It shall hereafter be unlawful for any person, firm, company or corporation to establish, maintain or operate any mobile retail food establishment within the limits of the Borough of Chesilhurst without first obtaining a satisfactory health certificate from the Camden County Department of Health and Human Services and a retail food mercantile license from the Borough as hereinafter provided.
A. 
Any person, firm, company or corporation desiring to operate any such mobile retail food establishment shall first make application, in writing, to the Borough Clerk for a permit for that purpose. Such application shall state: a) the name and residence of the owner; b) the character of the business proposed to be conducted; c) the name of the person to be in charge of said business; and d) the place where said business shall be conducted. Such application shall further attach a current copy of a satisfactory health certificate issued by the Camden County Department of Health and Human Services.
B. 
Upon receiving such application, the Borough Clerk shall determine whether all of the information and the copy of the health certificate have been included with the application. Upon such determination, the Borough Clerk shall refer same to the Borough Council for its approval, and if said application is approved by resolution of the Borough Council, the Borough Clerk shall forthwith issue such retail food mercantile license upon payment of the following fees:
(1) 
For a mobile retail food establishment being operated from January 1 to December 31 of any year, the sum of $100.
(2) 
A seasonal license may be issued to a mobile retail food establishment for the sum of $50. Said seasonal license shall be for the period of April 1 to September 30 in the same calendar year.
C. 
A retail food mercantile license shall not be required for a mobile retail food establishment to participate in Borough-sponsored events that last no more than 48 hours, such as "Chesilhurst Day." During such events, mobile retail food establishments are still required to comply with § 236-7 of this chapter, Display of health certificate.
During all hours of operation, any person, firm, company or corporation operating a mobile retail food establishment shall display the health certificate issued by the Camden County Department of Health and Human Services in a manner that allows the health certificate to be viewed by all members of the public.
Any person, firm, company or corporation operating a vending machine, and not already holding a retail food mercantile license, shall obtain said license for the operation of each vending machine at the rate of $3 per year for each such machine.
All retail food mercantile licenses issued under this article shall expire on the last day of the calendar year during which they are issued, except that seasonal licenses shall expire on September 30 of the calendar year during which they are issued.
Any person, firm, company, or corporation violating any of the provisions of this article shall, upon conviction thereof, pay a fine of $500 for the first offense, plus serve imprisonment for a period not exceeding 90 days, perform a period of community service not exceeding 90 days, or a combination thereof. For a second offense, the offender shall pay a fine of $1,000, plus serve imprisonment for a period not exceeding 90 days, perform a period of community service not exceeding 90 days, or a combination thereof.
