This article shall be known as the "Mifflin County Bridge Replacement and Rehabilitation Program Ordinance."
This article is ordained and enacted pursuant to the provisions of the Second-Class Township Code, as amended and reenacted, 53 P.S. § 65101 et seq., and the Pennsylvania Intergovernmental Cooperation Law, as amended, 53 Pa.C.S.A. § 2301 et seq., and otherwise per law.
The Township of Derry (Township) hereby approves the form and content of that "cooperation agreement for bridge replacement and rehabilitation" between the Township and Mifflin County, Pennsylvania, said cooperation agreement being attached hereto and incorporated herein as Addendum A.[1]

As required by § 2307 (53 Pa.C.S.A. § 2307) of the said Pennsylvania Intergovernmental Cooperation Law, as amended, the summary and substance of the agreement is as follows:
A. 
The bridge located in Derry Township on Nolan Drive spanning Buck Run has been identified as structurally deficient for inclusion in the Mifflin County Bridge Replacement and Rehabilitation Program;
B. 
The project must have PennDOT's written approval;
C. 
The Township shall provide for all of the engineering and management of the bridge project, in conjunction with PennDOT, where applicable, with the County contributing up to 90% of the cost of said project, but in no event an amount greater than $63,166; the balance due for the project being funded by the Township.
D. 
The County's 90% contribution will be in the form of a reimbursement.
E. 
The Township's share is paid from its general fund and may not include state or federal resources.
F. 
The value of Township labor contributed to the project is credited at the employee's rate of pay.
G. 
Upon completion of the project, the Township will submit all paperwork and a breakdown of costs to the County for calculation of the County's share of the cost.
H. 
Mifflin County's share of costs will be reimbursed to the Township at the completion of the project.
I. 
The Township will comply with all relevant regulations which apply to its replacement and rehabilitation of the bridge or bridges.
J. 
The agreement is as otherwise adopted by this article.
The Chairman of the Board of Supervisors of the Township or, in his absence, the Vice Chairman of the Board of Supervisors of the Township, together with the Township Secretary or, in her absence, the Assistant Township Secretary, are hereby authorized and directed to execute and attest to the agreement and counterparts thereof on behalf of the Township. This authority and direction to execute the agreement shall be authorized and carried out even if changes are made after the enactment of this article, provided that, the agreement is substantially in the form approved hereby and that such changes are editorial in nature and do not affect the meaning, intent, substance or effect of the agreement as approved by this article.
