No person shall cut, injure, deface, remove or disturb any tree,
shrub, fence, bench or any other structure owned or erected by others
in parks, playgrounds or recreational facilities of the Borough; nor
shall any person pick, cut or remove any shrub, bush or flower, or
mark, write, paint, or in any way deface any fence, bench or other
structure within the above-named areas; nor shall any person dig or
remove any soil, rock, sand, stone or make any excavation by tool,
equipment or other means or agency.

No abusive, profane or indecent language or nuisance noises
shall be allowed or permitted which shall be offensive or annoying
to other members of the public.

No dogs shall be allowed to run loose in parks, playgrounds
or recreational areas of the Borough. All pet owners shall be responsible
for wrapping and placing in proper receptacles any excretion of such
animals on park property.

No person shall carry or possess firearms of any description,
or air rifles, spring guns, bows and arrows, slings or any other forms
of weapons potentially inimical to wildlife and dangerous to human
safety, or any instrument that can be located with and fire blank
cartridges, or any kind of trapping device. Shooting into park areas
from beyond park boundaries is forbidden.

It shall be unlawful to remain or stay in a park, playground
or recreational area before sunrise or later than one hour after sunset,
except during the ice skating season when closing time will be 11:00
p.m. However, during the ice skating season the Police Department
will have the authority to determine whether or not the closing time
shall be earlier because of conditions existing at the park.

No person shall kindle, build, maintain or use a fire, except
in places designated for such purpose. All fires shall be continuously
under the care and direction of a competent person from the time they
are kindled until they are extinguished.

No person shall hunt, molest, harm, frighten, kill, trap, pursue,
chase, tease, shoot or throw missiles at any animal, wildlife, reptile
or bird; nor shall be remove or have in his possession the young of
any wild animal, or the eggs or nest or young of any reptile or bird,
except employees of the Department of Public Works.

No person shall dump, deposit or leave any bottles, broken glass,
ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, refuse or
other trash. No such refuse or trash shall be placed in any waters
in or contiguous to any park, or left anywhere on the grounds thereof,
but shall be placed in the proper receptacles where these are provided.
Where receptacles are not provided, all such rubbish or waste shall
be carried away from the park by the person responsible for its presence,
and properly disposed of elsewhere.

a.
Any group or association exceeding 25 in number and desiring to use
any park, playground or recreational facilities of the Borough shall
apply, in writing, to the Board of Recreation Commissioners, with
the advice and consent of Council, for permission to use the same.
c.
The standards for the issuance of a use permit shall be that:
1.
The proposed activity or use of the park will not unreasonably interfere
with or detract from the general public's enjoyment of the park.
2.
The proposed activity or use will not unreasonably interfere with
or detract from the promotion of public health, welfare, safety and
recreation.
3.
The proposed activity or use will not entail extraordinary or burdensome
expense or police operation by the Borough.
4.
The facilities desired have not been reserved for other use at the
date and hour requested in the application.
d.
Upon approval of the application by the Recreation Commission, the
permit shall be issued by the Borough Clerk.
e.
Appeal from refusal of the Recreation Commission to issue a permit
shall be made to the Borough Council at its next regular meeting.

a.
Purpose. The purpose of this subsection is to prohibit the feeding
of unconfined wildlife in any public park or on any other property
owned or operated by the Borough of Allentown, so as to protect public
health, safety and welfare, and to prescribe penalties for failure
to comply.
b.
FEED
PERSON
WILDLIFE
Definitions and Word Usage. For the purpose of this subsection, the
following terms, phrases, words, and their derivations shall have
the meanings stated herein unless their use in the text of this subsection
clearly demonstrates a different meaning. When not inconsistent with
the context, words used in the present tense include the future, words
used in the plural number include the singular number, and words used
in the singular number include the plural number. The word "shall"
is always mandatory and not merely directory.
Shall mean to give, place, expose, deposit, distribute or
scatter any edible material with the intention of feeding, attracting
or enticing wildlife. Feeding does not include baiting in the legal
taking of fish and/or game.
Shall mean any individual, corporation, company, partnership,
firm, association, or political subdivision of this State subject
to municipal jurisdiction.
Shall mean all animals that are neither human nor domesticated.
c.
Prohibited Conduct. No person shall feed, in any public park or on
any other property owned or operated by the Borough of Allentown,
any wildlife, excluding confined wildlife (for example, wildlife confined
in zoos, parks or rehabilitation centers, or unconfined wildlife at
environmental education centers, or feral cats as part of an approved
Trap-Neuter-Release program).
d.
Enforcement. This subsection shall be enforced by the Allentown Police
Department and/or other municipal employees of the Borough of Allentown.

No person shall bring or consume any alcoholic beverages or
cannabis items into any park, playground or recreational area of the
Borough.

The following rules and regulations shall be applicable to the
use of the Allentown Lake Park. In the event that a rule or regulation
as set forth in the within section is inconsistent with any other
section as set forth in the within chapter, then the rules as set
forth in the within section shall take precedence.
a.
The hours of the park shall be from sunrise to one hour after sunset.
b.
No alcoholic beverages or cannabis items shall be permitted in the
park.
c.
No littering shall be permitted in the park.
d.
Only nonmotorized boats or boats with electric motors shall be permitted
on Allentown Lake.
e.
No swimming shall be permitted in Allentown Lake.
f.
No bicycles shall be permitted on the dock at Allentown Lake.
g.
No buses shall be permitted in the parking area of the park.
h.
Boat trailers shall be permitted in the parking area only for the
purpose of loading and unloading.
i.
Vendors shall only be permitted in the park by Borough permit.
j.
It is not permitted to throw anything into the lake.
k.
Parking shall be permitted only during park hours.
l.
Fires shall only be permitted in authorized areas.
m.
The sports court's and basketball court's lights may be used all
year round, provided that it shall not be used after 10:30 p.m.
n.
All boaters shall have available in the boat they are using life
jackets or United States Coast Guard approved flotation devices, which
shall be equal in number for the number of persons in the boat at
any one time.

This chapter shall be enforced by the Police Department.

Any person violating the terms of this chapter, whether as principal, agent or employee of another shall, upon conviction, be liable to the penalty stated in Chapter 1, Section 1-5. In addition, the violator shall be liable to reimburse the Borough of Allentown for the cost of damages that are incurred.

The Council of the Borough of Allentown, moved by its appreciation
of the faithful medical services rendered over a period of more than
50 years by the late Walter David Farmer to the people of this community
and the many contributions of Dr. Farmer to the well-being of this
community, desires to honor his memory.

The recreation area bordering on the Allentown Lake, which area
is partly comprised of land granted to the Borough of Allentown by
Walter D. Farmer et al, which grant, dated December 23, 1965, was
recorded in Deed Book 3762, page 367 et seq., in the Monmouth County
Clerk's office; and the recreation area is further comprised of land
granted on December 30, 1971, to the Borough of Allentown by Walter
D. Farmer et al, which grant was recorded in Deed Book 3768, page
534 in the Monmouth County Clerk's office and consisting of three
thousand eight hundred seventeen ten thousandths (0.3817) acre of
land, more or less.

The lands encompassed by the descriptions in the deeds are dedicated
in living memory of Dr. Walter David Farmer as a public park for the
enjoyment of the citizens, and the designation of the area shall henceforth
be the Dr. Walter David Farmer Park; and whereas, there is in contemplation
the erection of a suitable monument by the citizens of the Borough
of Allentown to the memory of Dr. Farmer to be placed in the park,
the Common Council of the Borough of Allentown shall provide funds
in its annual budget for the purpose of maintaining the monument and
its surroundings.
