There shall be a Department of Law, the head of which shall be the Township Attorney. The Township Attorney shall be appointed by the Township Committee for a one-year term and receive such compensation as shall be provided by contract.

The Township Attorney shall be the legal advisor to the Township Committee and to all departments except those handled by the Township Prosecutor, the Board of Adjustment Attorney and the Planning Board Attorney. The Township Attorney shall prosecute or defend actions and proceedings by and against the Township and every department thereof. In furtherance of these general powers, and without limitation thereto, the Township Attorney shall, when requested by the Township Committee:
a. 
Advise the Township Committee as to the form and sufficiency of all ordinances and resolutions prior to their passage.
b. 
Review and approve all contracts, deeds, documents and instruments prior to the execution thereof by or on behalf of the Township.
c. 
Conduct or defend appeals from orders, decisions or judgements affecting any interest of the Township, as the Township Attorney may in his discretion determine to be necessary or desirable or as directed by the Township Committee.
d. 
Subject to the approval of the Township Committee, have power to enter into any agreement, compromise or settlement of any litigation in which the Township is involved.
e. 
Render opinions in writing upon any question of law submitted to the Township Attorney by the Township Committee with respect to their official powers and duties or the powers and duties of any officer of the Township.
f. 
Maintain a record of all actions, suits, proceedings, and matters which relate to the Township's interest, and report thereon as the Township Committee may require.

A Township Prosecutor may be appointed by the Township Committee. The Township Prosecutor shall serve for a one-year term and receive such compensation as may be agreed to. The Township Prosecutor shall have the same qualifications required of the Township Attorney and shall have the power and duty of conducting prosecutions for crimes and offenses charged by law enforcement and Township personnel cognizable by the Municipal Court of the Township, including violations of ordinances of the Township, complaints of or "against" any department under State Law and for violations of rules and regulations duly promulgated by any Department, except such crimes and offenses as it may be the duty of the County Prosecutor to prosecute.

Whenever the Township Attorney deems that the interest of the Township so requires, the Attorney may, with the approval of the Township Committee, appoint special counsel to assist him in the preparation, trial or argument of such legal matters or proceedings as he may determine. If the Township Attorney should be disqualified with respect to any matter, the Township Committee may appoint special counsel to represent the Township for and with respect to such matter.

All papers, documents, memoranda, reports and all other materials relating to the administration of the Department of Law shall be and remain the property of the Township. Upon the termination of his service with the Township, the Township Attorney shall forthwith surrender to his successor all such property, together with a written consent to substitution of his successor in all legal actions and proceedings then pending to which the Township is a party, as the Township Committee may require.

Pursuant to P.L. 1988, c. 110 of the Law of New Jersey, the position of Chief Financial Officer in the Department of Finance is created.

There is hereby created the position of Chief Financial Officer.

The individual so appointed to the position of Chief Financial Officer by the Township Committee shall perform the duties and obligations of this position in accordance with P.L. 1947, c. 151 (C. 52:27BB-26 et seq.) and N.J.S.A. 40A:9-140-1 et seq., as amended.

The Chief Financial Officer shall be a certified municipal finance officer having successfully fulfilled the requirements as set forth in N.J.S.A. 40A:9-140.2, as amended. Commencing January 1, 1991, no person shall be appointed or reappointed as the Chief Financial Officer unless he/she holds a municipal finance officer certificate issued pursuant to law or unless on or before February 22, 1989 such individual has been granted tenure pursuant to N.J.S.A. 40A:9-140.8, as amended.

The Chief Financial Officer shall serve a term of four years and continue to hold such office during good behavior and efficiency, and shall not be removed therefrom except for just cause and then only after a public hearing upon a written complaint setting forth the charge or charges against him, or upon expiration or revocation of certification by the Director of the Division of Local Government Services.

Upon the just cause removal by the Township Committee, upon the expiration or revocation of certification or upon the death, resignation or other vacancy created in the office, the Township Committee shall appoint a successor Chief Financial Officer, which individual shall satisfy all requirements as set forth herein.

The Chief Financial Officer who has served in that position for a period of not less than five consecutive years, who is a holder of a Municipal Finance Officer certificate shall be granted tenure upon filing with the Township Clerk and with the Division of Local Government Services in Department of Community Affairs a notification evidencing his/her compliance.

There is hereby created the Department of Public Works, the head of which shall be the Superintendent of Public Works.

The Department of Public Works shall provide for the maintenance, care, repair and cleaning of all Township streets and roads, drainage facilities, signs and traffic markers, Township automotive and radio equipment and maintain Township buildings and public places.

The Superintendent of Public Works shall:
a. 
As directed by the Township Administrator, provide for the supervision of the Department for the maintenance, care, repair and cleaning of all Township streets and roads, drainage facilities, signs and traffic markers, Township automotive and radio equipment and maintain Township buildings and public places.
b. 
The Superintendent submit monthly reports of all work performed, services rendered and inspections made during the previous month. In connection therewith, the Superintendent or designated member of the Department shall investigate all complaints from residents and taxpayers of the Township relating to the operations under the Department of Public Works.
c. 
Recommend to the Township Administrator and prepare an analysis of items to be included in any capital budget of the Township. In connection therewith the Superintendent of Public Works shall attend meetings of the Township Committee as required to provide the necessary input as to capital projects and address complaints relating to the operations of the Department.
d. 
Consult with and assist the Township Administrator with labor negotiations with members of the Department.

The Superintendent of Public Works, as a full-time employee of the Township, shall be eligible for tenure after five continuous years of employment and shall be subject to removal without good cause as provided in N.J.S.A. 40A:9-154.6.

The Superintendent of Public Works is a non-union supervisory position appointed by the Township Committee for five years.
