There shall be a Board of Health Advisory Committee in the Borough consisting of seven members appointed by the Mayor, with the advice and consent of the Borough Council, for a term of three years, staggered by reason of original appointment. Appointments to fill vacancies shall be made in the same manner as original appointments and all such appointments shall be for the unexpired term only.

The purpose of this section is to foster the openness of government and provide citizens with information concerning the various appointed municipal positions which exist within the Borough of Matawan. The section further provides for a procedure whereby a citizen can indicate his or her desire to serve in a particular appointed position. The section also provides for a notification process so that those citizens who have indicated a desire to hold a position will be notified when that position is under consideration for appointment and will ultimately be notified as to the action that was taken. Finally, the section provides a means for determining vacancies for unexcused absences.

The following terms as used in this section shall have the meaning set forth below unless the context within which the term is used clearly provides for a different meaning:
APPOINTED MUNICIPAL POSITION
Shall mean any appointed position within the Borough government, which is created either by statutory law or by ordinance or resolution. Examples of such positions are Borough Historian, member of any board, commission, agency, council or committee of the municipality.
APPOINTING AUTHORITY
Shall mean the official or body which by virtue of statutory law or by ordinance or resolution is given the authority to appoint a person to hold a particular appointed municipal position.

The Borough Clerk shall cause a Register of Appointed Municipal Positions to be prepared and maintained. Such register shall be made available on the Borough's website and at the Borough Hall and shall set forth at least the following:
a. 
Title of each appointed municipal position;
b. 
Brief description of the positions' powers and duties;
c. 
Any special credentials or qualifications required to hold the position;
d. 
The length of term for the position;
e. 
The name of the person currently holding the position, the expiration date of his or her term, and the number of vacant seats on the Board or Commission;
f. 
The dates/times and frequency of any meetings which the holder of the position must attend; and
g. 
The Appointing Authority for each board or commission, and who confirms each appointment.

The Borough Clerk shall maintain a current updated listing of all existing vacancies for each appointed municipal position within the municipality. Such list shall be made available free of charge at the Municipal Clerk's Office and shall, in addition, be posted by the Municipal Clerk on a bulletin board maintained for public announcements in the Municipal Building and on the Borough's website.

Unless essential for the proper functioning and/or carrying on of business of the local agency upon which the vacancy has occurred, a vacancy shall not be filled for a period of 30 days from its posting in order to allow interested persons time to submit applications as provided in 2-31.6 below.

The Borough Clerk shall maintain an application form to be completed by any person interested in serving in an appointed municipal position. Such application shall, at a minimum, contain the following information: (This form is on file in the office of the Borough Clerk.)
a. 
Name;
b. 
Address;
c. 
Telephone number;
d. 
Email address;
e. 
Appointed municipal position(s) sought;
f. 
Qualifications/experience for position(s);
g. 
List of boards and commissions for applicant to indicate desired boards and commissions to serve on; and
h. 
Signature.

An Application for Citizen Service filed for appointment to an appointed municipal position shall be deemed a public record. A person applying shall have their street address, telephone number and email kept confidential.

Any person interested in serving in an appointed municipal position may file an application for such position with the Borough Clerk. Such application(s) may be filed at any time, whether or not the appointed municipal position sought is vacant. A person may withdraw his or her application at any time.

The Borough Clerk shall maintain all filed applications in a file or binder, segregated for each board or commission.

Prior to filling any appointed municipal position, the appropriate Appointing Authority shall review each application filed for that position. Each person having submitted an application for an appointed municipal position under consideration to be filled shall be notified of said vacancy. The Appointing Authority shall conduct such review, investigation and/or interviews as the Appointing Authority deems necessary or advisable, in its discretion. After a decision is reached to fill a vacant appointed municipal position, all those who had submitted an application for that position shall be notified of the appointing decision.

A vacancy shall be determined to exist on a Borough board, committee, commission, authority or other applicable municipal agency, whenever a member without being excused by a majority of the authorized members of such body, fails to attend and participate at meetings of such body for a period of three consecutive regular meetings or six consecutive weeks, whichever is longer.
The applicable body upon which a vacancy has been determined to have occurred shall notify the Appointing Authority in writing of such determination; provided, however, that such vacancy is not due to a legitimate illness.
Whenever a vacancy shall be deemed to have occurred pursuant to the reasons set forth under N.J.S.A. 40A:9-12.1 or pursuant to the terms of this section, the Appointing Authority shall forthwith fill the office for the unexpired term in the manner prescribed by law, ordinance or resolution.

A Shade Tree Commission is established for the purpose of regulating, planting, care and control of shade and ornamental trees and shrubbery upon and in the streets, highways, public places, parks and parkways of the Borough, except State highways unless the State Highway Department assents thereto, and except County highways, parks and parkways unless a County Shade Tree Commission is operative and gives assent thereto. The Commission members shall be residents of the Borough and serve without compensation except as hereinafter provided.

The Shade Tree Commission shall consist of five members appointed by the Mayor for a term of five years, except that those first appointed shall be on a staggered basis. All appointments, except those to fill vacancies, shall be effective January 1 next succeeding the appointment. Any vacancy occurring by reason of the death, resignation or removal of any Commissioner shall be filled for the unexpired term by the Mayor.

The Commission shall organize annually by the election of one of its members as Chairman, and the appointment of a Secretary, who need not be a member.

The Shade Tree Commission shall have the power to:
a. 
Recommend that the Mayor and Council adopt such ordinances and written rules and regulations as may be necessary, pursuant to statute, and for the proper interpretation of this section, administration and enforcement, provided that the ordinances and regulations do not conflict with this section and conform to the general standards.
b. 
Exercise full and exclusive control over the regulation, planting and care of shade and ornamental trees and shrubbery now located, or which may hereafter be planted, in any public highway, park or parkway, except such as are excluded pursuant to subsection 2-32.1, including the planting, trimming, spraying, care and protection thereof.
c. 
Regulate and control the use of the ground surrounding the same, so far as may be necessary for their proper growth, care and protection.
d. 
Move or require the removal of any tree, or part thereof, dangerous to public safety.
e. 
Care for and control such parks and parkways; encourage arboriculture; make, alter, amend, and repeal, in the manner prescribed for the passage, alteration, amendment and repeal of ordinances by the Borough Council, any and all ordinances necessary or proper for carrying out the provisions hereof.
f. 
Administer treatment to or remove any tree situated upon private property which is believed to harbor a disease or insects readily communicable to neighboring healthy trees in the care of the Borough and enter upon private property for that purpose, with the consent of the owner, provided the suspected condition is first confirmed by certificate issued by or on behalf of the New Jersey Department of Agriculture.
g. 
Undertake a review and approval of all applications submitted under the provisions of Chapter 24 for the Protection of Trees.
h. 
The Commission may adopt a written protocol whereby one of its members may be delegated to review and approve the application for tree removal for application of a minor event involving no more than five trees.

Except as hereinafter provided, the initial cost of all trees planted by the Commission, the cost of planting the same, the cost of the posts and boxes or guards used for their protection, and the cost of the removal of any tree or part thereof dangerous to public safety shall, if the Commission so determines, in accordance with rules and regulations for that purpose, be a charge upon the real estate in front of which the tree shall be planted or removed as an improvement. The cost, if it is so determined that it is to be paid by the owner shall, unless paid directly to the Commission, be certified to the Collector of Taxes and shall thereupon be a lien upon the real estate, and shall be included in the next tax bill rendered to the owner and collected in the same manner as other taxes against the property.
The provisions of this section shall not apply to a planting to replace a tree planted by the Commission or a planting in connection with Arbor Day exercises or other educational demonstration.

In every case where the owner will be charged with the cost of planting any shade tree, the Commission shall give notice of the meeting at which it is proposed to consider the planting by publishing the notice at least once, not less than 20 days before the meeting, in a newspaper circulating in the Borough, or by personal service of a copy of the notice upon the abutting owner at least 10 days before the meeting. The notice shall specify the street or portions thereof, on which the planting is proposed and require all persons who may object to present their objections in writing at the office of the Commission at or before the meeting. Before final action is taken, all objections so filed shall be considered. The Commission shall give reasonable notice of its intention to remove, or cause the removal of a tree or part of a tree dangerous to public safety, unless public safety requires immediate removal, in which case no notice shall be necessary.

No Statute giving any person, State, County or municipal board, body or official, power or authority to lay sidewalk along or to open, construct, curb or pave any street, or to do any similar act, shall be construed to permit or authorize any interference with or injury to a highway shade tree without the consent of the Shade Tree Commission within whose jurisdiction the tree is located. In all cases, the Commission shall reasonably cooperate with the person, board, body or official for the general public good.
Nothing in this section shall be held to take away or diminish any of the powers or authority of any County Park Commission over the trees or shrubbery in any County park or parkway within its jurisdiction, or to give any other commission or board any power or authority with respect to such trees or shrubbery.

During the month of December in each year, the Shade Tree Commission shall certify to the Council the estimated sum necessary for the proper conduct of its work during the ensuing fiscal year, which shall include the sums estimated to be expended for such of the following items as it is anticipated expenditure will be made:
a. 
Payment of wages and salaries of employees;
b. 
Expenses of Commission members in discharging official duties, including expenses incident to attendance at professional meetings;
c. 
Purchase of trees and shrubbery; and
d. 
Purchase of necessary equipment and materials and the cost of services for the prudent promotion of the work;
The Council shall annually appropriate such sum as it may deem necessary for the purposes.

There is established an Environmental Commission which shall consist of seven members who shall be appointed by the Mayor for a term of three years, except that those first appointed shall be on a staggered basis. All members of the Commission shall be residents of the Borough and one member shall be a member of the Planning Board. All appointments to fill vacancies shall be for the unexpired term only. Members of the Commission shall serve without pay.

The Mayor shall appoint one member of the Commission to serve as Chairman and Presiding Officer.

The Commission is established for the protection, development and use of natural resources, including water resources located within the Borough.

A vacancy occurring other than by expiration of a term shall be filled for the unexpired term only. The Mayor or Borough Council may remove any member of the Commission for cause, on written charges served upon the member and after a hearing thereon at which the member shall be entitled to be heard in person or by counsel.

The Commission shall have the following powers and duties:
a. 
Subject to the prior approval of the Unified Planning Board and Council, the Commission may acquire property, both real and personal, in the name of the Borough, by gift, purchase, grant, bequest, devise or lease, for any of the purposes of the Commission and it shall administer the same for such easement (including conservation easement), covenant or other contractual right (including a conveyance on conditions) as may be necessary to acquire, maintain, improve, protect, limit the future use of, or otherwise conserve and properly utilize open spaces and other land and water areas in the Borough.
b. 
Conduct research into the use and possible use of the open land areas of the Borough.
c. 
To advertise, prepare, print and distribute books, maps, charts, plans and pamphlets, which in its judgment it deems necessary for its purposes, within the limits of funds appropriated to the Commission.
d. 
To coordinate the activities of unofficial bodies organized for similar purposes.
e. 
Keep an index of all open areas, publicly and privately owned, including open marsh lands, swamps, and other wetlands, and to obtain information on the proper use of such areas.
f. 
Recommend from time to time to the Unified Planning Board, plans and programs for inclusion in the Master Plan of the Borough for development and use of such areas.
g. 
To do such other acts and things as are reasonably related to and designed to carry out the purposes and objectives of the Commission, including without limitation, the appointment and payment of such clerks and other employees of the Commission which may be required within the limits of the funds appropriated to the Commission.
h. 
Keep records of the meetings and activities of the Commission and make an annual report to the Borough Council.

The Environmental Commission may, by majority vote, invite participation by associate members of at least five associate members of the Commission, who will be appointed by the Commission for a term of one year as associate members. The associate members shall be residents of the Borough of Matawan. Associate members shall serve without compensation. Associate members shall, as much as possible, consist of educators, students; representative of environmental organizations, historians, scientists, and business representatives. Associate members may participate in all of the deliberations of the Commission, but shall not be voting members of the Commission and shall not represent the Commission before Mayor and Council or before any other public body. Associate members may participate in all of the proceeding of the Environmental Commission. Their terms as associate members are from January 1 to December 31 of the year of their appointment. The Environmental Commission reserves the exclusive right to not reappoint any associate members. A majority vote of the members of the Environmental Commission, shall at the organization meeting of the Commission in January of any year, confirm the appointment of associate members at the reorganization meeting. The appointment of associate members to the Environmental Commission shall follow the appointment and reorganization of members of the Environmental Commission.

There is established a Commission to be known and designated as the Borough of Matawan Economic Development, Business and Redevelopment Commission (EBD); the members of which shall be appointed by the Mayor and approved by the Council.

a. 
The Commission shall consist of nine members, one of whom shall be the Mayor or his designee; two shall be members of the Borough Council appointed by the Mayor on the recommendation of the Council; one shall be a member of the Unified Planning Board; three shall be residents of the Borough of Matawan; and two members of the Matawan business community.
b. 
The terms of the Mayor and the members of the Council shall correspond with their respective official tenures, the terms of the remaining member shall be for three years each, staggered by reason of original appointments. For purposes of appointment, the Governing Body shall specify the initial terms of the members of the Commission initially appointed.
c. 
The terms of the Council members shall be on an annual basis, with the appointments made by the Mayor on the recommendation of the Council.
d. 
The members of the Commission shall serve without compensation.
e. 
The Commission shall elect a Chairman from among its members on an annual basis, which Chairman shall be a member of the Governing Body of the Borough of Matawan.
f. 
The terms of all members of the Commission shall commence on January 1 of the year of appointment.

The duties of the Commission shall be as follows:
a. 
To serve as the liaison between the Borough of Matawan and existing and proposed businesses to improve communications as well as discuss issues of mutual relevance and address any mutual concerns as it concerns the well-being, commercial vitality, business presence, as well as redevelopment issues in the Borough of Matawan.
b. 
To analyze the several and various business communities in the Borough of Matawan with a view of ascertaining and also enhancing the types of businesses best suited to the economic and commercial improvements of the Borough of Matawan and also to advance and provide for redevelopment opportunities for the individuals and businesses in the Borough of Matawan.
c. 
To promote and advance economic opportunities, tax incentives for business districts as well as make recommendations concerning commercial uses to be considered as technology advances in the commercial and development arena and for enhancement of the streetscape of the Borough of Matawan.
d. 
To encourage expansion and enhancement of existing businesses to the best interest of the Borough of Matawan and its residents; and to coordinate the interrelationship of the various business districts.
e. 
To prepare, develop and distribute any and all types of communications medium to attract and assist in companies and individuals wishing to engage in redevelopment opportunities and locate or enhance existing or new business in the Borough of Matawan.

The Commission shall receive from all officials and all authorized boards, departments of the Borough of Matawan, all information that a fully functioning agency of the Borough of Matawan receives as well as notifications of any hearings of any Unified Planning Board Applications or request for zoning changes; inquiries for business opportunities that wish to relocate in the Borough of Matawan that are filed with the Clerk; and, will also receive any such additional assistance as may be required in the performance of its duties. The Commission shall also be given to all public municipal records and information which may assist the Commission and its mandated duties.

There is established a Commission to be known and designated as the Borough of Matawan Sports Commission, the members of which shall be appointed by the Mayor and approved by the Council.

a. 
The Commission shall consist of seven members nominated and appointed by the Mayor with consent of Council.
b. 
The terms of the Commission members shall be for one year, with the appointments made by the Mayor with the consent of Council.
c. 
The members of the Commission shall serve without compensation.
d. 
The Commission shall elect a Chairperson from among its members on an annual basis, which Chairperson shall not be a member of the Governing Body of the Borough of Matawan.
e. 
The terms of all members of the Commission shall commence on January 1 of the year of appointment, and terminate on December 31st of the same year; or until a successor is appointed.

The duties of the Commission shall be as follows:
a. 
To serve as the liaison between the Borough of Matawan and various citizen and sporting groups and other organizations who wish to foster sports activities and programs in Matawan.
b. 
To develop and enhance the use of sports facilities and assist the Borough in management and organization of the programs at such facilities.
c. 
To promote and advance the use of our facilities for the general public.
d. 
To prepare, develop and distribute any and all types of communications medium to attract and assist residents wishing to engage in sports activities in the Borough of Matawan.

The Commission shall receive from all officials and all authorized boards, departments of the Borough of Matawan, all information that a fully functioning agency of the Borough of Matawan receives as well as notifications of any hearings of the Unified Planning Board Applications or request for zoning changes; and, will also receive any such additional assistance as may be required in the performance of its duties. The Commission shall also be given access to all public municipal records and information which may assist the Commission in its mandated duties.

The recommendations of the Commission shall be communicated on a monthly basis to the Clerk who shall forward same to the Governing Body. Actions of the Commission may be reviewed and amended by the Governing Body which reserves the final authority on the use of public facilities.

There is hereby established a Recreation Commission which shall consist of three members of the Matawan Borough Council. One member shall be appointed by the Mayor as Recreation Commissioner and two members of the Council shall be appointed by the Mayor as Commission members. Said appointments shall be made on January 1 of each year and shall terminate on December 31 of each year.

The Recreation Commission shall meet at least twice a year, which schedule of meetings shall be established by the Commissioner. The Commission shall have the power to adopt the bylaws and rules and regulations for the proper conduct of public recreation in and for the Borough.

The Commission shall have full control over the activities conducted at public playgrounds, indoor recreation centers and other recreation areas and facilities on any of the properties owned or controlled by the Borough or on other properties where the consent of the owners is first secured. The Recreation Commission shall have the power to sponsor and conduct any form of general recreation and activity that will employ the leisure time of the people in a constructive and wholesome manner. The Commission will advise the Council as to the acquisition of additional recreational facilities, and their development, but the final determination for capital projects shall be the Council's responsibility.

The Recreation Commissioner shall be the liaison between the Matawan Borough Council and the other Recreation Commission members, the Director of Recreation and the delegates. The Recreation Commissioner shall act as liaison with all parties, organizations and commissions to ensure maximization of general recreation and related activities and shall report to the Recreation Commission regarding said activities. The Recreation Commission shall have the final authority and control over activities regarding general recreation related activities, as well as public playgrounds, indoor recreation centers and other recreation areas and facilities.

The Mayor, with confirmation of Council, shall have the power to appoint a Director of Public Recreation. The Director of Public Recreation shall be trained and qualified for the work of planning and directing public recreation. The Director of Public Recreation shall be responsible for the daily operations of public recreation within the Borough of Matawan and any affiliated programs. The Director of Public Recreation shall be responsible to and act under the direction of the Recreation Commission. The Director of Public Recreation shall assist the Recreation Commission in performance of its duties and establishment and administration of its budget. The Director shall be assisted by the Delegates to perform all recreational programs.

a. 
The Director of Public Recreation shall make an annual report to the Mayor and Council which shall include a report on the activities carried on by the Commission and a financial report. The Director of Public Recreation shall make supplementary reports at any time he/she is requested to do so by the Mayor and Council.
b. 
The Director of Public Recreation shall annually prepare and submit a budget to the Mayor and Council for consideration and approval. The items as approved shall be included in the municipal budget. The Director of Public Recreation shall be responsible for the expenditures and shall refrain from over expending any line item classification as contained in its budget submission by 20% or more, without prior Council approval for such expenditure.

The Commission and/or the Director of Public Recreation are expressly granted the right to receive gifts or bequests of money or other personal property. Such gifts or bequests, if not otherwise limited by the donor, may be used by the Commission for any of the activities carried on by the Commission pursuant to this section.

a. 
Establishment. There is hereby created the Recreation Delegates of the Borough of Matawan, which shall serve in accordance with the provisions of this section.
b. 
Membership; Terms; Alternates; Compensation. The Recreation Delegates shall consist of seven members and two alternates appointed by the Mayor with the consent of the Council. Each member shall serve for a term of five years, and the members first appointed shall be appointed for terms of one, two, three, and four years respectively, in such manner that the term of at least three members shall expire in each year. After the initial appointments of the seven members and at the end of the first year and each successive year, all appointments shall be for terms of five years, and, if vacancies occur, said vacancies shall be filled for the unexpired terms only. The alternate members shall be appointed each year and shall serve one-year terms. The members shall serve until their respective successors are appointed. The members shall receive no compensation for their services. All members shall be residents of the Borough of Matawan. All members shall comply with any regulatory mandates that are propagated by the State, County of regional authority that deals with composition of membership and ability to serve.
c. 
Elected Officers. The members of the Recreation Delegates shall elect annually, from among their number, a Chairman and a Vice Chairman, Treasurer and Secretary. The elected officers shall serve for terms of one year and shall be eligible for reelection in successive years.
d. 
Advisement; Responsibility to Implement Programs. The Recreation Delegates shall advise the Director of Public Recreation concerning recreation and the use of parks and other designated areas for recreational purposes. It shall be the responsibility of the Director of Public Recreation to ensure the implementation of recreation programs recommended through the Recreation Delegates.
e. 
Powers and Duties. The Recreation Delegates shall under the Director of Public Recreation:
1. 
Act in advisory capacity to the Director of Public Recreation in all matters pertaining to the utilization of parks and recreation programs and recreational areas for the implementation of the recreational programs.
2. 
Act in an advisory capacity to the Director of Public Recreation in the annual budget process as it applies to recreation programs and make recommendations with respect to the Director of Public Recreation for submission to the Mayor and Council.
3. 
Advise the Director of Public Recreation in the planning of parks and recreation programs therein for the users of said parks and recreation programs and promote and stimulate public interest and, to that end, solicit to the fullest extent possible the cooperation of school authorities and other public and private agencies interested therein.
4. 
Make recommendations of policies to Director of Public Recreation for the acquisition, development and improvement of parks and playgrounds.
5. 
Make recommendations to the Director of Public Recreation fees for participation in Borough of Matawan sponsored recreation activities for both Borough residents and nonresidents.
6. 
Make recommendations with the Director of Public Recreation on staffing needs for the implementation of the parks and recreation programs.
7. 
Make recommendations to the Director of Public Recreation on matters pertaining to all lands, playgrounds, and recreation places owned or leased by the Borough. Make recommendations to the Director of Public Recreation on appropriate rules, regulations and bylaws for the use of said facilities.
f. 
Functions; Responsibilities. The Recreation Delegates shall also perform the following functions:
1. 
Help interpret the recreational needs and desires of the community.

Continually study and evaluate the programs existing in the community.

Disseminate public information to the community regarding historical legacy and traditions of the Borough of Matawan.

Engage in public information to the community regarding the benefits of participation in the various programs offered and the values to be derived from participation in those memberships as well as recruit volunteer leadership and participation.

A Historical Sites Commission is established to preserve historical sites and recommend the acquisition of future sites to be preserved.

The Commission shall consist of seven persons, residents of the Borough, to be appointed as follows:
a. 
Three members to be selected by the Mayor with the advice and consent of the Council;
b. 
Three members to be nominated by the Matawan Borough Historical Society, and appointed by the Mayor with the advice and consent of the Council; and
c. 
One member of the Borough Council to be appointed by the Mayor. Each selected member except the Council member shall serve for a term of three years.
d. 
The Council member shall serve for a term consistent with his term of office on the Borough Council.
All appointments except initial appointments and those to fill vacancy, shall be effective January 1, next succeeding the appointment. Any vacancy occurring shall be filled for the unexpired term by the nomination of a replacement by the appropriate selecting body depending upon the category of the vacant Commissioner.

The Commission shall organize immediately upon its appointments. The Commission shall have monthly meetings, as may be determined by the Commission. The Chairman, Secretary and Treasurer of the Commission shall be elected by the members of the Commission at its organization meeting each year.

The Secretary of the Commission shall submit quarterly reports in writing to the Borough Clerk.

The members of the Historical Sites Commission shall serve without compensation.

The powers and duties vested in the Commission are hereby defined and designated as follows:
a. 
Provide for the maintenance, operation, use, management, regulation, control and supervision of all historical sites designated by the Borough Council;
b. 
Make recommendations to the Borough Council for the acquisition of historical sites;
c. 
Adopt and promulgate rules and regulations for the use of historical sites;
d. 
Submit a recommended budget in December of each year for the costs and expenses of the Commission; and
e. 
With a prior approval of the Borough Council, designate the use of such historical sites and recommendations for any changes in use.

A Safety Committee of the Borough is hereby established. The members of the Safety Committee, with the exception of the Public Safety Commissioner, shall be appointed by the Mayor with the consent of the Council.

The Committee shall be composed of the following persons:
Public Works representative.
Water Department representative.
Public Safety Committee Commissioner.
Member at Large - Borough resident.

The purpose of the Safety Committee is to promote safety in the municipal workplace and upon publicly owned and operated land improvements and infrastructure.

A Special Events Committee is herewith established to consist of the Borough Administrator; Borough Clerk or her designee; Police Chief or his designee; Fire Chief or his designee; First Aid Captain or his designee; Director of Public Works or his designee; a representative of the Health Department; a representative from the Borough Council assigned as liaison by the Mayor on an annual term which appointment is made on the date of the annual Reorganization Meeting of Mayor and Council in January; the Director of Recreation or her designee; and a member or the general public who shall be a resident of the Borough of Matawan, appointed to an annual term by Mayor on the date of the annual Reorganization of Council in January. All Committee members shall serve without compensation. Other than the citizen member of the Committee, all other Committee members are ex officio members for the duration of their office unless relieved by a majority vote by members of the Borough Council. All Committee members are accorded one vote on any given issue. Committee members shall, at their first meeting in any calendar year elect a Chair and Vice Chair from their members who shall preside over the meetings of the Committee. The term of the Chair and Vice Chair shall be for one year.

a. 
Requests to Mayor and Council for the use of parks, playgrounds, public streets, public facilities, plazas, municipal facilities by any individual or group shall be referred to the Special Events Committee for review by the Committee on issues concerning the feasibility of the request and conditions that may be attached to any approval that concern health, safety and well being of the residents of the Borough of Matawan. The Committee may consider the costs to the municipality of the undertaking of the event by any police, fire, first aid, public works or administrative cost to the residents of Matawan and may condition its recommendation of approval of the event by Mayor and Council subject to any reasonable conditions that must be met by the applicant and the payment of the public costs that would be incurred by agencies and departments of the Borough of Matawan for the orderly undertaking of the event.
b. 
Final Authority. Notwithstanding anything contained in this section, Mayor and Council reserve the final authority to accept or reject the recommendations of the Committee and reserve unto itself the ability by majority vote of Council to rule on any request without referral to the Special Events Committee.
c. 
Exemptions. Borough Agencies or Departments who are the sponsors of any public event may request permission for the use of facilities and the scheduling of events directly to Mayor and Council but the Mayor and Council may refer the request to review by the Special Events Committee to coordinate planning for the event.

Any adverse decision of the Special Events Committee or any conditions attached to the approval of an event may be appealed by any applicant to the Mayor and Council.

Mayor and Council reserve the right to reject by majority vote of Council any approval granted by the Special Events Committee when it is determined that it is not in the best interests of the residents of the Borough of Matawan and the event impacts on the public health, safety and well being of the residents of Matawan.

The Special Events Committee shall prepare an application form that shall be submitted by any applicant seeking permission for a public event or the use of public facilities.

Nothing contained in the within section shall apply to any request for the use of the Matawan Community Center, which is regulated under a separate Ordinance.

The Borough Clerk or her designee shall be appointed the secretary of the Special Events Committee and is delegated with the recording and maintenance of the minutes of the deliberations and actions of the Special Events Committee.

A Disability Accessibility Committee to ensure for continued compliance with the Americans with Disabilities Act (ADA) for all Borough public buildings and properties, and to make recommendations on any various policies, issues, needs and future of said buildings, properties and projects.

One representative from the Public Works Department to be selected by the Mayor with the advice and consent of the Council, shall serve for a term of one year;
b. 
One representative from the Construction Department to be selected by the Mayor with the advice and consent of the Council, shall serve for a term of one year;
c. 
One representative-at-large to be selected by the Mayor with the advice and consent of the Council, shall serve for a term of three years;
d. 
Two members of the Borough Council to be appointed by the Mayor, shall serve for a term of one year; preferably an individual with sensitivity to disability related issues.
All appointments except initial appointments and those to fill vacancy shall be effective January 1, next succeeding the appointment. Any vacancy occurring shall be filled for the unexpired term by the nomination of a replacement by the Mayor.

The Committee shall organize annually by the election of one of its members as Chairman, and the appointment of a Secretary, who need not be a member.
b. 
The Disability Accessibility Committee shall meet the second Monday in January for their reorganization and at such time will set dates for their quarterly meetings.
c. 
The meeting dates shall be advertised in a newspaper recognized by the Borough and the meetings shall be open to the public.

The Committee shall, when appropriate, recommend policies and procedures to implement the intent and municipal obligations of the ADA; and shall, once yearly issue a report of its activities and its proceedings to the Mayor and Council.

a. 
Established. It is hereby established in the Borough a volunteer CERT.
b. 
Membership. The CERT shall consist of up to 50 members, all of whom shall be under the supervision, and respond to the direction of, the Borough's Emergency Management Coordinator.
c. 
Appointment; Term of Office; Qualifications. Members of the CERT shall be appointed by the Borough Council and shall serve terms of one year. CERT members shall be at least 18 years of age and shall undergo mandatory training in areas such as disaster preparedness, disaster fire suppression, disaster medical operations, light search and rescue operations, disaster psychology and team organization, and anti-terrorism. Such training shall be organized by the Borough and in accordance with the curriculum established by the Federal Emergency Management Agency (FEMA).
d. 
On-Going Training. CERT members serving multiple terms shall be required to undergo continuing training as required by the Borough.

The Mayor and Council of the Borough of Matawan herewith create an Animal Welfare Advisory Committee (hereinafter, "the Committee") to be composed of three members appointed by the Mayor on an annual basis beginning January 1, 2016, which appointments shall be for a one-year period, subject to confirmation by the Council of the Borough of Matawan. The members shall serve until successors are qualified if no appointment is made on the anniversary of that member's appointment.

The members of the Committee shall not be employees of the Borough of Matawan and shall be unpaid, and the members shall not be able to receive any consideration or remuneration other than membership in the Committee.

The Committee shall meet on an as-needed basis and shall provide reports to the Mayor and Council by May 31 and September 31 of every year concerning its activities and shall make regular recommendations to the Mayor and Council concerning issues involving animal welfare and shall be afforded opportunities for the dissemination of information on the Borough's website concerning animal welfare issues as they arise, subject to the approval of the chief administrative office of the Borough of Matawan.

The Committee shall not have any rights, duties, or obligations that are specifically delegated by law to enforcement agencies of the State, County, or Municipality concerning animal cruelty issues of any type.
