A. 
The purpose of the City Center Zoning District is to further the goals and objectives of the Olivette 2006 Strategic Plan.
B. 
The City Center Zoning District is intended to:
1. 
Create a city center consistent with the concepts and key revitalization elements of the 2006 Strategic Plan.
2. 
Create a walkable community center with pedestrian and streetscape improvements.
3. 
Develop new horizontal mixed-use buildings with higher density and presence at Olive Boulevard and Dielman Road to provide community as well as business and personal services.
4. 
Develop new continuous street grid to improve access to and throughout City Center area.

Eligible development areas within eight hundred (800) feet of Olive Boulevard, between Dielman Road on the east to Indian Meadows Drive to the west.

A. 
Minimum land area of forty thousand (40,000) square feet or existing lot of record.
B. 
Any petition to develop property shall identify, for each lot within the Development Area:
1. 
All owner(s) of record;
2. 
All owner(s) under contract;
3. 
The authorized representative of all owner(s) of record or owner(s) under contract; and
4. 
If an applicant has been named as a developer of one (1) or more lots pursuant to a plan approved by the City Council, the ordinance or resolution number granting such authority.

A. 
The following dimensional standards shall apply to the overall development area as identified during review.
1. 
Height.
a. 
Minimum: two (2) stories.
b. 
Maximum: five (5) stories not to exceed seventy (70) feet.
Through the procedures outlined in Article XI, Site Plan Review, of this Chapter, the Commission may authorize buildings less than two (2) stories, maintaining a height no less than fifteen (15) feet.
2. 
Floor Area.
a. 
Maximum: none.
b. 
However:
(1) 
Twenty-five hundredths (0.25) to fifty hundredths (0.50): site plan review.
(2) 
Less than twenty-five hundredths (0.25): special permit use.
3. 
Setbacks.
a. 
Front Yard Setbacks.
(1) 
Olive Boulevard: minimum ten (10) feet.
(2) 
Other streets: minimum ten (10) feet.
b. 
Side and rear yard: none.
4. 
Transitional Yard. Where the side or rear lot line directly abuts a side or rear lot line in an adjacent residential zoning district ("SR," "AR" or "PRO" with residential use), then a transitional yard in accordance with Section 428.260, being part of Article II, Site Planning, of Chapter 428, Community Design — Olive Boulevard Corridor, shall be provided.

A. 
Multi-story structures consisting of the following land use mix:
1. 
Ground Level.
a. 
Land uses as identified under Table A: Authorized Uses, being part of Article III, "COR" Commercial/Office/Retail unless noted as follows:
(1) 
Retail trade (Sector 44-45) under, except 447, Gasoline stations.
(2) 
Outdoor retail display areas not exceeding five thousand (5,000) square feet.
(3) 
Motion-picture theaters (Sector 51-512131).
(4) 
Accommodations and food services (Sector 72), except the following would be considered permitted uses:
(a) 
Full-service restaurants in excess of two thousand five hundred (2,500) square feet but not exceeding five thousand (5,000) square feet (72221).
(b) 
Limited-service restaurants, without a drive-through service, in excess of one thousand eight hundred (1,800) square feet but not exceeding three thousand five hundred (3,500) square feet (72222).
(c) 
Outdoor dining areas.
b. 
The combined floor area of the following uses not exceeding fifty percent (50%) of the ground-floor floor area:
(1) 
Finance (Sector 52).
(2) 
Real estate and rental leasing, except 53113 Lessors of mini-warehouses and self-storage units.
(3) 
Professional, scientific, and technical services (Sector 54).
(4) 
Management of companies and enterprises (Sector 55).
(5) 
Administrative and support and waste management and remediation services (Sector 56).
(6) 
Educational services (Sector 61).
(7) 
Health care and social assistance (Sector 62).
(8) 
Arts, entertainment, and recreation (Sector 71).
(9) 
Other services (except public administration) (Sector 81).
2. 
Upper Level.
a. 
Any of the permitted uses authorized on the ground level.
b. 
Multi-family residential and lodging services.
c. 
General offices and medical services.
B. 
Site Plan Review.
1. 
Multi-story residential structures.
2. 
Single-story structures.
3. 
Outdoor garden centers less than ten thousand (10,000) square feet directly adjacent to a "CC" conforming indoor garden center business two thousand five hundred (2,500) square feet or greater.
C. 
Special Permit.
1. 
Standalone dining establishments.
2. 
Drive-throughs.
3. 
Dining establishments exceeding the parameters noted above.
