From and after passage and publication of this chapter, it shall
be unlawful for any person or persons under the age of 18 years to
be and remain in or upon any of the public streets, alleys, highways,
footwalks or public commons in the City of Shamokin at night after
the hour of 11:00 p.m., during the life of this chapter, unless such
person or persons be accompanied by its or their parents, guardian
or other person having the legal custody of said minor person or persons
or unless said minor person or persons is in performance of an errand
directed by said parent, guardian or other persons having the care
or custody of said minor or whose employment makes it necessary to
be upon said public street, highway, footwalk or common during the
nighttime after said specified hour, provided that the above exceptions
shall not apply where said minor person or persons shall be found
playing or unnecessarily loitering in or upon said public streets
or highways, alleys, footwalks or public commons of said City.
It shall be unlawful for any parent, guardian or other person having the legal custody or care of any person or persons under 18 years of age to allow or permit any such child to go or be in or upon any of the public streets, alleys or public commons in the City of Shamokin at nighttime after the hour set out in § 189-1 of this chapter, unaccompanied by such parent, guardian or other person, unless said minor is in the performance of an errand or duty directed by such parent, guardian or other person; provided, however, that this exception shall not apply where said minor person shall be playing or unnecessarily loitering in or upon said streets, alleys, footwalks or public commons.

Any person, firm or corporation who shall violate or fail to
comply with any of the provisions of this chapter shall, upon conviction
thereof before any Magisterial District Judge, be sentenced to pay
a fine of not less than $100 and not more than $300, and costs of
prosecution, and/or suffer imprisonment for up to 180 days, or both.
The continuation of such violation for each successive day shall constitute
a new and separate offense, and the person or persons allowing the
continuation of the violation may be punished as provided above for
each separate offense.
All ordinances or parts of ordinances inconsistent herewith
be and the same are hereby repealed.
