purpose of issuing summonses pursuant to this Section to enforce parking regulations on off-street parking facilities operated by the Parking Authority of the Borough.

On properties owned or leased by the Parking Authority of the Borough upon which the Parking Authority of the Borough has installed parking meters requiring the payment of a fee for such parking privileges on the days and hours specified on the meters, failure to pay the prescribed fee for such parking privileges shall be a violation of this Section, subject to the penalties as provided herein.

The rate for off-street parking meters described in subsection 8-1.2A, shall be twenty-five ($.25) cents for every 30 minutes or part thereof. Parking at all off-street parking meters described in subsection 8-1.2A shall be free on Sundays.

Notwithstanding the provisions of subsection 8-1.2B, the Borough is hereby authorized to designate long-term meter and permit parking in lots described in subsection 8-1.2A and for lengths of time as may be determined appropriate by the Borough. The long-term meter and permit parking in lots described in subsection 8-1.2A shall be $40 per month, or $35 per month if purchased for a six month period. The Borough is further authorized to install signs and pavement markings for the purpose of designating long-term meter and permit parking spaces in the aforesaid lots. Parking in long-term meter and permit parking lots shall be free on Sundays.

Notwithstanding the provisions of subsections 8-1.2B and 8-1.2C, the Borough is hereby authorized to designate daily meter and permit parking in the Somerset/Pearl Street lot for lengths of time as may be determined appropriate by the Borough. The Borough is further authorized to install signs and pavement markings for the purpose of designating daily meter and permit parking spaces in the aforesaid lots. The daily rate for the Somerset/Pearl Street Lots shall be $5 per day. Parking in the Somerset/Pearl Street lot shall be free on Sundays.

On properties owned and/or leased by the Parking Authority of the Borough upon which the Parking Authority of the Borough has rented space on a monthly or other periodic basis for a prescribed fee and has issued stickers, decals or some other type of marking or designation to persons who are authorized to park in such designated space at the off-street parking facilities, parking in such space without a valid sticker, decal or other authorized marking or designation duly issued by the Parking Authority of the Borough shall constitute a violation of this Section. Any person who violates or fails to comply with any provision of this Section shall, upon conviction therefor, be liable to a fine not to exceed $10 together with court costs, or be imprisoned in the County Jail for a period not to exceed 10 days, for each offense.

This Chapter shall be enforced by the Police Department and by Parking Enforcement Officers with full power and authority:
a. 
To enforce on behalf of the Borough all applicable laws, ordinances and regulations respecting the parking of vehicles in on-street metered parking areas or off-street parking facilities owned and/or maintained by the Parking Authority of the Borough;
b. 
To issue summonses for violations of any provisions of the law, ordinances or regulations;
c. 
To serve and execute all processes with respect to any such violation issuing out of the court of a municipality; and
d. 
To cause any vehicle parked, stored or abandoned in violation of any provision of this Chapter to be towed away from the scene of such violation and to collect from the owner of the vehicle the cost of the towing and subsequent storage of the vehicle.

Any person who violates or fails to comply with any provision of this Section for which no other specific penalty is provided shall, upon conviction or guilty plea therefor, be liable to a fine not to exceed $25 together with court costs, or imprisonment in the County Jail for a period not to exceed 10 days for each offense.

Signs identifying this Section and the penalties for the violation thereof shall be placed upon all off-street parking facilities operated by the Parking Authority of the Borough that are subject to this Section.

a. 
The summons issued under this Chapter shall be in the form of "Uniform Traffic Ticket" or such other summonses as may be designated by the Director of the Motor Vehicle Commission of the State of New Jersey as the "Uniform Traffic Ticket."
b. 
The summons issued under this Chapter may be issued by means of an automated ticket system.

a. 
The Parking Authority of the Borough of North Plainfield shall receive from the Borough of North Plainfield a sum equal to 60% of the dollar amount of each summons written by the Parking Authority's parking enforcement officers for violations of the revised general ordinances of the Borough of North Plainfield and for violations of Title 39 of the Revised Statutes of the State of New Jersey for parking violations. Said sum shall be paid to the Parking Authority only for those parking violations where the applicable fine has been collected by the Borough of North Plainfield Municipal Court and paid to the Borough of North Plainfield.
b. 
The Parking Authority shall utilize the funds paid to the Parking Authority by the Borough of North Plainfield to carry out the Parking Authority's statutory purposes, including, but not limited to, the payment of salaries for parking enforcement officers; the purchase and repair of parking meters; and, the purchase and/or lease of property for parking facilities.

It shall be unlawful for any person to stop, stand or park a motor vehicle on the premises described in Schedule "A" annexed hereto and made a part hereof without first having obtained a permit therefor from the Department of Administration of the Borough.

The Department of Administration is hereby authorized to adopt rules and regulations providing for the issuance of parking permits to officers and employees of the Borough.

Beginning at a point on the northerly sideline of Race Street being N 47° 42' E a distance of 52.26' from the intersection of the easterly sideline of Somerset Street and the northerly sideline of Race Street thence running.
Along the sideline of Race Street N 47° 42' E a distance of 93.32' to a point and corner of Lot 11, thence running.
N. 41° 7' W a distance of 114.93' to a point and corner of Lot 11, thence running.
S 45° 37' W a distance of 80.51' to an angle point along the northerly property line thence running.
S 49° 24' W a distance of 13.03' thence running.
S 41° 12' E a distance of 112.64' to the point of beginning.

Except during a snow emergency as defined in Chapter 7, Traffic, it shall be unlawful for any person to stop, stand, or park a motor vehicle in the parking area or driveway of Lot 14, Block 131, as shown on the Tax Map of the Borough, unless such stopping, standing or parking is for the purpose of utilizing the facilities of the North Plainfield Memorial Library.

Any person violating any of the provisions of this Section shall be subject to a fine not to exceed $25.

The Council does hereby establish zones to be known as parking meter zones, in the following streets of the Borough:
a. 
Streets running north and south.
1. 
Somerset Street, from Greenbrook Bridge to Grandview Avenue, both sides.
2. 
Watchung Avenue from Manning Avenue to the Plainfield border, both sides.
b. 
Streets running east to west.
1. 
Craig Place, from Grove Street to Somerset Street, north side.
2. 
Pearl Street, from Somerset Street to Watchung Avenue, both sides.
3. 
The south side of Linden Avenue from Somerset Street to a point 150 feet west.
4. 
Harmony Street, between Somerset Street and Watchung Avenue from the designated loading zone west to Somerset Street, north side.
5. 
Chatham Street from Warren Street to Watchung Avenue, north side.
And hereafter, as traffic conditions require, in such other streets as may be designated by proper action of the Council.
And in the parking meter zones, the Council shall cause parking meters to be installed and shall cause parking meter spaces to be designed as hereinafter provided, and shall fix the time limitations for legal parking in such zones and the hours during the day or night when the parking meter or meters must be used and when the time limitations shall be effective in compliance with the provisions of this Section and of the ordinance or ordinances as hereinafter set forth; and shall indicate the time limitations by designating the same on the parking meter or meters and by appropriate signs posted in proximity to the meter or meters in the zones.
The time limitation for parking and the period during which parking limitations are effective, shall be as is provided in Chapter 7, Section 7-3, Parking; and parking time limit, in parking meter zones, shall coincide with Chapter 7, Section 7-3, Parking; and the installation of the parking meters on the above streets shall be subject to such exceptions as bus stops, taxicab stands and prohibited and restrictive parking areas as are designated by ordinance or regulations of the Council of this Borough and no parking meter shall be installed within any of the areas where parking is prohibited by Statute R.S. 39:4-138.

Authority is hereby given to provide for the installation, regulation, control, operation and use of the parking meters provided for in this Section, and to maintain meters in good workable condition and the Mayor and Borough Clerk are hereby invested with power and authority to enter into a contract after approval of the terms and conditions thereof by the Council of the Borough for the purchase and installation of parking meters, the payment of such parking meters and installation to be provided for solely from the receipts, funds, and revenues obtained from the operation of the parking meters, without in any manner obligating the Council of the Borough to pay for the same from any other source. And the Mayor and Borough Clerk are further authorized and empowered to enter into a contract or contracts, after approval of the terms and conditions thereof by the Council of the Borough for such protection and maintenance of the parking meters as may be necessary to maintain the same in good operating condition and to pay for such parts, protection and maintenance, exclusively from the receipts, funds, and revenues received from the operation of the parking meters.

Parking meters installed in the parking meter zones established as provided in subsection 8-4.1 of this Section shall be placed upon the curb immediately adjacent to the individual parking places hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by a proper legend the legal parking time established by the Borough and when operated shall indicate on or by its dial and pointer the duration of the period of legal parking, and on the expiration of such period, shall indicate illegal or over parking.

The Borough Engineer shall have lines or markings painted or placed upon the curb and/or upon the street adjacent to each parking meter for the purpose of designating the parking space for which the meter is to be used and each vehicle parked adjacent or next to any parking meter shall park within the lines or markings so established. It shall be unlawful and in violation of this Section to park any vehicle against any such line or markings or to park the vehicle in such position that the same shall not be entirely within the area so designated by such lines or markings.

When a parking space in any parking meter zone shall be parallel with the adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked so that the foremost part of such vehicle shall be nearest to the parking meter.

When any vehicle shall be parked in any space adjacent to which a parking meter is located in accordance with the provisions of this Section, the operator of the vehicle shall, upon entering the parking space, immediately deposit or cause to be deposited a coin or coins of the United States as designated on the parking meter and in accordance with the time designated thereon, and failure to deposit such coin or coins shall constitute a violation of this Section, and shall subject such person to the penalty prescribed in subsection 8-4.12. Upon the deposit of such coin or coins, and placing the meter in operation, the parking space may be lawfully occupied by such vehicle during the period of the parking time which has been prescribed for the part of the street in which the parking space is located. If such vehicle shall remain parked in any such parking space beyond the parking time fixed for such parking space, and the parking meter shall indicate such illegal parking, such vehicle shall be considered as parked overtime and beyond the period of legal parking time and the parking of a vehicle overtime or beyond the period of legal parking time in any such part of the street where any such meter is located shall be a violation of this Section and the operator thereof shall be subject to the penalty hereinabove prescribed.

The rate for on-street parking meters shall be twenty-five ($.25) cents for every 30 minutes or part thereof.

It shall be unlawful and a violation of the provisions of this Section for any person to cause, allow or permit any vehicle registered in the name of or operated by such person, to be parked for a period of time longer than that paid for, in accordance with the designation on the parking meter, or beyond the period of legal parking time established for any parking meter zone within any parking space.

It shall be unlawful and a violation of this Section for any person to deposit or cause to be deposited in a parking meter a second or other coin for the purpose of increasing or extending the parking time of any vehicle beyond that which has been established for the parking space adjacent to which the meter is placed.

It shall be unlawful and a violation of the provisions of this Section for any person to cause or permit a vehicle to be placed and remain in any parking space adjacent to any parking meter while such meter displays a signal indicating that the vehicle occupying the space has been parked beyond the period of time paid for or prescribed for such parking space.

It shall be unlawful and a violation of the provisions of this Section to deposit or cause to be deposited any slug, device or metallic substitute or any other substitute for a proper coin of the United States.

It shall be unlawful and a violation of the provisions of this Section for any person to efface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this Section.

Unless another penalty is expressly provided, every person convicted of or who pleads guilty to a violation of a provision of this Section or any supplement thereto shall be liable for a penalty of not less than $25 and not more than $50 or imprisonment for a term not exceeding 15 days or both.

The coins required to be deposited in the parking meters as provided herein are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets, and also the cost of supervising and regulating the parking of vehicles in the parking meter zones created hereby, and to cover the cost of purchases, supervision, protection, inspection, installation, operating, maintenance, control and use of the parking meters described herein, or the regulations of parking and provisions for other parking places as may be deemed necessary by proper action of the Council.
