This chapter shall be known as the "Shamokin Electrical Code."

There is hereby adopted by the Mayor and Council of the City
of Shamokin, for the purpose of establishing rules and regulations
for the installation, extension or alteration of electrical apparatus
on, in or around any building, structure or premises within the limits
of the City of Shamokin, that code known as the "National Electrical
Code" as prepared by the National Fire Protection Association, being
the 1975 edition thereof, which will remain in effect until it is
superseded by later editions as prepared by the Association. Three
current copies of the National Electrical Code are on file in the
office of the City Clerk and are available for public use and information.
A.ย
This chapter shall not apply to the following electrical work:
(1)ย
Minor repair work such as repairing or replacing fuses, switches,
receptacles, lamps or lighting fixture parts.
(2)ย
The connection of portable electrical appliances to previously approved
permanent receptacles.
(3)ย
Electrical work and apparatus installed for or by an electric or
communication utility within the property of that utility for use
by that utility in the exercise of its function to serve the public
as a utility.
B.ย
However, such work shall be performed in conformity with the National
Electrical Code.
This chapter shall be enforced by the office of the Building
Inspector heretofore created by ordinance of the City, and the executive
official in charge shall be known as the "Building Inspector." The
Building Inspector shall, upon the installation, renewal, extension
and reception of any electric wiring and electric apparatus pursuant
to this chapter, cause an inspection or inspections to be made by
himself or his duly authorized agents, to determine that the electrical
work conforms to the provisions of the National Electrical Code and
this chapter and the provisions of the ordinances of this City and
the statutes of the Commonwealth of Pennsylvania.
No electrical work within the jurisdiction of this chapter shall
be commenced until the owner or his assignee have made an application
for permit from the Building Inspector. The permit shall be conspicuously
posted where the work is being done.
A.ย
All applications shall include plans and specifications showing the
proposed electrical work in necessary detail.
B.ย
Permits shall be issued after proper application has been made and
approved, and the permit fee paid. Fees shall be based upon the value
of the work to be done and shall be paid by the owner of the property
or his assignee. Permit fees are as follows:

If the applicant for a permit also requires additional permits for
work covered by other ordinances of the City of Shamokin, one permit
shall be issued and a fee paid, based on the total value of all work
to be done.
D.ย
If, in the course of the work, any changes are made in the plans
and specifications on which the permit has been issued, amended plans
and specifications shall be submitted. Upon payment of an additional
fee, if necessary, a supplementary permit shall be issued to cover
the charges.
The Building Inspector, in the discharge of his official duties
and upon proper identification, shall have the authority to enter
any building, structure or premise at any reasonable hour.
The Building Inspector shall be given notice at least 24 hours
prior to the commencement of work by the individual, firm or corporation
to whom the electrical permit was issued.
A.ย
All inspections shall be made to ensure that the proposed electric
work complies with the provisions of the National Electrical Code.
No electric wiring shall be concealed unless inspected and approved
by the Building Inspector or his duly authorized representatives and
the representative or representatives of the Middle Department Association
of Fire Underwriters, a nonprofit corporation, hereinafter referred
to as "Underwriters," or a similar organization that specializes in
such inspections, but such inspection or inspections shall be made
within a reasonable time after notice of the completion of the electric
work sought to be inspected for approval. A duplicate record of each
written approval made by the Underwriters or similar organization
shall be filed with the Building Inspector.

All decisions made to determine whether or not the proposed electric
work complies with the provisions of the National Electrical Code
shall be made by the Building Inspector or his duly authorized representative.
The Building Inspector or his duly authorized representative shall
have the power to stop electrical work and order the removal thereof
when he determines that such work is being installed not in conformity
with the National Electrical Code and this chapter and the provisions
of the ordinances of the City and the laws of the State of Pennsylvania.
C.ย
No inspection shall be required for temporary service entrance equipment
which shall be used to provide electricity for use in the construction
work, provided this service entrance equipment will not be ultimately
used to provide the permanent power for the installation.
D.ย
The Building Inspector may waive his inspection of all or that portion
of the proposed electrical work for which he shall have received a
duplicate record of approval by the Underwriters or similar organization
if it complies with the provisions of the National Electrical Code
and this chapter. Notice of the waiver of inspection shall be served
on the applicant so that the approved work can be concealed.

In order to safeguard persons and property against the hazards and
perils incident to defective electrical wiring and apparatus that
are or may now be in existence within the corporate limits of the
City, the Building Inspector or his duly authorized representative
is hereby given the duty to inspect with his agents and the representative
or representatives of the Underwriters or similar organization when
requested by proper authorities, or when public interest so requires,
any premises within the City at reasonable times to ensure that the
existing electrical wiring system and apparatus is not defective and
unsafe.

All decisions that the existing electric wiring system and apparatus
are defective shall be made by the Building Inspector, in writing,
on notice to the owner of the premises served forthwith personally
or by regular mail addressed to the address as shown on the latest
tax records, with the reasons for his decision.
C.ย
Upon the Building Inspector's or his duty authorized representative's
decision that the existing electric wiring system is defective and
unsafe, aforesaid, the system or portions of the system which are
defective and unsafe shall be discontinued until they are corrected
and made to comply with the provisions of the National Electrical
Code in accordance with this chapter.
Any person aggrieved by the decision of the Building Inspector
may seek relief therefrom by filing an appeal with the Board of Appeals
heretofore established under the provisions of the Building Code of
the City of Shamokin.[1]

Any person, firm or corporation who shall violate or fail to
comply with any of the provisions of this chapter shall, upon conviction
thereof before any Magisterial District Judge, be sentenced to pay
a fine of not less than $100 and not more than $300, and costs of
prosecution, and/or suffer imprisonment for up to 180 days, or both.
The continuation of such violation for each successive day shall constitute
a new and separate offense, and the person or persons allowing the
continuation of the violation may be punished as provided above for
each separate offense.
All former ordinances or parts thereof conflicting or inconsistent
with the provisions of this chapter or of the National Electrical
Code hereby adopted are hereby repealed.
Each section of this Electrical Code and every part thereof
is hereby declared to be an independent section or part of a section;
and if any section, subsection, sentence, clause or phrase of this
Electrical Code shall for any reason be held by any court to be invalid,
it is the intent that the validity of the remaining phrases, clauses,
sentences, subsections and sections of the Electrical Code shall not
be affected thereby.
This chapter shall take effect immediately upon its final passage
and publication according to law.
