Every person, firm or corporation that shall sell, offer or expose for sale or distribute or engage in the business of processing or otherwise handling of milk, milk products and fluid milk products in the Borough of North Caldwell shall make application in writing to the Board of Health of the borough for a license for that purpose.
Upon the granting of every such license, the Board of Health shall furnish to the licensee one sign for each vehicle or conveyance used by each licensee for the sale and distribution of milk products. Such sign shall be conspicuously placed on the right side of such vehicle or conveyance and shall not be removed therefrom until the expiration or revocation of the license. The license issued for the sale of milk in a store or other building or for a bottling plant, depot or station shall be conspicuously displayed in such store, bottling plant, depot or station. Such licenses shall not be sold, assigned or transferred. Every license issued by the Board of Health for the sale or distribution or bottling of milk shall be issued in the name of the owner of the vehicle, store, bottling plant, depot or station in which the milk shall be sold or handled.
The annual license fee for each wagon, vehicle, milk plant, milk depot or premises used in the distribution or sale of milk products shall be $5. (N.J.S.A. 24:10-57.10)
All license shall be renewed on or before the first day of January next year after the issuance thereof.
Each license shall be granted on the condition that it is subject to suspension or revocation for violation of any of the provisions of this chapter or of any regulation promulgated by the Board of Health thereunder.
All premises whereon milk, milk products or fluid milk products are handled for the purpose of sale or distribution in the Borough of North Caldwell shall be open for inspection by the Board of Health, the Health Officer or its or his agents at any and all times.
It shall be unlawful for any person, firm or corporation to sell, expose for sale, distribute or have in possession with intent to sell or distribute in the Borough of North Caldwell milk, milk products or fluid milk products which have been produced upon premises whereon any person shall be ill with a communicable disease, except under such conditions as may be imposed by the Board of Health; and notice shall immediately be given said Board of Health upon knowledge of the existence of any such disease upon such premises, and any person failing to give such notice shall forfeit his license to sell or deliver milk in the Borough of North Caldwell until special permission therefor has been obtained from the Board of Health.
Nothing contained in this chapter shall be construed to require a license for the possession, sale or delivery of condensed (preserved) or evaporated milk in hermetically sealed cans, or the sale of milk by the glass to be consumed on the premises of sale; provided, however, that no milk or cream shall be sold or exposed or offered of sale in the borough except from or in bottles or single service containers which have been mechanically filled, capped and handled in conformity and in accordance with the requirements of the statutory provisions of the State Health Department regulations and of this chapter.
Samples of each of the products referred to in this chapter must be furnished without cost to the authorized agents of the Board of Health of the Borough of North Caldwell whenever required.
In addition to other remedies provided by law, any person who violates any provision of or order promulgated under this chapter shall, upon conviction thereof, be liable to a fine of not more than $100 for each violation. (N.J.S.A. 24:10-57.10)
