Pursuant to N.J.S.A. 40:54-1 the public library has been created
as a public body, corporate and politic, as an agency in instrumentality
in the Town of Secaucus, County of Hudson, New Jersey under the name
"Secaucus Public Library."
The Secaucus Public Library is hereby created pursuant to N.J.S.A.
40:54-1 and the library shall have all of the powers and duties set
forth in N.J.S.A. 40:54-12 et seq. and heretofore enacted and applicable
thereto and all amendments and supplements thereto hereafter enacted.
A.
The Secaucus Public Library Board shall consist of nine members,
one of which shall be the Mayor and one shall be the Superintendent
of Schools. Seven citizens shall be appointed by the Mayor, and at
least four shall be residents of Secaucus. The original appointments
shall be for term of one, two, three, four and five years respectively
as selected by the Mayor. The Mayor and Superintendent of Schools
may appoint an alternate to act in his/her place instead with the
authority to attend all meetings of the Board and in his/her absence
to vote on all questions before the Board.
B.
Upon the expiration of the term of office of any trustee, the Mayor
shall appoint a citizen for a term of five years in the same manner
as the original appointment. Vacancies occurring on the Board of Trustees
shall be filled for the unexpired term only and in the same manner
as the original appointments are made.
The trustees of the Library Board shall make and execute under
their hands and seals a certificate setting forth their appointment
and their organization and the names of the officers elected, such
certificate to be acknowledged in the same manner as required by conveyances
of real estate, recorded in the Clerk's office of Hudson County.
Certified copy of the certificate shall be sent to the office of the
Secretary of State of Trenton and to be filed there of record.
The Board of Trustees shall make an annual report to the Chief
Financial Officer of Secaucus. The report shall include a statement
saying forth in detail all public revenues received by the library,
all state aid received by the library, all expenditures made by library
and the balance of funds available. The annual report shall also include
an analysis of the state, and condition of the library and shall be
sent to the Mayor and Council and to the Division of State Library,
Archives and History in the Department of Education.
