Pennsylvania-American Water Company is hereby authorized and directed, at the request of the Borough of Homestead, to shut off the supply of water to the owner or occupant of any premises served by Pennsylvania-American Water Company, if such owner or occupant shall neglect or fail to pay for a period of 30 days from the due date thereof any rental, rate or charge for sewer, sewage or sewage treatment service imposed by the Borough of Homestead, and the water shutoff shall remain until all such overdue rentals, rates and charges, together with any penalties and interest thereon, shall be paid in full to the Borough of Homestead.
Prior to shutting off the water supply to the owner or occupant of premises served by Pennsylvania-American Water Company as provided for under the terms of this article, the Borough of Homestead shall provide at least 10 days' notice by mail of an intention to shut off the supply of water to the owner or occupant of such premises and, in addition thereto, the Borough of Homestead shall provide a written notice at the main entrance to the premises. If during such ten-day period the person liable for the payment of the rentals and charges delivers to the Borough of Homestead or Pennsylvania-American Water Company a written statement, under oath or affirmation, stating that he has a just defense to the claim, or part of it, for such rentals or charges, and that the statement is not executed for the purpose of delay, then the water supply shall not be shut off until the claim has been judicially determined.
The appropriate officers of the Borough of Homestead are hereby authorized and directed to execute a proposed agreement with Pennsylvania-American Water Company to accomplish the purposes specified in this article, which agreement shall be identical in form and content to attached Exhibit A hereto.[1]
