No entrance driveway to private property shall be constructed within the limits of any street, avenue or highway, in the Borough of North Caldwell, without a permit therefor having been first obtained authorizing such construction.

The owner of the premises affected by such improvement, or his duly authorized agent, shall first make application to the Borough Engineer in writing, upon forms to be provided therefor, for a permit stating the name of the owner and address of the property affected thereby and the location, character and extent of the proposed improvement. Said application shall be accompanied by a permit fee of $30 to defray the expenses of processing said application.

Upon receipt of the application, the Borough Engineer shall inspect the site of the proposed work and shall authorize the issuance of such permit, upon condition that said work shall conform to the typical section as shown on the permit and to existing or proposed final street grades, and that provision shall be made for adequate street drainage across the driveways, and said work shall conform to further requirements of the Borough Engineer due to existing topography conditions at the site of the proposed driveway.

Upon approval by the Borough Engineer of said application and the conditions upon which the same is granted, the Borough Engineer shall forthwith issue such permit, without charge, and such work shall be done only in accordance with the application and the conditions approved by the Borough Engineer. Upon completion of said work, said permittee shall advise the Borough Engineer of such completion, and said Borough Engineer shall make inspection thereof and certify to satisfactory completion.

Any person, firm or corporation who shall violate the terms and provisions of this article, or any part thereof, shall, upon conviction, be liable to a penalty as stated in Chapter 1, Article II General Penalty, Section 1-5 et seq., in the discretion of the Judge. Each day that such violation shall exist shall be construed as a separate violation of this article.
