This chapter shall be known as the "Comprehensive Land Use Ordinance of the Township of Frankford," hereinafter "this chapter."

It is the intent and purpose of this chapter:
To regulate development and provide zoning regulations for the Township of Frankford pursuant to the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq, as interpreted by decisional law.
To implement and give effect to the goals and objectives of the Master Plan for the Township of Frankford, adopted November 29, 2000, amended on October 31, 2005, and as may be amended from time to time.
To give municipal effect to the purposes of the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.

This chapter is adopted pursuant to the delegation of power and authority provided in the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq. Unless otherwise clearly appearing to be a regulation solely and exclusively adopted pursuant to Article 6 of the Municipal Land Use Law with respect to subdivisions and site plans, each provision of this chapter shall be construed and treated as a regulation of the "zoning ordinance" as contemplated in N.J.S.A. 40:55D-65. Departures from any component provisions of the zoning ordinance shall be by variance, pursuant to N.J.S.A. 40:55-70. Departures from any provisions which are solely and exclusively regulations concerning standards of subdivision or site plan approval shall be by exception pursuant to N.J.S.A. 40:55D-51.

If any section, paragraph, sentence, clause or provision of this chapter shall be determined by a Court to be invalid, such determination shall not affect, impair, invalidate or nullify this chapter as a whole and the remainder of this chapter shall remain valid and effective.

Any and all ordinances or parts thereof in conflict or inconsistent with any of the terms and provisions of this chapter are repealed to such extent as they are so in conflict or inconsistent, provided, however, that the adoption of this chapter shall not prevent or bar the continuance of or institution of any proceedings for offenses committed prior to its adoption.

Nothing contained in this chapter shall exempt any of the dwellings or buildings, or parts of buildings, covered by this section from full and complete compliance with the other provisions of this Code or any other ordinance or ordinances.
