[HISTORY: Adopted by the City Council of the City of Shamokin 5-12-1980 by Ord. No. 269 (Ch. 34 of the 1967 Code). Amendments noted where applicable.]
As used in this ordinance, the following terms shall have the meanings indicated:
PERSON
An individual, partnership, corporation, agency or institution owning, harboring, keeping or in charge of any animals, including any dog, cat or fowl.
No animals, including any dog, cat or fowl, shall be allowed to run at large off the premises of the person owning or keeping the same and, when off the premises of said person, shall be under the control of a person of suitable age and strength to prevent such animal from running at large or otherwise endangering lives, limbs, health or property of others.
No person shall own, keep or maintain any animals within the City of Shamokin in an unsanitary, unsafe or offensive condition productive of a nuisance detrimental to the public safety, health and comfort.
No person shall cause, suffer or allow any animals, including any dog, cat or fowl, to be upon the private property of another within the City of Shamokin without the express authority or permission of the owner of the property.
No person shall cause, suffer or allow any animal, including any dog, cat or fowl, to defecate upon any public property or private property other than the owner's within the limits of the City of Shamokin, except as set forth in ยงย 132-7 of this ordinance.

It shall be illegal within the City of Shamokin for any person or persons to own, possess, harbor or control any animal or bird which makes any noise or disturbance to the peace and quiet of the neighborhood, regardless of whether the animal or bird is physically situated in or upon private property, said noise being a nuisance, provided that, at the time the animal or bird is making such noise, no person is trespassing or threatening to trespass upon private property in or upon which the animal or bird is situated, nor there being any other legitimate cause which justifiably provoked the animal or bird.
A person may cause, suffer and allow an animal, including any dog, cat or fowl, to defecate in that area of any street or alley lying between the curblines or, where there are no curbs, in the paved area and the berm of any street or alley and in that area between the curbline or the berm and the sidewalk, provided that said person shall, immediately after said animal has deposited his feces, have said feces wrapped or enclosed and deposited in said person's garbage or in some other place approved by the Board of Health of the City of Shamokin in such a manner so as not to cause an odor or hazard to the health of any resident of the City.
Under the direction of the Board of Health, the Health Officer or such person as duly authorized by the Board of Health shall be in charge of the enforcement of this chapter, and he shall act as prosecutor in all cases of violation of the health laws, ordinances, rules and regulations or prosecution for the abatement of nuisances detrimental to the public health.

Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this chapter shall, upon conviction thereof before any Magisterial District Justice, be sentenced to pay a fine of not less than $100 and not more than $300 and costs of prosecution and/or suffer imprisonment for up to 180 days, or both. The continuation of such violation for each successive day shall constitute a new and separate offense, and the person or persons allowing the continuation of the violation may be punished as provided above for each separate offense.
All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed.
The City Clerk of the City of Shamokin shall certify to the adoption of this chapter and cause the same to be published as required by law. This chapter shall take effect immediately upon passage.
