There is hereby created and established the position of Code Enforcement Officer for the City, the number of which officers shall be as provided for by the Council from time to time.

Appointments to the position of Code Enforcement Officer shall be made by the City Manager and such officers shall be subject to the control, order, and direction of the City Manager. Such appointments may be revoked at any time by the City Manager or by the Council.

It shall be the duty of every Code Enforcement Officer to see to the enforcement of the Avalon Municipal Code, all ordinances of the City, and all statutes effective in the City, to preserve order and prevent infractions of the law, and to arrest violators thereof. Every Code Enforcement Officer is hereby declared to be a conservator of the peace and is hereby invested with police powers.
The duties set forth in this section may be delineated, limited, or extended from time to time, or additional duties may be assigned, by resolution of the Council.

No Code Enforcement Officer shall serve writs, summons, or other processes, except by direction of the City Manager.

Every Code Enforcement Officer shall appear as a witness whenever necessary in a prosecution for a violation of a City ordinance, this Code, or a State or Federal law; provided, however, no such officer shall receive any witness fee for such services in any action or suit to which the City is a party. All fees due for such services, if paid, shall be turned over to the City Treasurer.

It shall be the duty of every Code Enforcement Officer to conduct himself or herself in a proper and law abiding manner and to avoid the use of unnecessary force.

The City Manager may make or describe such rules and regulations for the guidance of Code Enforcement Officers as he shall see fit. Such rules, when approved by the Council, shall be binding on such officers.
