It is hereby determined and declared that the Ship Bottom Volunteer Fire Company No. 1 (hereinafter "fire company"), a duly incorporated fire company of the State of New Jersey, is the official volunteer fire company of the Borough of Ship Bottom.

No person shall hereafter become an active member of the fire company or any unit thereof unless at the time of appointment such person is above the age of 18 years. He/she shall be physically fit to perform the duties of a fire person as evidenced by a certificate to that effect by a practicing physician of the State of New Jersey, after a physical examination had for that purpose.

Every active member of the fire company shall, in each and every year, be required to perform at least 40% of fire duty, to be comprised of actual attendance at fires and drills.

No person shall be an active member of the fire company who is not a citizen of the United States of America.

Every person seeking to join the fire company shall make application, in writing, to the fire company. The name of each person elected to active membership in the fire company and proposed as a member of the fire company shall be presented through the secretary of the fire company to the Ship Bottom Borough Council for confirmation. Prior to confirmation by the Borough Council, the secretary shall request for each perspective member a motor vehicle record check through the Borough of Ship Bottom and a criminal record check through the Ship Bottom Police Department or MORFO Track. The secretary of the fire company shall also request a motor vehicle and criminal record check, as set forth herein, for each person who is an active member of the fire company as of the date of enactment of this chapter.

An annual statement shall be furnished to the Ship Bottom Borough Council by the secretary of the fire company, listing the fire calls, drills, record of attendance at fires and fire drills and such other information as shall from time to time be requested by the Borough Council.

All funds appropriated for the fire company by the governing body shall be accounted for annually to the governing body pursuant to N.J.S.A. 40A:14-34.

Any member of the fire company may be removed for cause and upon notice by a majority vote of the members in good standing of said fire company, or for cause and upon notice by a majority of the members of the Borough Council. Violation by any member of any of the requirements of this chapter shall constitute good cause for removal. Additionally, the following shall be considered disqualifying factors for membership and shall also be considered cause for removal:
A. 
The applicant or member was charged with an indictable offense or is presently under an indictment;
B. 
The applicant or member was charged with any offense involving domestic violence;
C. 
The applicant or member was charged with two or more offenses of driving while intoxicated as defined under N.J.S.A. 39:4-50 or was convicted of driving while intoxicated as defined under N.J.S.A. 39:4-50 within the last five years;
D. 
The applicant or member is currently on probation or has been on probation at any time within the last 12 months;
E. 
If the applicant or member pled guilty or has been found guilty of any motor vehicle moving violation five or more times within the past two years;
F. 
The applicant or member has been dishonorably discharged from any branch of military service or law enforcement agency;
G. 
The applicant or member was adjudicated by a court or found by an employer to have violated any person's civil rights;
H. 
The applicant or member was convicted of an offense involving or touching on previous public office, position or employment;
I. 
The applicant or member, having been a citizen of the United States, has renounced his or her citizenship;
J. 
The applicant or member is subject to a restraining order for harassing, stalking, or threatening, or a restraining order for any domestic-violence-related offense;
K. 
The applicant or member sold, manufactured or distributed any illegal controlled substance in his or her life;
L. 
The applicant or member engaged in the unauthorized usage of any illegal drug while employed in a position of public trust;
M. 
The applicant or member had a license suspension/revocation and/or multiple motor vehicle violations.
