Whereas, the Borough Council has determined that the regulation
of satellite dish antennas ("STDAs") is necessary in order to promote
the public health, safety, welfare and aesthetics and to ensure the
ordinary development of the Borough. STDAs mounted on the roofs of
structures present safety hazards caused by improper or careless mounting
and high winds. STDAs, whether mounted at ground level or on the roof
of a structure are unsightly and are not conducive to the aesthetics
of the Borough.

As used in this chapter:
Shall mean any apparatus which is designated for the purpose
of receiving television, radio, microwave, satellite or similar signals,
with the exception of conventional television antennas.

The application fee for a permit to install an STDA shall be
$50.

STDAs, including any structural supports, are permitted in all
zones after the following requirements are met:
a.
STDAs are only permitted as an accessory use on a lot that contains
a principal structure.
b.
Only ground level, free-standing mounted STDAs shall be permitted.
c.
Ground-mounted STDAs shall be no closer than 15 feet from any side
property line and 15 feet from any rear property line.
d.
Ground-mounted STDAs shall be located in the rear yard only.
e.
STDAs shall be designated for use by residents of the main building
only.
f.
Power control and signal cables from a ground mounted STDA to the
served structure shall be buried in accordance with the appropriate
code.
g.
No lot may contain more than one STDA as heretofore regulated.

STDAs may be mounted on a roof of a structure or in an area of a lot not otherwise provided for in subsection 19-4.1 if the applicant for a STDA permit shows, by means of a site signal survey, that the placement of the STDA in accordance with the subsection 19-4.1 would result in unreasonable interference with satellite signal reception.

Every ground-mounted STDA shall be enclosed with a wooden or
wire-mesh fence having a height of five feet, in order to prevent
unauthorized persons from gaining access to the antenna. The fence
required hereby may be constructed on the perimeter of the property
in accordance with the Code governing fences, but the screening requirements
set forth in this section shall remain in effect, even if the fence
constructed is at or near the perimeter of the property, rather than
in closer proximity to and surrounding the antenna and mount.

a.
The diameter of any STDA shall not exceed 10 feet.
b.
The dish shall be erected on a securely mounted foundation.
c.
The overall height from the mean-ground level, or in the case of
a roof-mounted STDA from the level of the roof at which point the
STDA is mounted, to the highest point of the antenna or any attachments
thereto, when extended to their full height, shall be no more than
seven feet.

The Construction Official is hereby designated as the public
officer charged with the enforcement of the terms of this section.
All complaints for alleged violation of any of the terms of this section
shall be submitted in writing to the Construction Official.
