§ 7-1 DEFINITIONS.

§ 7-1.1 Words and Phrases.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

PUBLIC HOLIDAYS

Shall mean New Year's Day; Martin Luther King Jr.'s Birthday; Lincoln's Birthday; Presidents' Day; Good Friday; Memorial Day; July 4th; Labor Day; Columbus Day; General Election Day; Thanksgiving Day and Christmas Day.

§ 7-1.2 Official Time Standard.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

§ 7-2 AUTHORIZATION FOR THE CLOSING OF ANY STREET.

a. The Mayor, and in the event of his/her absence, disability or inability to act, the Chief of Police or the ranking Police Officer is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.

b. Any regulations promulgated by the Chief of Police or designee and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

c. Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.

d. Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

§ 7-3 TOW-AWAY.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 7-4 PENALTY.

§ 7-4.1 School Zones.

a. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this chapter or any supplement thereto, within a School Zone as established by § 7-33, shall be subject to the following penalties:

1. First Offense. A fine of $75.

2. Second Offense. A fine of $100.

3. Third Offense. A fine of $125 for each conviction and a period of community service for each conviction which shall be left to the discretion of the Municipal Court.

b. Mandatory Court Appearance Required. Any person issued a summons charging a violation of this chapter within a School zone, except as expressly provided by New Jersey Statute, shall personally appear in Municipal Court to plead or otherwise respond thereto and may not waive the appearance by use of the mails or otherwise.

§ 7-4.2 Non-School Zones.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this chapter or any supplement thereto, in a non-school zone, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

§ 7-5 EFFECT OF CHAPTER.

If any part or parts of this chapter are, for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

§ 7-6 REPEAL.

All former traffic ordinances of the Township of West Orange are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

§ 7-7 PARKING.

§ 7-7.1 Regulations Not Exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statue or as hereinafter provided.

§ 7-7.2 Parking Prohibited During State of Emergency.

a. Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. The effectiveness of this subsection is contingent upon the signs being erected as required by law.

c. Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

§ 7-7.3 Temporary Parking Prohibition for Snow Plowing and Removal.

a. Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.

The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that the parking will not interfere with the normal flow of traffic.

b. Any unoccupied vehicle parked or standing in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

c. The effectiveness of this subsection is contingent upon signs being erected as required by law.

d. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

§ 7-8 CONSTRUCTION ZONE: TRAFFIC CONTROLS FOR STREET AND HIGHWAY CONSTRUCTION AND MAINTENANCE OPERATION AND ADOPTION OF MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES FOR STREETS AND HIGHWAYS. (Municipal roads only)

§ 7-8.1 Controls Established for Construction Zone.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.

The Township of West Orange, in the County of Essex, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

§ 7-8.2 Pre-Construction Meetings.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Chief of Police or his or her designee in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Chief of Police or his or her designee is in violation of this section.

§ 7-8.3 Hazardous Conditions.

The person, contractor, or utility shall provide the Chief of Police or his or her designee with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason the emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Chief of Police or his or her designee to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility for such condition.

§ 7-8.4 Hours.

There shall be no construction, maintenance operations, or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m., except for emergencies. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Chief of Police or his or her designee. If it is determined by the officer in charge that construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

§ 7-8.5 Road Closings and Detours.

Road closings and/or traffic detours shall not be permitted unless approved by the Chief of Police or his or her designee.

§ 7-8.6 Traffic Directors.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Chief of Police or his or her designee that same is necessary to provide for the safety and expeditious movement of traffic.

§ 7-8.7 Stop Work.

The Chief of Police or his or her designee shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

§ 7-8.8 Site Preparation.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

§ 7-8.9 Violations and Penalties.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days.

A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

No person shall park a vehicle on any street between the hours of 2:00 a.m. and 5:00 a.m. of any day. The provisions of this subsection shall not apply to the following streets or parts of streets:

b. Streets or parts of streets which are subject to the restrictions and controls of Subsections 7-14.6, 7-14.7 and 7-14.8.

§ 7-14.6 Winter Parking Restrictions.

In order to afford the Township the opportunity to clear the streets of snow and to open the highways of West Orange to traffic, during the period from November 15 at 12:00 midnight to April 15 at 12:00 midnight during any year, no vehicle shall be permitted to park on any of the streets or parts of streets described below.

The streets or parts of streets shall be subject to the following alternate side of the street parking restrictions. No person shall park a vehicle on Monday and Tuesday and no person shall park a vehicle on Wednesday until 5:00 p.m. upon the side of the streets or parts of streets indicated in Column A.

No person shall park a vehicle on Thursday, Friday or Saturday upon the side of the streets or parts of streets indicated in Column B below. The streets included in this schedule shall not be included in any other parking regulations in this section.

The exception is Tompkins Street where alternate side parking shall be observed for the entire length on the west side on Monday and Tuesday; for the east side on Wednesday, Thursday, Friday and Saturday.

§ 7-14.10 Parking of Commercial Vehicles on Streets.

a. Definitions. As used in this subsection:

COMMERCIAL VEHICLE

Shall mean any motor vehicle, truck, pickup truck or van licensed or designated for use or used for the transportation of property or other commercial purposes on the streets and highways of New Jersey such as the regular providing and delivery of goods, wares, merchandise and services.

PARK OR PARKING

Shall mean the standing or waiting on a street, road or highway of a vehicle not actually engaged in receiving or discharging passengers or merchandise, unless in obedience to traffic regulations or traffic signs or signals.

PERSON

Shall mean natural persons, firms, associations, partnerships and corporations.

PICKUP TRUCK

Shall mean a truck or other motor vehicle with an open back designed, used or maintained primarily for the regular transportation of property or delivery of services.

STORE

Shall mean keeping for safe care or custody whether temporarily or permanently.

TRUCK

Shall mean every motor vehicle designed, used or maintained primarily for the regular transportation of property or delivery of services.

VAN

Shall mean an enclosed motor vehicle designed, used or maintained primarily for the regular transportation of property or delivery of services.

b. Parking Restrictions. No person shall park or store any commercial vehicle on any residential street, highway, right-of-way, public place or private road within the Township between the hours of 9:00 p.m. and 7:00 a.m. every day unless the following conditions are satisfied:

1. Only one commercial vehicle may be parked or stored.

2. A commercial vehicle may only be parked or stored if it cannot be legally parked or stored in a residential zoning district as provided by Chapter 25 Land Use Regulations of the Revised General Ordinances of the Township.

3. All equipment such as pipes, pipe racks and ladders must be removed from the vehicle daily and not exposed to public view.

4. Any signage or commercial markings that are permanently affixed to the vehicle must be covered with a blank metallic cover that is the same color as the body of the vehicle.

5. Any signage or commercial markings, such as magnetic lettering, that is not permanently affixed to the vehicle must be removed.

6. Any vehicle permitted to be parked pursuant to this subsection must have a single chassis body with not more than four wheels, it shall not be more than 20 feet long and seven feet high and shall not exceed 6,000 pounds registered gross vehicle weight.

c. Exceptions. Nothing herein shall be deemed to prohibit the parking or storing of commercial vehicles, or equipment related thereto, on a residential street while it is being used in the transaction of business with the owner or occupant of residential property in the area or is in the area for the purpose of installing, maintaining or performing public utility services.

d. Enforcement. Enforcement of these regulations shall be the responsibility of the Police Department. It shall also be the responsibility of all the Township departments to report any suspected violations of these regulations to the Police Department.

e. Penalties. Any person convicted of violating this subsection shall be liable to a fine of $50 for each such violation and each day in which such violation continues shall constitute a separate violation or offense.

§ 7-14.11 Parking in Fire Lanes.

Notwithstanding the provisions of Chapter 13, Subsections 13-8.2 et seq. of the Revised General Ordinances of the Township of West Orange, the Chief of Police is empowered to enforce unlawful parking within fire lanes established under Subsection 13-8.5 of Chapter 13. Complaints issued by the West Orange Police Department shall be on uniform traffic complaint-summonses and addressable in the West Orange Municipal Court.

§ 7-15 PARKING OF VEHICLES PROHIBITED DURING CERTAIN HOURS.

No truck, tow truck, flat bed truck, truck tractor, trailer, semitrailer, road tractor, pole trailer, vehicle with dual rear wheels, bus or construction equipment shall be parked between the hours of 9:00 p.m. and 7:00 a.m. prevailing time on any street in the Township.

§ 7-16 ROUTES FOR TRUCKS OVER FOUR TONS.

Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described are hereby designated as routes for vehicles OVER four tons registered gross weight. All trucks having a total combined registered gross weight of vehicle plus load in excess of four tons shall be excluded from all streets, except for those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pick up and delivery of materials.

Exceptions from the provisions of this section are emergency vehicles, buses, garbage trucks and public road maintenance vehicles.

§ 7-26.3 Unscheduled Bus Stops.

The driver of a bus except school buses, commuter shuttle buses, summer shuttle buses, senior citizens buses and buses for the handicapped and disabled, shall not stop the vehicle upon any street other than at a designated Bus Stop to pick up or drop off passengers.

§ 7-26.4 Buses, Parking, Stopping and Standing Prohibited.

The parking, stopping or standing of any bus on any public street is prohibited except in Bus Stops as specified in Subsection 7-26.1 and where permitted by Subsection 7-26.3.

§ 7-27 TAXI STANDS.

The locations described are hereby designated as Taxi Stands. No vehicle other than a taxi shall be permitted to occupy these locations during the times indicated.

Such spaces are for use by persons who have been issued special identification cards, plates or placards issued by the New Jersey Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

§ 7-32.6 Signs, Pavement, Markings, Installation and Maintenance.

The owners of the premises referred to in Subsections 7-32.2 and 7-32.3 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.
