This Part shall be known as the "Old Lycoming Township Open
Container Ordinance."

The purpose of this Part is to restrict the use of open containers
in inappropriate areas of Old Lycoming Township.

As used in this Part, the following terms shall have the meanings
indicated:
ALCOHOLIC BEVERAGES
Any drink capable of being consumed which contains ethanol
or ethyl alcohol. Such beverages are classified in four main categories,
namely: alcohol, spirits, wine and beer.
OPEN CONTAINER
Any bottle, can, flask, dish or other vessel that is open
and/or in the process of being consumed which contains an alcoholic
beverage as defined herein.

1. It shall be unlawful for any person to possess or transport any malt
or brewed beverage, beer, wine or other alcoholic beverage in an open
container in a motor vehicle or upon the streets, sidewalks, alleys
or public ways in the Township, nor shall any person possess an open
container in or upon the parking areas of a private shopping center,
grocery store, or similar establishment in the Township.
2. It shall be unlawful for any person to possess and/or consume an
alcoholic beverage in an open container in or upon any public or municipally
owned lands, including, but not limited to, the Township Building
and municipal parks and playgrounds, unless otherwise authorized by
Township officials.
3. No person shall possess or consume malt or brewed beverages, beer,
wine or other alcoholic beverages in an open container in or upon
the property of another unless that person is a guest, licensee or
invitee of the owner or occupant of the property.

Any person, establishment, operator, and the like, who violates
this Part shall be sentenced, upon conviction, to pay a fine of not
less than $25 and not more than $600 for each violation, plus costs
of prosecution. Default in payment may result in imprisonment as permitted
by law for the punishment of a summary offense.
