The Health Officer, Public Officer, Enforcement Officer or his or her designee may direct the owner, operator or occupant of lands lying within the boundaries of the Borough to remove from such lands all brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, refuse, trash and debris within a period of time not to exceed 10 days.

Any person violating the provisions of subsection 11-10.1 shall be liable to penalty as provided in Chapter 1, Section 1-5.

It shall be the duty of the Chief of the Fire Department or his or her designee to cause notice to be given whenever it shall appear necessary and expedient to eliminate a fire hazard. It shall be the duty of the local Health Officer, Public Officer, Enforcement Officer or his or her designee to cause notice to be given whenever it appears necessary and expedient for the preservation of the public health or to eliminate an unsanitary or obnoxious condition.

Whenever the owner, operator or occupant cannot be served personally, within the Borough, with notice of a violation of subsection 11-10.1, then in that event, the officer causing the notice to be given may cause the notice to be mailed to such owner, operator or occupant, at their last known address. When notice is given by mail, then such owner, operator or occupant shall have five days from the day of mailing of the notice within which to remove the condition proscribed in subsection 11-10.1 of this section.

Whenever the owner, operator or occupant of lands within the boundaries of the Borough shall refuse or neglect to remove from such lands, all brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, refuse, trash and debris within the time provided by this section, such brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris may be removed by or under the direction of the local Health Officer, Public Officer or Enforcement Officer, and if a fire hazard, may be removed by or under the direction of the Chief of the Fire Department; and if both health and fire hazard are involved, then by or under the direction of both or either.

In all cases where brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris are removed from any lands under this Section by or under the direction of the officer or officers specified in subsection 11-10.5, such officer or officers, as the case may be, shall certify the cost thereof to the Council of this Borough, which shall examine the certificate, and if found correct, shall cause the cost as shown thereon to be charged against the lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.
The provisions of this subsection and subsection 11-10.5 shall be in addition to the penalty provided by Chapter 1, Section 1-5.
