Editor's Note: The provisions of this article were formerly included as Chapter 128, Forest, Town, Art. I, Motor Vehicles, but were retitled and renumbered at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
It shall be unlawful for any person to operate, cause to be operated, park, or walk a motor vehicle of any description in Town-owned public parks, exterior school property of the Town, public walkways, grassy areas, trails, recreational facilities, open space areas, land owned by Fire Districts or by a nonprofit conservation organization or in any other area within the Town where motor vehicles are not allowed, except in designated parking areas.
Any violation of § 179-1 shall be subject to a fine of $250 for a first offense, $350 for a second offense, and $500 for each offense thereafter; and shall be held responsible for the cost of all environmental remediation. Any vehicle used in violation of this article shall be impounded and shall be towed and stored at the owner's expense and shall not be released until all fines, court costs and fees have been paid and/or court action has been completed.
No person illegally operating any vehicle in violation of § 179-1 shall elude a police officer or Town official upon being signaled to stop or upon being told to stop, by any oral statement, siren, flashing light, hand signal or other signal. Such prohibited eluding shall include, but is not limited to, acts consisting of failing to stop, increasing speed, changing direction, turning off lights or taking action to avoid or escape from a police officer or Town official. Any person apprehended in violation of this section shall be subject to a penalty of $250 in addition to the penalty set forth in § 179-2 above.
This article shall not apply to any employee, official or agent of the Town, Fire District, a Land Trust or other conservation organization while engaged in the actual performance of his or her duties, nor to any Town or Land Trust vehicles and equipment and/or vehicles and equipment used by vendors under contract with the Town or Land Trust to provide goods or services within such facilities. This article shall not apply to emergency vehicles and those vehicles used for handicap purposes.

The Gingerella Sports Complex skate park is a skate or ride-at-your-own-risk, nonsupervised facility designed for skateboarding and in-line skating. Safety equipment (e.g., helmet, pads) are the responsibility of the user and should be worn at all times. Users of the skate park shall adhere to the following rules:
A. 
The skate park is open from dawn till dusk. No person is allowed in the skate park when it is closed.
B. 
Motorized vehicles or bicycles are prohibited within or on the skate park.
C. 
Any damage of skate park surfaces should be reported to the Westerly Recreation Department as soon as possible.
D. 
Skating when the surface is wet due to rain, snow or during skate park maintenance periods is prohibited.
E. 
Graffiti in the skate park is prohibited.
F. 
No competitive or demonstration events or amplified music are allowed without prior written approval from the Westerly Recreation Department. A Field/Facility Use Form must be filled out and submitted to the Westerly Recreation Department for review and approval prior to the event.
G. 
Smoking, drug use, and consumption of alcoholic beverages within the park is prohibited.
Any violation of this article is subject to a $25 fine for first offense, $50 for a second offense, and $75 for a third offense along with expulsion from the park. All violations will be enforced through the Westerly Police Department and the Westerly Municipal Court.
