[Ord. 168, 8/11/1992, § 1400]
In interpreting and applying the provisions of this chapter,
they shall be held to be the minimum requirements for the promotion
of the health, safety, morals and general welfare of the Township.
This chapter is not intended to interfere with or abrogate or annul
other rules, regulations or ordinances of the Township provided that
where this chapter imposes a greater restriction upon the use of land
or premises or upon the construction of a building or requires larger
open spaces than are imposed by such other rules, regulations or ordinance,
the provisions of this chapter shall control.
[Ord. 168, 8/11/1992, § 1401]
All Ordinances or parts of Ordinances inconsistent herewith
are hereby repealed, including the Old Lycoming Township Zoning Ordinance,
enacted on December 10, 1974, and its amendments. Nothing in this
chapter shall be construed to affect any suit or proceeding now pending
in any court or any rights accrued or liability incurred or any cause
or causes of action accrued or existing under any Ordinance repealed
by this chapter. Nor shall any right or remedy of any character be
lost, impaired or affected by this chapter.
[Ord. 168, 8/11/1992, § 1402; as amended by Ord. 231, 10/14/2008; and by Ord. 271, 11/10/2015, Art. 11]
The provisions of this chapter are severable and if any provisions,
sentence, clause, Section, part or application thereof shall be held
illegal, invalid or unconstitutional, by a court of competent jurisdiction,
such illegality, invalidity or unconstitutionality shall not affect
or impair any of the remaining provisions, sentences, clauses, Sections
or applications. It is hereby declared to be the legislative intent
of the Township, that this chapter would have been adopted had such
illegal, invalid or unconstitutional provision, sentence, clause,
Section or part not been included therein and if such illegal, invalid
or unconstitutional application had been specifically exempted therefrom.
