Editor's Note: The power of the municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. N.J.S.A. 39:4-8 requires that all traffic and parking ordinances be approved by the Division of Motor Vehicles.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Mayor or, in his/her absence, disability or inability to act, then the Chief of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $100 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Haworth are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon signs being erected as required by law.
d.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Haworth, in the County of Bergen, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or in which a violation occurs or continues.

All ordinance or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commission of Transportation 20 days after passage and publication as prescribed by law.

Parking along the east side of Stevens Place shall be reserved for Haworth Borough officials and employees and for Borough Hall business and Library business, as follows:
a. 
Commencing at the intersection of Haworth Avenue and Stevens Place, the two parking spaces beginning on the east side of Stevens Place 63.5 feet from the aforementioned intersection shall be designated "Parking for Police Vehicles Only."
b. 
The second northernmost parking space of the angled parking area on the east side of Stevens Place shall be reserved for the Mayor and the parking space immediately to the south of the parking space reserved for the Mayor shall be reserved for the Borough Administrator.
c. 
A total of 14 parking spaces to the south of the spaces referred to in Subsection b above shall be reserved for patrons of the Library and persons visiting Borough Hall on business.
d. 
The parking spaces on the east side of Stevens Place to the south of the intersection of St. Nicholas Avenue and Stevens Place shall be designated as parking for Borough employees.
e. 
Parking on the south side of Haworth Avenue between Stevens Place and Owatonna Street shall be limited to one hour on days that Borough Hall is open, and at such times shall be reserved for persons visiting Borough Hall on business.
f. 
The parking lot area (containing four parking spaces) adjacent to the Haworth Municipal Center that begins 127 feet from the intersection of Haworth Avenue and Stevens Place on the east side of Stevens Place shall be designated "Parking for Police Vehicles Only."
g. 
Penalties. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection, or any supplement thereto, shall be liable to a penalty of not more than $50 for each violation.
h. 
Signage. The Haworth Police Department is hereby authorized to post appropriate signage and enforce the provisions hereof.

In any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to P.L. 1977 c.202 (C.39:4-197.5), P.L. 1975 c.217 (C.52:27D-119 et seq.) or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. State, County, or municipal law enforcement officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped on both public and private property. No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.
Pursuant to P.L. 1989, c.201, the penalties for violations must be $130 for a first offense and for a subsequent offense must be a fine of at least $150 and up to 90 days community service on such terms and such form as the Court shall deem appropriate, or any combination thereof.

For a violation of the provision of this section or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding 15 days, or both; except that for a violation of a section of Article 11 [N.J.S.A. 39:4-80 et seq.], or 13 [N.J.S.A. 39:4-105 et seq.], 14 [N.J.S.A. 39:123 et seq.] or 17 [N.J.S.A. 39:4-140 et seq.] of this section or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not less than $50 or more than $200 or imprisonment for a term not exceeding 15 days, or both.

a. 
No person shall park a vehicle on the northerly side of Massachusetts Avenue beginning at a point 45 feet easterly from the northeasterly corner of the intersection of Massachusetts Avenue and Schraalenburgh Road and running a distance of 405 feet in an easterly direction along Massachusetts Avenue except Borough of Haworth residents who have been issued parking permits as set forth herein.
b. 
The Chief of Police shall designate 45 spaces along the portion of Massachusetts Avenue described above as "Permit Parking for Borough of Haworth Residents Only" and signs shall be posted accordingly.
c. 
Borough residents interested in parking along the portion of Massachusetts Avenue described above shall make application for a parking permit to the Police Department; the applicant shall show the Chief of Police or his designee satisfactory evidence of residence in the Borough of Haworth. The Police Department shall issue a permit to all Borough of Haworth applicants.
d. 
Permits issued shall indicate the date of issuance and must be visibly displayed in the left (driver's) side rear window.
e. 
Any person who violates this section shall, upon conviction thereof, be punished by a fine not exceeding $100. A separate offense shall be deemed committed on each and every day during or on which a new violation occurs or continues.
f. 
Pursuant to the provisions of N.J.S.A. 39:4-135, angle parking shall be permitted on that portion of Massachusetts Avenue described above, and the Haworth Police Department is hereby authorized to post appropriate signage.
