The City shall sell cemetery plots in the City of Neosho IOOF Cemetery on a first-come, first-served basis for cash in an amount to be determined by the City Council by resolution from time to time. From and after January 21, 2020, hereinafter, the price per lot may be modified by a duly passed resolution. The price per plot shall be six hundred and fifty dollars ($ 650.00).

Upon receipt by the City of the full purchase price of a cemetery plot or plots, the City Manager shall execute a cemetery deed, which shall be attested by the City Clerk, recorded by the Newton County Recorder of Deeds, and delivered to the purchaser.

Funds from plot sales shall be split evenly between the City of Neosho IOOF Cemetery trust account and the IOOF Cemetery operations fund. All funds placed into the trust shall be invested by the City, and the interest income from said trust account shall be used solely for the purpose of maintenance, improvement, and administration of the City of Neosho IOOF Cemetery, and the principal thereof shall not be invaded.

There may be up to two (2) cremation burials in one (1) plot. A cremation burial and a traditional burial may not occupy the same plot. Any cremation burial must be contained within a vault. All openings and closings will be handled by the City or its designee.

A. 
The City of Neosho IOOF Cemetery shall be closed to public use between the hours of 12:00 Midnight and 5:00 A.M., unless otherwise posted.
B. 
The City Manager or his/her assignee may issue permits for individuals or groups to use the park grounds during the hours listed as closed.
C. 
Any person in violation of these provisions shall be guilty of trespass.

A. 
For the purpose of this Section, a "cemetery" shall be defined as a graveyard or burial ground for the depositing of the bodies of the dead, including all avenues, walks, streets and roadways located within this area.
B. 
It shall be unlawful for any person to loiter, loaf, wander in, play, desecrate or disfigure in any way the cemetery grounds, including tombstones and markers and to stand or remain idle either alone or in concert with others in a cemetery located in the City limits of Neosho. Nothing contained herein shall prevent any person from attending a funeral being conducted at a cemetery located within the City limits of Neosho.
