For the purpose of this section, the following terms, phrases, words and their derivations shall have the meanings given in this section:
AUTHORIZED PRIVATE RECEPTACLE
Any solid plastic, rubber or metal container having a tight-fitting lid, commonly known as a garbage container, and used for disposal of garbage, litter, refuse, rubbish as defined in this section. Excluded from this definition are plastic and paper bags.
AUTHORIZED PUBLIC RECEPTACLE
Any plastic, rubber, metal or wooden container owned and maintained by the Borough of Ship Bottom for use by pedestrians and the general public on public property for disposal of any garbage, litter, refuse, rubbish, trash or recyclable material as defined in this section.
GARBAGE
Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
LITTER
Garbage, refuse and rubbish as defined in this section and all other waste material which, if thrown or deposited as prohibited in this chapter, tends to create a danger to public health, safety and welfare.
PUBLIC PLACE
Any and all streets, sidewalks, boulevards, alleys, beaches or other public ways, and any and all public parks, squares, spaces, docks, grounds and buildings.
RECYCLABLE MATERIAL
Any material which would otherwise become municipal solid waste, and which may be collected, separated and/or processed, and returned to the economic mainstream in the form of raw materials or products.
REFUSE
All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles, and solid market and industrial wastes.
RUBBISH
Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary rails or tracks.

A. 
Regulations.
1. 
No person shall place any garbage, litter, refuse, rubbish, trash, recyclable material or other material of any sort, kind or description at the curb or any other place within the Borough for collection by the contractor and/or hauler, unless:
a. 
Such material is placed in an authorized private receptacle in accordance with the rules and regulations of the Borough;
b. 
The person placing the garbage, litter, refuse, rubbish, trash, recyclable material or other material of any sort, kind or description is either the owner, tenant, or guest of the owner or tenant of the property abutting the curb where such placement is made.
2. 
No person shall place any garbage, litter, refuse, rubbish, trash, recyclable material or any other material in any authorized private receptacle, except that the owner, tenant, or guest of the owner or tenant may make such placement in the authorized private receptacle provided by the owner or tenant of the dwelling house occupied by the person or persons seeking to dispose of such garbage, litter, refuse, rubbish, trash, recyclable material or other material of any sort, kind or description.
3. 
No person shall place any garbage, litter, refuse, rubbish, trash, recyclable material or other material of any sort, kind or description that would normally be placed by the person or persons described in Subsections A and B of this section at the location described above, in any public receptacle. Public receptacles are to be used by pedestrians for their convenience.
B. 
No person shall use any type of plastic bag containing any garbage, litter, refuse, rubbish, trash, recyclable material or any other material of any sort, kind or description as the sole container for curbside pick up within the Borough.

No person, including merchants owning or occupying a place of business, shall sweep into or deposit in any gutter, street or other public place within the Borough the accumulation of litter from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying property shall keep the sidewalk in front of their premises free of litter.

No person shall drive or move any truck or other vehicle within the Borough unless such vehicle is so constructed or loaded as to prevent any load, contents or litter from being blown or deposited upon any street, alley or other public place; nor shall any person drive or move any vehicle or truck within the Borough, the wheels or tires of which carry onto or deposit in any street, alley or other public place, mud, dirt, sticky substances, litter or foreign matter of any kind.

No person shall bring, cart, remove, transport or collect any litter from outside this municipality or into this municipality for the purpose of dumping or disposing thereof, unless authorized by the Borough. No truck or other vehicle containing litter which has been transported into the Borough shall be parked or allowed to remain standing on any street in the Borough or any public property for a period in excess of two hours.

Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than one $1,000 or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment, in the discretion of the judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.

No person shall cast or place or cause to be cast or placed any advertisement, handbill, circular or paper on any public street, on sidewalks, into any vestibules or yards, upon porches of any dwelling house or other buildings, or into any vehicle while on the public highways or on private property within the Borough; except that this section shall not apply to newspapers and addressed envelopes delivered to subscribers and addresses. Advertisements, handbills, circulars and papers may be distributed in the Borough, provided they are securely placed at each dwelling so as not to be blown away by the wind.
