The fees and rates at Ginny Duenkel Pool for 2016 shall be as follows:
a. 
Rec Shelter Parties. Parties to be held in Rec Shelter area only during the months of July and August from 6:00 p.m. to 8:00 p.m., seven days a week, 25 person maximum. Fee is $100 for rental of Rec Shelter and a fee of $3 per person for non pool members and no charge for members.

As used in this section:
a. 
The term "family" shall mean a husband, wife and all unmarried children between the ages of two years and 21 years who reside in the same household.
b. 
The term Senior Gold shall refer to former residents of West Orange over the age of 60 who meet all of these additional requirements. 1) Age 60 or older. 2) A former resident for a minimum of 20 years. 3) A pool member for a minimum of the last five consecutive years.
c. 
The term Junior Limited shall be for members of the Swim Team whose families do not have full membership. These pool members shall be permitted to use the pool for swim team meets and practices only.

The availability of the Toby Katz Community Center ("Center") has prompted many organizations and individuals to inquire about renting it for various functions and social gatherings. This section establishes a fee schedule to be charged by the Township when renting the Center to the public. It is the intention of the Township to restrict rentals to West Orange residents and West Orange based groups and organizations.

As used in this section:
ALCOHOLIC BEVERAGES
Shall mean beer and wine only may be served at the Center. Liquor and distilled spirits are expressly prohibited.
CATEGORY I
Shall mean and includes all branches and departments of Township government.
CATEGORY II
Shall mean any bona fide resident of the Township and any organization, club, association or similar group which is native to the Township.
CATEGORY III
Shall mean any commercial or business entity, or representative thereof, which in the reasonable judgment of the Director provides services or assistance to the residents of the Township.
DIRECTOR
Shall mean the Township Director of Recreation and Cultural Affairs.
FACILITY
Shall mean the Toby Katz Community Center.
TOWNSHIP
Shall mean the Township of West Orange.

The following rental rates shall be in effect for those desiring to use the facilities at the Toby Katz Community Center:
a. 
Category I. No charge for meetings or social affairs.
b. 
Category II. An hourly rate of $115 with a minimum charge of three hours and a maximum rental of six hours. There shall also be a security deposit of $125 per event payable in advance.
c. 
Category III. An hourly rate of $150 per hour with a minimum charge of three hours. There shall also be a security deposit of $175 per event payable in advance.
d. 
Extra Room Charge. For Categories II and III there shall be an additional charge of $50 per hour for use of both the skate room and the lake room.

a. 
The renter shall be solely responsible for all liquor liability related to the rental and the Township's liquor liability insurance policy shall not cover the renter or the event.
b. 
The renter shall be liable for any damages cause to the facility and the Township shall have the right to collect additional payments from the renter that may exceed the security deposit fee to cover the costs to repair the damages caused to the facility.
c. 
The renter shall be responsible for obtaining all required licenses, permits and approvals for the event as required under law.

The Director may elect to treat a Category II entity as a Category I entity if it is in the best interests of the Township.

Responsibility for administering this section shall lie with the Director.

The availability of the Oskar Schindler Performing Arts Center has prompted many organizations and individuals to inquire about renting it for various productions and social functions. This section establishes a rate schedule to be charged by the Township to any organization or individual wishing to rent the facility. The party renting the facility will be required to execute an agreement with the Township.

The rate for the rental and use of the Oskar Schindler Performing Arts Center shall be as follows:
Category A
For organizations or individuals desiring to rent and use the facility for a performance or function open to the general public the rate shall be $2,500 for each calendar day the facility is in use by this organization or individual
Category B
For business or commercial organizations desiring to use the facility for a business purpose or for a function or performance not open to the public the rate shall be $5,000 for each calendar day the facility is in use by this organization

The following exemptions shall apply to the rate schedule for the rental and use of the Oskar Schindler Performing Arts Center:
a. 
The Director of Recreation may exercise his/her reasonable judgment and determine that it is in the best interest of the Township to charge a Category (B) organization the rate associated with a Category (A) organization or individual;
b. 
West Orange Theater Under the Stars shall be exempt from the payment of any fees; and
c. 
The Township Council may exercise its reasonable judgment and waive any fee.

An organization or individual desiring to rent and use the Oskar Schindler Performing Arts Center shall provide the Township with a certificate of insurance from an insurance company acceptable to the Township evidencing:
a. 
General liability insurance in the amount of $1,000,000 occupancy and $2,000,000 aggregate or an amount deemed necessary by the Township Attorney; and
b. 
The Township named as an additional insured under the organization or individual's policy.
The Township Attorney, however, may waive the above requirement for insurance if he/she determines that under the circumstances the production of an insurance certificate is not necessary. All waivers shall be subject to approval by the Council.

The organization or individual renting the facility shall agree to defend, indemnify, and save harmless the Township, its officers, officials, agents, and employees from any and all liability, claims, losses, suits, actions, demands, all damages, costs and attorney fees that may arise as a result of activities or actions of the Township at the Oskar Schindler Performing Arts Center.

Responsibility for administering this section shall lie with the Director of Recreation.

The Township shall provide a site for the program. The site shall be a minimum of 6,000 square feet. The site shall be subdivided into at least 16 plots. Each plot shall be a minimum size of 100 square feet. Each plot shall be clearly delineated and labeled. Use of the site by unauthorized individuals shall be prohibited. Additional space shall be provided for storage and parking.

The Township shall enclose the garden with fencing. The Township will provide a water source along with a hose reel of sufficient length to service all plots. Additionally, the Township shall provide an electrical outlet.

Rental forms shall be available from the West Orange Recreation Department. Rental of plots shall be according to the following priority:
a. 
West Orange residents; then
b. 
After a certain date to be determined yearly by the West Orange Recreation Department, West Orange residents may rent an additional plot if any remain; and then
c. 
After a certain date to be determined yearly by the West Orange Recreation Department, nonresidents may rent a plot if any still remain available.
Renters shall pay an annual rental fee for each plot. The fee to be paid shall be established by the West Orange Recreation Department. Additionally, the renter shall be required to pay a deposit. The deposit shall be returned to the renter provided the plot is returned to its natural fallow state by December 1st of the year.

a. 
The West Orange Recreation Department shall have the right to ban certain nonorganic fertilizers, herbicides, fungicides, insecticides and other products that may be either potentially harmful to the environment or to the area residents.
b. 
Individual renters shall be limited to a maximum of two plots annually.
c. 
Hours of operation shall be daily from 6:00 a.m. to 8:30 p.m. The hourly policy shall be subject to administrative review by the West Orange Recreation Department.

This section establishes a set of rules for the use of the Township of West Orange Skate Park for all persons utilizing the facility.

a. 
The skate park is a skate at your own risk facility designed for skateboarding only. The skate park shall not be supervised and users shall skate at their own risk.
b. 
The skate park shall open, weather permitting, during posted hours only. Monday through Saturday 9:00 a.m. to Sunset and Sundays 10:00 a.m. to Sunset.
c. 
No skating is permitted when the equipment is wet and/or icy.
d. 
All participants under the age of 17 must wear a helmet as mandated by New Jersey state law. Helmets, knee, elbow and wrist pads are strongly recommended for all skaters.
e. 
All participants must wear proper footwear and clothing at all times.
f. 
Only skaters are allowed in the skate park area. No spectator shall be allowed in the skating area.
g. 
All participants must skate in such a manner to avoid collision with other skaters.
h. 
The use of profanity or abusive language, vandalism, fighting and other aggressive or disruptive behavior shall result in the loss of privileges at the skate park.
i. 
Graffiti or purposeful defacing of the park and/or equipment shall result in prosecution.
j. 
No food or drink is permitted inside the skate park.
k. 
The use of drugs or alcohol within the skate park is prohibited and shall result in prosecution.
l. 
Smoking is not permitted in any area of the park.
m. 
Pets are not permitted within the skate park.
n. 
No organized events of any kind are allowed without the approval of the West Orange Recreation Department.
o. 
Skateboarding is discouraged outside the skate park.
p. 
All other Township of West Orange Park Rules and Regulations apply.
q. 
Failure to abide by these rules and regulations may result in the suspension of an individual's ability to use the skate park or the issuance of a fine by the Township of West Orange.

Any person convicted of violating any section this section shall be subject to:
a. 
A fine of not less than $35 and no more than $500; and
b. 
Suspension of the person's ability to the use the Township of West Orange Skate Park.
Any violation of the provision of this section which also violates any other federal, state, or local law shall not preclude prosecution under of those federal, state or local laws.
