As used in this article, the following words and phrases shall have the meanings indicated, unless the context clearly indicates a different meaning.
BOROUGH
Borough of Moosic, Lackawanna County, Pennsylvania.
COMMERCIAL VEHICLE
Any vehicle other than a private passenger vehicle, including trucks, trailers, and construction equipment.
PERSON
Any individual, association, partnership or corporation, and includes any officer, employee, department, agency or instrumentality of a state or any political subdivision of a state. Wherever used in any clause prescribing and imposing a penalty, "person" includes the individual members, partners, officers and managers or any of them of partnerships and associations and, as for corporations, the officers and managers thereof or any of them.
TRUCK
A motor vehicle designed, used or maintained primarily for the transportation of property.
TRUCK TRACTOR
A motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
No person shall allow the idling and/or running while parked of a truck or a truck tractor on property abutting a residential district between the hours of 9:00 p.m. and 7:00 a.m.
Violations of this article shall be enforced by the Borough of Moosic Code Enforcement Officer or the Moosic Police Department.
Any person who violates or permits a violation of this article, upon being convicted before a District Justice, shall pay a fine not exceeding $600, and any costs incurred by the Borough of Moosic, and in default of payment of the fines and costs shall be subject to imprisonment in the Borough Jail for a period not exceeding 30 days. Each day of the violation shall be considered a separate violation and offense.
